पति को सुप्रीम कोर्ट जाना चाहिए। क्योंकि इस आधार पर तो कोई भी इलेक्ट्रॉनिक और डिजिटल एविडेंस कोर्ट में एडमिट ही नही हो पायेगा। क्योंकि कॉल रिकॉर्ड टेक्स्ट मैसेज, चैट मैसेज, ऑडियो, वीडियो रिकॉर्डिंग सभी कहीं ना कहीं निजता का हनन करते है

That Petitioner relied upon decisions of Delhi High Court in the case of Deepti Kapur vs Kunal Julka on 30th June , 2020 “ It may be noted that in the impugned order the Family Court has expressed its subjective opinion that the recording comprised in the CD will certainly assist it in deciding the dispute between the parties ; and that therefore the evidence on the CD is relevant. Even otherwise, the conversation be-tween the wife and her friend, which is the subject matter of recording on the CD, in which she is alleged to have spoken about the husband and his parents, would be a 'relevant fact' as understood in law, upon a combined reading of sections 5, 7 and 8 of the Evidence Act. To that extent therefore, the contents on the CD are relevant for purposes of the divorce proceedings”.

But evidence act says, during marraige such communication is previledged but not when they are in dispute agsinst each other. They can difinitely use the same ofcourse if it is not trivial or irrelevant.

मेरा भी केस चल रहा है मेंटेनेंस का, अभी अंतरिम पे बहस होना है, मेरी वाइफ adultry में है, उसका पूरा सेक्सुअल कॉल रिकॉर्डिंग मेरे पास है, कोर्ट में मैंने जमा किया है, अब मन मे बहुत दुविधा है की कोर्ट आगे क्या फैसला करेगी, ऑडियो से तो साफ साफ जाहिर होता है कि वो adultry में है, अब इसके बाद भी क्या कोर्ट अंतरिम की राशि बांधेगी या नही बांधेगी, समझ नही आ रहा है। 21/12/21 को पेशी है।

I was reading the judgement and this is about CD had CCTV recording of the wife supposedly speaking with her lady friend, by name Sugandha, on phone and talking about the husband and his family in a manner, which the husband claims was derogatory, defamatory and constituted cruelty to him. This is about presenting the Wife phone call recording with friend by CCTV recording installed in Bed room. This is breach of privacy because its CCTV Installed in Bed room and recording private wife conversations. This is not about phone call recording between husband and wife.
