At the risk of sounding real: Do you think Kate Middleton,Duchess of Cambridge ban tourists from watching her bathe? As a needlecrafter I would hate to create and gift a $8000 piece: time and materials plus 20% and find it i. eBay for $10. Instant brand devaluation. No I do not want people to think that they have access to the work or are associated with the brand without spending $8000. It’s called marketing, PR/advertising.

Not necessarily ban. If a good location you source at goes out of business because reseller overharvesting causes them to lose a lot of customers who have no incentive to shop there for the markdowns because Resellers picked the bones dry then a good source is eliminated. Seems short sighted and not sustainable. Moderation seems warranted. Imho... if you do that to all your best sourcing locations you paint yourself into a corner of not having those locations to source from anymore as well as other resellers.. Analogy of mcdonalds clearcutting the rainforest for short term grazing of their cattle until the Earths ozone is depleted.

When I buy an item from a store, I pay for it, I then own the item. I don’t believe the ‘brand’ should be able to tell me what I can or can’t do with an item once it belongs to me. Gray Market, huh? Thrift store it is!! Thanks Chris for the heads up. 😅

I agree, we should be able to resale whatever we own. As far as Patagonia and their warranty, it should not be a legal excuse. When I buy the item they give it a warranty and it should not matter who owns the jackets if I sell it, it is still the same jacket, not like they are having to warrant an additional item. I often find new with tags items at thrift stores and should be able to sell them.

@@kb1236 unfortunately that is the world and reality we live in you can't resell it if it's new and you are not an authorized period end of story been like that forever and unless your an actual business you will not be able to be an authorized seller so only thing you can sell are used items even then if you try to sell big name brands you will most likely get an IP infraction on Amazon or Vero on eBay for selling counterfeit items so as a 30 plus year online reseller stay away from selling new items and big name brands you will never have issues with Veros or IP infractions

As a Reseller, I never make it obvious ANYWHERE that I'm a ReSeller. This includes buying huge amounts of new items in any one sale. Also, I avoid using stock photos. I've been busted so many times for that, mostly on depop and eBay. I just quit using stock photos.

Years ago when Victoria's Secret used to be a great seller, everyone would massively shop the semi annual sale in bulk and they used to have you sign a paper stating you are not reselling it. Now I don't think VS sells well anymore but I'm not certain.

This is a really great video! I stopped reselling on certain platforms that are dramatic or as you said “gives headaches.” So when I started reselling back in 2017, I started on EBay, Mercari and OfferUp/LetGo but as I kept on learning, I realized what I loved, what I didn’t, what platforms actually worked better and I actually found a niche for myself that I loved. So, I learned a lot. I still resell today. I’ve made some very decent money with it but what I used to sell was furniture and other peoples goods they couldn’t sell. I did quite well. I also am a designer myself and do a lot of upcycling which is something that works for me too. I do a lot of harvesting of the beads/stones I work with. I love my holistic business and I’ve been involved in it for over 20 years. Now regarding my niche: The niche I found that I love and works very well for me is in board games. Yes! Board games. I also love anything that’s vintage from the 80’s and 90’s. If I find these things sometimes I keep them for myself or I will resell. Reselling is an art, just like anything, I think. I think it takes an eye for design and just knowing from intuition what’s going to make a profit or not. So, with my sales and creative background, I’ve been able to resell successfully and love it. At first when I was learning, I was selling clothing because that’s what my friend that got me into this was doing and still does but for me, it was a headache and the clothing market is competitive and saturated. I didn’t like having to take a million photos and other things that came along with selling clothing. When I picked up a board game lot for $10 and flipped the games quickly for between $10-$40, I knew I loved that and I stayed with it. I just picked up a vintage 1986 Let’s Make A Deal board game but I’ll probably keep it. I also realized that I sold much faster on Mercari and the Marketplace. EBay might have eyes on it but it comes with many headaches. I’d rather go small and not deal in drama or headaches. It works for me. So now, my focus is really on my beads and jewelry as it was when I first started and if I see some cool vintage items, I’ll pick them up. I do really love reselling, thrifting and reselling for myself and others too who don’t know how. There are many different ways to make great money thrifting and reselling. I’ve had tremendous luck and now I never buy anything full price. I thanked my mom this past week for taking me to all those garage sales when I was a child. Back then I was like “this is so gross” but little did I know how valuable reselling, recycling, and upcycling would be for me today. It was like a prophecy for the future for me and today I’m so thankful. 😉 Good luck to all out there! ♥️

At the hobby store we were constantly getting MAPP pricing violations for items from a particular board game manufacturer because the manufacturer would raise the MAPP pricing on some item or another. We eventually just dropped the manufacturer, their items didn't move fast enough to deal with trying to keep up with their MAPP pricing on items that we sold maybe 1 of per year.

