Just about everywhere in the UK is private property. So PC 5231 continual statements that it's private property is useless and pointless. There is nothing special about private property. It's not the USA where there they can have people leave private property. In the UK, private property open to the public is a "public place". If there are no signs or indications, then the public are stupid and will use it if they want to. And they can't be punished for the failings or lack of budget of the police to put up signs and barriers. Since trespass is a civil tort, only common law can be used. And to be able to use their "reasonable" force, they need to have their enjoyment of the land to be curtailed. Looking around does not interfere with their enjoyment of the land since they don't use it (as proven by the poor state of the memorials). Also, it's reasonable *and appropriate* force. That means force can only be used if it's appropriate, not just reasonable force. And in this situation there is no requirement for any force since no one is being threatening or violent or disruptive.

What a shame if that is private property that the memorials can't be seen. The guys were respectful, so that was incredibly petty. That guy gave me the creeps. His constant repetition of having the right to use force seems to indicate the way his thoughts were lingering hopefully.

What crime were they preventing and how does the act apply simply to move someone off publicly accessible spaces?

If a sign clearly states no public access and you still despite clear signage walk onto the area you cannot in your right mind claim it’s still public accessible. Those officers are being prevented from carrying out lawful activities and having to deal with idiots with no jobs looking for a reaction for their KZbin so yes they can use force.

Also a landowner or individual acting on behalf of the landowner whom is the police can use reasonable force to remove said trespassers. It doesn’t even matter if it’s not aggravated lol, they’ve been asked to leave; they haven’t so reasonable force is used to remove them. This is all really common sense 😂 What do you not understand seriously?

@@Mrwm117 What you're missing here is that Mr Porky said he could use 'reasonable force' under the criminal law act 1967 to remove him. He can't - that is to prevent a crime or in an arrest. The police will make it up as they go along thinking it will bamboozle you. If the police knew the law, they'd become barristers.

He was right and even without section 3 criminal law act he acts on behalf of the landowner and can use reasonable force to remove the trespassers.
