Complete information about Section 9 under the Hindu Marriage Act, 1955 This article will educate you about Section 9 of the Hindu Marriage Act, 1955 and how to file a legal notice under that section. Marriage is considered a sacred bond and the termination of marriage is considered a betrayal of that sacred bond. There are instances when one spouse chooses to leave the other spouse and chooses to live separately without any specific reason. In such cases, the other spouse has a legal right to file an application for restoration of marital rights. Meaning of marital right Marital right basically means the right to live together. Restoration means to restore the condition after taking something illegally from a person. Thus restoration of conjugal rights means the restoration of cohabitation and marital relations between both the husband and wife i.e. husband and wife through legal intervention. The remedy available for the restoration of conjugal rights is the compulsory renewal of cohabitation when the husband and wife are living separately for any reason. When can a person exercise this right? When either of the spouses or the spouse distances himself or herself from the public without any reasonable excuse, the aggrieved spouse has the option of approaching the court for restoration of marital rights. Marital rights petition is filed under Section 9 of the Hindu Marriage Act, 1955. The restoration of a petition of marital rights under section 9 is considered as the last chance to save the marriage before it breaks down. Conditions for filing a complaint under Section 9 of the Hindu Marriage Act In order to file a petition for restoration of marital rights, it is necessary that the following conditions are fulfilled: 1. Husband and wife should not live with each other. 2. There should be no justifiable reason for the husband or wife to withdraw from the society. 3. The affected spouse should file for restoration of marital rights. Grounds for rejection of restitution of conjugal rights petition A petition for restitution of conjugal rights can be dismissed by the court in any of the following cases: Where the defendant can claim any matrimonial relief. Where the husband or wife filing the petition has committed any marital misconduct. Where the actions of the spouse filing the complaint make it impossible for the respondent to live with them. Where to file restoration of conjugal rights petition under section 9 A petition for restitution of conjugal rights can be filed with a civil court having jurisdiction over an area where- 1. The marriage took place. 2. Husband and wife used to live together for a time. 3. The wife currently resides. Steps for Restitution of Conjugal Rights Spouses who are separated from the other husband can file a petition for restitution of conjugal rights in the civil court which is justifiable. For this, the party should consider taking the services of a divorce lawyer in India who can educate him on the matter. The lawyer will tell the party about all the valid grounds and application. The burden lies on the spouse to prove that the husband has left without any reasonable excuse The court then evaluates the petition and if the court is satisfied that the case is valid, the court asks the other husband to appear to present his case. After hearing both the parties and inspecting the facts and evidence, the court may order restitution of conjugal rights by way of attachment of the property of the spouse. If the spouses are not able to respect the decree for restitution of conjugal rights, for a period of more than one year, then the aggrieved spouse has a valid ground to file a divorce against the other spouse. Another important feature under Section 9 petition is that an aggrieved wife who does not seek judicial separation from her husband can also claim maintenance under Section 25 of the Hindu Marriage Act, 1955 without filing a separate maintenance petition. If the wife is unable to maintain herself or her children financially, then maintenance can be claimed during the pendency of the petition for restitution of conjugal rights. Mera 12 saal ka beta hai 2005 me shadi hui thi. 1.5 saal se uska koi ata PTA nahi hai devorce bhi nahi de rahi hai