Thank you, pretty cool that Patagonia Rep took the time to explain their policy. Shed some great light on why brands have these policy's. Explaining the difference in expected profit margins of RA vs Sourced Pre-owned Items was on point. I do both in the Toy & Plush Categories with a Brand I specialize in. The profit margin may be smaller in my RA but the net profit is much higher. So mixed with my bread & butter items I have a good consistent income on all the platforms together. Then offloading the rest of my inventory in bulk on Whatnot has been an added plus to our business. Appreciate the video! ~pam 💯💛

How can they ban you from a brick and mortar store? If the employees know you there then just go to a different store and pay cash if you want to be extra stealthy. Seems like an empty threat because I don't see how they could ever enforce that.

It's there store they can do whatever they want it's like on ebay a seller cam block any buyer they want for no reason so don't understand why you don't think a brick and mortar store should have that same ability you ask how would they enforce it trespass you and then show your photo to every employee and let them know your banned from the store

I worked for a major retailer 20+ years ago who sold Levi's. We would get limited shipments. They put a cap on how many customers could buy at a time because they would take them to other countries & resell them.

Back in early 90s i'd sell new tagged clothing at swaps. I made a ton of money and nobody said a thing. One seller that i remember sold thousands of bootleg cassette tapes for years and nothing happened. But then around 1997-98 the state board and management started looking harder at resellers and many sellers disappeared. One unlucky storage buyer bought three 10x30 storage units full of books and tapes that belonged to the church of scientology. He tried selling them at a swapmeet and said he was threatened and harassed by the church so he stopped selling their stuff. He told me church people kept coming up to his booth and asking him where he got the books and tapes from. After that I never saw him again. I'm pretty sure one day people wont be able to sell used items at all. Some cities now stop people from having garage sales.

That's the way it should be. A store has the right to tell you that you can't buy from them; fair enough, it's their store. But if they let you buy something, the moment it's yours and not theirs, their right to say what is done with it should end. It's a basic concept called "right of first sale." A person or a company should have the right to decide who they will sell to, and how much they sell it for, but after the sale is made their rights to that item should fully transfer to the person who now owns it. It's such a basic concept I don't even know why it needs to be said.

They are trying to establish that you have agreed to terms at the time of purchase. That makes it a contract. So you can't actually be banned unless you do something that violates the contract. This is where it gets grey because what they really want is to be able to do is ban you on an assumption that you have violated the contract and force you to decide if it's worth taking them to court. Same goes with strong-arming your sales platform into banning or suspending you. This is why resellers need better supportive legislation for class actions and other remedies.

I am a minnow of a minnow of a seller but one problem brand i ran into for vintage purposes was Chanel. They forbid you from selling their vintage product unless under strict guidelines and one of those guidelines is it must come with all the original / undamaged packaging. As that is part of their brand experience . Other brands are similar to this but Chanel was the only one i have hada problem with thus far.

I have only bought items to resell. I’ve been selling on eBay for 20 years. I think I’m just gonna keep doing that ! Buying new to resell has not really interested me, but I was really fascinated to hear what the reasoning is behind it. I get the warranty thing, but if you put it in your listing that you cannot offer a warranty, wouldn’t that handle that? It is crazy that you can literally get banned from a store for reselling merchandise you bought there. Thank you so much for sharing this. I’m sure this will save many people a lot of grief.

And that brand you spoke of in the beginning, it's already selling used items from their brand on their website, just like the workout Lulu company from Canada. You will find less and less of it when sourcing.

It’s a little different, but in the couponing world, companies started trying to go after people who couponed then resold. The Supreme Court ruled that once you buy a product, it’s yours and you can do whatever you want to. I guess the stores can ban who they want but couldn’t you just go in with cash? How would they know who you are then? Ordering online would be more tricky but I don’t see how they could stop you from buying in the store.

