The same shit happened for me this year. My BM took me to CS and I was keeping my son more than her and paying for everything. They wanted me to pay 675 a month. She then tried to get them to bump it up to 960 a month. She didn’t know I filed a custody complaint on her because she was keeping my son from me for almost a year while this was going on. The judge gave me 50/50 legal and physical custody and my payment is only 300 a month now😂

It’s called an order of default and my attorney and I capitalized off of it with all of my evidence. I still have to to pay CS cause I make more than her but I have a court order stating we share physical and legal custody of our child. So far she has been following the court order parenting plan and my son and I relationship has been restored and better than ever. He will be 3 next month and I’ll have him that week for his birthday as his mom kept him from me last year. Looking forward to it!

When I petitioned for full custody of my son, who was already living with me, I received a call from his mother FLIPPING OUT after she was served. One of the first things she said was "Do you realize I can take 17% of your check now??". It's crazy.. Even when everything was in my favor, she knew that the system worked against me and assumed because she was the mom she would win. Needless to say I won in the courts and my boy is with me. 💪🏽💪🏽

Full custody is only granted if one parent is unfit or agrees to it. Some parents would prefer to pay child support as opposed to having the responsibility of taking care of a child. State ordered CS is in place because traditionally men would walk away from their children to start a new family, and not provide support. The state was left with the financial responsibility of having to make up the gap.

Same thing happen to me I didn’t fully read my child support order I just wanted to get out the courtroom and I had already been paying my bm because me and her had a agreement, but outta nowhere she wanted that agreement in writing. I continued to pay her directly like I was already doing 5 years go by and I’m back in school so I ask her for an temporary adjustment and she wasn’t trying to work with me. At this point I go to DCS trying to get the adjustment and the Support Officer who I’ve never spoke with told me I was ordered to pay through the state and on record I’ve never paid a dime 😮 luckily for me I was able to show direct transfers from my bank account to my bms noted as (CS) and my child Support Officer accepted them as payment 😅 Its a cruel game but it happens never take anybody’s word and read your paperwork! On the other hand my bm was getting state services without claiming my support as income and they quickly cut those services and she found herself in some mess at that point I couldn’t help her like she couldn’t help me when I needed the adjustment 😅

I knew about those detail with that Eddie Curry case because a guy I knew would give his mother the child support money and she would write the check for it to the mother because he didn't have a checking account. The BM said he didn't pay and he brought in the checks from his mother to the BM and the court said none of that counted because it came from his mother and not him and the checks didn't have child support on the checks. So guys if you ain't paying through the state, make sure you write the check or money order yourself and make sure you put child support in the memo section. Dude lost 18 months of payments.

The only advice I can give for my brothers on child support is keep your finances private. Keep your raises and promotions to yourself. Even when it comes to your kids the less they know the better because they report back everything they see and hear. It's difficult but try not to pay more than your court order because you will not get credit for it and the state will offer your child's mother an opportunity to raise your child support every 3 years especially when your income increases. If you can afford it please get an attorney to represent you because although you may have to pay $500 -$1,000 for them to represent you they can express to the judge your debt to income ratio and save you thousands long term. Wear a suit to court and be respectful to the judge. Keep in mind that child support is a business for the state and they have to meet a quota by putting you on. Child support is not a typical lawsuit where you can actually win. The odds are stacked against you. I've been on for 8 years and have a court date next month. I have 2.5 years to go and I will finally be finished. Please remember that nobody is honest about their income so if you can get your paycheck electronically save it to a PDF and play with those numbers a bit. Last but not least, if you have multiple sources of income no need to list them all. List your primary and keep the others private. It's the state you're dealing with and they don't have the capacity to check with your employer or the IRS to verify your income so they rely on you to provide the information. Be smart about your career moves, if you know it's been 3 years and a modification is coming don't accept any promotions or raises until after your court hearing. I know the women here will get mad at me but it's about self preservation.

I had no idea she lost her job or applied for welfare not that it would've made a difference if I would have known. I basically got into a bad motorcycle accident when my daughter was 2 years old and she moved on to someone else.

I used to pay a landlord some years ago by the cash app and Zelle, but I always made sure to put this is for rent whenever I sent it. One time, when he passed, his son tried to say I nevr paid shit and used his parents to try to take me to court. I literally pulled out my phone and showed them the records . I said well your honor. Here's 3 years' worth of Zelle and Cash app records." Then the judge said so do you currently have a lease young man I said yes. He said well when it's over I suggest you leave asp.

I paid the state disbursement unit of my state. Never EVER give money to your ex directly, especially if you have an order. WRITE CHILD SUPPORT ON YOUR CHECKS/MONEY ORDERS before your case becomes official in the meantime.

I never agreed with how Laura handled this. She’s the poster child of don’t let this happen to you 😂. When it comes to the courts stop playing games with them. If a judge sees that one parent is constantly filing motions, that’s when they hit you. My ex did that and his support would go up every time. One judge was so pissed at him for trying to reduce again, that he went through every previous request and told him how much he would have increased his support if he reviewed the case.

This is exactly what Judge Mathis has warned guys about several times on his TV show. If you are not paying your child support through the state, the judge could decide to either accept your past history of payments, or he could ignore it. In this case, it sounded like the judge was an asshole and decided to just ignore it. That being said, in most states, you can only sue for so many years of back child support. I don't think any state would make you pay up to 18 years of back child support. Most of them limit it to like two years I think.

Child support is spending money on children. Your 19 year old college student, needs financial support. That's why CS extends to include collegiate years. You also mentioned that your daughter was 19, but that you had only been paying CS for 10 years, and the other 9? As a mother that gets $300.00 a month in child support for a 10 year old, it does do much, it takes care of her extracurricular activities. Total cost of caring for her including private school tuition is easily 1800.00 a month. I would much rather we split time, instead of having sole custody. Most men want the accolades of being a father without sacrificing their time.

I can comfirm. The state of hawaii came after me. Me and baby mama had a mutual agreement. 5 years later i received a letter from Hawaii child support enforcement agency saying i owed over 30k in child support. My babies mother had to tell them i paid what we agreed upon and she didmt want back pay. From that point on Hawaii raised it $300, more a month and it had to go through them. Its definitely a business that pays the state
