When a defendant does not appear in the court proceedings on the fixed date, the court orders to proceed ex-parte and after that the case can be decided only after hearing the plaintiff. The provisions for this have been given in Rule 3, 6, 7 and 13 of Order 9 of the Civil Procedure Code. सर मे छतरपुर से हूँ मेरे पिता की मृत्यु 1984 में हो गई थी उसके बाद जमीन मेरे नाम आ गई थी और मेरी बहन का जिक्र उसमे नहीं किया गया (क्योंकि बहनो को कहा पूछा जाता था) आज मेरी बहन ने केस दर्ज कर दिया है मेरी बहन की उम्र 80 साल है जबकि 2005 में मेने अपनी जमीन अपने बच्चों के नाम कर दी थी सर इस केस में क्या मतलब निकलेगा

Sir in a suit there are three defendants among them one contested and the other two were exparte.....and subsequently the sole defendant win the suit and judgement and decree was passed........ however the plaintiff made an appeal and plaintiff/appellant issued notice to the respondents/defendants and now ....the sole defendant appeared but also one defendant (deceased who was exparte) his sons appeared and applied application for impleadment in the appeal suit, appeared now can they contest the suit.

सर, sdm कोर्ट से 116 बटवारे का मुकदमा दायर की गयी लेकिन प्रतिवादी समन प्राप्त करने के बाद भी कोर्ट में नहीं गया और sdm कोर्ट उस पर ex पार्टी डिसिशन दे दिया. अब बटवारे का डिसिशन हुए 2 साल हो गए. क्या अब प्रतिवादी उस ex party डिसिशन को मण्डल आयुक्त के पास चैलेंज कर सकता है? Pls सर reply दे दीजिए

I have got exparte decree. In 2018 only .and I have filled EP in 2019. Now in 2021 Dec . execution process started . But defendant attanded only once starting in case. And now he came and filing petition that setside decree. And stay of suite. Under limitations act sec5. Under medical ground. But they have taken that medical ground from case started day on wards it seem. Defendant son was mental disability. They have stated that we are going for treatment. So that way we have not attended. From case started on wards but actually he son was disabled from birt only. And more over his son getting pension also. But They are using this ground has a sufficient ground . Whether this case will dismissed or allowed. Pls tell me sir as our opinion