I never understand companies that want to ban resellers for spending $$$. A lot of them do this then end up going out of business a few years later. With the way the world and economy is they should be happy to take people's money.

On the other hand there is brand preservation and the fact that they’re already a billion dollar company. I did a case study on them years ago and it was cool to hear a corporate company was encouraging and paying their office employees to go out and hike/kayak/climb which is what their gear was intended for. Now you have a bunch of Silicon Valley tech bros wearing their vests and I’m sure they want to retain their image. When you’re already making that much money they probably don’t feel the need to focus so much on squeezing as much profits as opposed to being sustainable. I mean if they offer lifetime warrant my they’re probably planning on sticking around for the long run

I got banned by Hibbett’s Sports from buying too many clearance items from their website. If their systems see my address on any order, they automatically cancel the order.

adidas outlet didnt let me buy multiple pairs. Treated me like a criminal for trying to resell outlet shoes. Outlet shoes that no one wanted i was doing them a favor. offered to sell me only one pair. I got pissed off and said cancel the sale i aint buying shit and left the store. f them.

I’d love to see law firms find ways to sue Patagonia. I own goods I should be able to set them on fire or do whatever I please to. It’s my belonging. Btw how do they ban a person? They cannot ID you when you enter the store. Or do they keep a database of banned people?! Makes no sense.

I will never buy a brand for personal use, pay full price and not be able to then resell it once I'm done using it. Makes no sense. The reselling of new items I kind of get.

There’s an auction here online that every couple of months they sell bags of Patagonia pants or shirts the same size and style, like 5 to a bag. Sometimes jackets too. They sell for good money but still way under full retail. I wondered if they were legit…

This is stuff that never made sense to me. You buy that item, that item is yours, no longer theirs. You bought and paid for their brand. They make the stuff to sell. If you aren't using it anymore, who cares what happens to it? It's kinda like the tax thing. Dealers get charged a tax to get items, we buy items, pay tax. We sell item, buyer pays tax. Then we are taxed again for making over $600 in sales. Zero sense.

Want to have your mind blown? Look at how much the annual salary is for congress, senate, etc. Then realize that all of them are millionaires. They didn't start off rich. They are all criminals, literally.

If you pay full price you can sell it and because you own it you can price it. If you work for company you cannot sell it for profit personal use only. If authorized dealer it has to be sold as same price as dealer is if you sell less they can pull line from your store. If bought from authorized dealer and you work for that place but you cannot sell. That's why alot of retail take your personal sizing and only let you buy in that size.

Unless this is specific to this particular company, MAP pricing limits the price you advertise. You can sell as low as you want when dealing with a customer but you cannot advertise or mark your price lower than the "Minimum Advertised Pricing" they assign

I know a lot of stores have similar limits… Polo, CK, Tommy, North Face, Levi’s, etc… I have experienced recently because of excess inventory some of these stores aren’t limiting clearance items because they just want to get rid of units. I think some of their policies are fluid 🤷🏻‍♀️

I got flagged for trying to sell a certain brands speed loader (for guns) I've sold a few other ones (from different brands) but this one I got told to remove it and that there brand is not allowed to be sold on eBay , warned me if I tried to re-list it, I could be suspended. I can't recall the brand though.

Maybe you could hire some people to go in and buy thirty items, then pay in cash. Or maybe even recruit family and friends to help you get around their policy.

So this is only for nwt items or is it also for used items? Like if I bring in a damaged pre-owned item for them to fix under warranty, how would they know how I came by it?

You usually need a reseller license in order to do that, that will mean you can also use it to not pay taxes on the goods you purchase wholesale for the purpose of resell. You may or may not need to register as a business, LLC at minimum, and get a tax id for the business (similar to your SSN, but for the business itself). So in order of what you should file: LLC, tax id, then reseller license (which may be called a different name, depending on your state).

I buy entire stores that went out of business, if they don't want me selling their tears, they shouldn't have gone out of business. I don't consider that gray area. I will take any company that tries to vero me to court and win, since my items all came new from stores that closed due to the pandemic or something else, if they didn't want their stuff resold, they could have destroyed it or taken it back, but they elected to sell it, I'm protected by the first sale doctrine.

does the ebay vero apply to personal accounts? can you sell the brands as if they was your own personal stock? can you buy the stuff from the patagonia stores anonymously meaning can you pay cash for items? so there is no traces if you buy them from brick and mortar stores. patagonia is a place in the tip of south america so you could munge the name for resale on ebay by saying "tip of south america coat" and make sure not to show the logo i dont know how patagonia can ban you from their stores because 1. you could do like above and buy with cash so they have no personal info to trace you 2. unlike casinos i doubt that the company shares info between stores. if the item is brand new and you are reselling it now becomes pre owned because it is not being sold by a dealer or online.

Patagonia is known for high quality and end use design in sometimes challenging environments so they rely on the functional integrity of their products so I understand why they exert control on the retail end. Authentic Patagonia can be useful and like new for decades.

We have a source that buys close out shoes and sometimes clothes. They had a batch from Harley Davidson and another batch from Korkease. Neither brand would allow for online reselling. The shoes could only be sold offline. Needless to say, we didn’t buy any of either brand because we don’t have any offline selling avenues.

Authorized 3rd party reseller? There is no such thing. These brands who issue copyright take downs on platforms like ebay are actually violating the laws of this nation. When you buy something, you own it, you can legally resell or do whatever you want with it. While its true that brands often have contractual agreements with distributors and retailers, those rules do not apply to consumers because consumers do not have a contractual agreement. In the case of Patagonia telling its customers they can't resell their products, that is total baloney. Unless the customers actually signed a legal contract agreeing to those terms, they will never be honored in a court of law. As for those brands who issue IP take down notices to resellers, those resellers then have the right to sue the brand itself. Brands know what the laws are, but they blatantly violate them anyway. On platforms like ebay, brands will often file claims with ebay claiming an item is counterfeit in order to get items removed from sale. In such cases resellers can then file lawsuits for defamation, harassment, and any losses/damage to their businesses that resulted from those takedowns. Brands know they can't legally stop consumers from reselling their products, so they lie thru their teeth and make those bogus counterfeit claims. Its going to take resellers to start filing lawsuits against these major brands who blatantly violate the law before it will ever stop.

Patagonia isn't living by their promise to keep all their items out of landfills. as long as a certain profit margin is met then you can return the item. how is their mission statement met if they don't warrantee all their products that have made several people money down the chain of possession of their product?

They aren't going to come after you for preowned. In fact, the trick for many is to mark new items used just to get around that. Don't use asterisks, the algorithm will push your listings down for weird characters. Listen to the eBay for Business Podcast from a few weeks ago, they talk about that. I think it's episode 206. Edit: Don't use the stock photos either.

I think you laid this video out very well and it's super informative thank you! Question, so do I hear you right that you are basically saying there are companies out there that will play the game dirty? Even though as sellers we have rights to sell their product because of the first sale doctrine, are you saying that they will still report the item to eBay as fake or fraudulent to get eBay to get it off the site? Also in your opinion do you have some top brands that overall you would just steer clear from regardless of how juicy the deal seems? For example this video is Patagonia but I have also heard through the grapevine trying to sell virtually anything made by Beachbody is really playing with fire in terms of being able to keep your eBay account? That there are some items they have ended cleaning their fake but also that if they see you trying to sell several of their items that they are one of the companies that will say all your items are fake and it'll possibly get you suspended from eBay or something like that? Do you have knowledge and thoughts on this and also any other companies you would watch out for? Again great video, I liked this one. Might even be a good idea to do a part two on it? 👍

So let’s take someone like StockX for an example they sell all different types of shoe brands let’s just say you buy a Nike off-white and it sells for $190 retail then they/us go and sell it for $500 so basically they are profiting Why doesn’t nike have a problem with that Always wanted to know.

Chris is correct, I rather purchase used shoes for $6 and resell them for $26 rather than buy new shoes for $56 and sell them for $76. At the end of the day, the profit margin on the used shoes come out the same as the new shoes but the cost of goods is much lower on the used. You could buy more used shoes because of the lower cost of goods.

@@anymoose correct, and Chris explained this in a previous video he made, so if you are an eBay seller then the profit margin would NOT be the same. This is why resellers need to understand that selling more expensive items does not equal more profit. If you don't understand your true profit, you will never be a successful reseller. The most successful resellers are the ones who sell a higher volume of lower priced items, not a lower volume of higher priced items.

i don't get why companies get mad at reselling, it's official products (none of that counterfeit nonsense), it's sold at reasonable prices (none of those scalping issues), because resellers are literally just the online version of a mom and pop shop
