I just got my first subject to property. The owners were divorcing and the man was left to pay the bills. He moved out of state and was in a preforclosure era. He contacted me for assistance, met up and talked for about 2 hours. We came to an agreement where he was free from foreclosure. I now have a tenant living there on a 6 month lease all while I am doing cosmetic fixes. The Value is 190k and there is 71k in equity. I have a cash flow of $450 every month the property.

That is great! What did you do to pay for the owners' outstanding balance? Did you use a hard money lender or another loan to pay off their outstanding balance?

@@Mary-zd6ow It's always good to have money saved. In this case I used what I had in my savings. Wasn't much to catch them up. You can use private money. Money from another source is also great. Say you borrow 5k from PL and Interest only. You pay them back with the money your making from the property. Pay in monthly installments until you're finished.

1 was able to scale from 0 to 90 units and creative financing was a big way to scale fast. With it becoming a buyers market and people still wanting seller market home prices, creative financing is the win-win situation. Your price, but my terms. If you can master off market lead generation and creative financing, you can scale big in 2023. I still work a W2 as I stabilize my 90 unit portfolio

I have a few questions. After you took over the property the $2800 covered the 1st mortgage how much was the payment on the $191,000 that you borrowed and who paid that? And did you put the seller on a lease option for a year or did you just rent it out to him?

Jerry I am now watching this video in 2023 so I missed earlier but wanted to thank you for showing the best and worst outcome. I actually bought my first home as a creative financing deal but also I am from Miami and when individuals there go thru this process and cannot find investors like you , they resort to Chapter 13 and they can hold the sale for a while and then the trustee will structure the payments etc. so they can stay in their home. It’s a unique situation but in the end whatever we can do to help the homeowners

The way that banks will be handling the forbearances is all new territory in this economic climate. It may not work out that the lender will simply put the backpayments at the end of the loan and sellers will simply just start making payments. Lenders may require lendees to qualify for that loan again. I've talked to a few.

I really appreciate what you said at 36:02 about people always "making the deal work on paper" by cherry picking comps. I've been a residential appraiser for 31 years and have seen cherry picked comps from sellers/buyers/brokers/lenders/next-door-neighbors! Now that I'm into wholesaling it's so frustrating to see inexperienced people think that they can quickly look at a few sold sales and instantly show an accurate ARV. Great video, Jerry and Pace!

So you’re transferring the deed and leaving mortgage with fixed interest and balance in place. Thus, deed goes into buyers name and mortgage remains in sellers name. If they don’t feel comfortable tell them you will instead have the deed held within a safety deposit box with recording instructions. Have third party note servicing to collect payments and pay the mortgage monthly. A few days before closing (if seller requests) have them sign a Third-Party Authorization form for their bank so you can call and cancel their insurance. You then want to replace the insurance with a non-owner occupant landlord insurance policy with the existing mortgagee and the seller as a secondary. Have Closing agent execute the contract Transfer deed in your name and collect and pay out anything at closing. The closing agent will then put deed in a deposit box and will only trigger a recording when underlying mortgage is paid in full. Or simply record the deed. If the due on sale, clause is called, simply deed, the property back to the seller and record the transaction at the registry. Simultaneously, the seller will transfer the deed back in your name. The only difference this time is that the deed will not be recorded, and instead held in the safety deposit box.

I follow both you guys and i have learned so much, I thought having the seller live in the property was a big no no when doing a creative deal but i assume from this video it depends on the situation. My 2 big questions are if it was the 2nd lien that is foreclosing on the property why couldn't you treat it the same way as a stand alone bank loan and bring the loan current instead of paying the entire 190k? The second question is what if the seller who waits till the last minute to make decisions and decides to claim bankruptcy while under contract, what would happen then? I watched quite a few videos of Pace's and even though there is enough equity for 2 to eat lol Pace always says that the most important thing is whether the property can cash flow and in this example it doesn't but you guys are getting all of the other benefits. Always a fan of you both you guys are the powerhouse team :)

I listened to Audio. I think the most epic party about it was..... for every dollar that I loan you I make one extra dollar. Somehow that clicked with me a lot better than listening to very complex mechanical details. I think starting off the presentation to the owner this way.... would be the best way to go.... Meaning mentioning this at the start and finish..... Also one thing I didn’t hear is whether or not conversation can be recorded... I did not hear you asking permission of the owner to record conversation. I heard owner object to recording. What is the best way to let the seller know that they are being recorded? Without sounding too offensive? Also if owner objects from being recorded..... would the contract be sufficient to stand out in court of law in case if owner comes back and states that he did not fully understand the process? One more thing.... Owner kept referring to capital lease, I am not familiar with this.... wouldn’t that suffice owner better? Or maybe there is a reason why he couldn’t do capital lease. Also one other thing that struck me and somehow I didn’t think of this yet owner asked.... Why not just pay off both loan entire $650k and sell it for actual market value....? Yes that would be a lot of money, but wouldn’t hard money lender give that money to you at let’s say 12 percent and then you and Pace acquire this deal and it would be done and over with? Sure there would be least profit.... but it didn’t seem owner objected to that.... One more thing... I realize owner also wanted to live for a bit longer than 12 months.... however it sounded like the easiest option of what owner wanted was for you and Pace to just pay entire loan amount for both loans and let him live in your house for 12 months with lease option agreement..... One more thing why didn’t the owner go to get hard money lender to cover the 191k debt? Even if they would pay hard money lender 191k plus 12 percent at least they would be able to offset themselves from looming foreclosure.... Or do you think hard money lender wouldn’t load to the seller entire 191k on a house that has already some equity? I am sorry if I am asking so many questions. It’s just this is the first time I heard live audio conversations with video explanations like this that somehow connect on high level all of the dots.... Note.... if we try to be real.... would the owner have any other option that is more suitable for him? Where not so much profit would be taken out of his equity? We are taking 200k for 200k..... In stock market if I was to buy 200k worth of stocks I can make 10 to 12 percent return... That is 24k in one year..... without doing anything as complex as subject to.... Sure I understand there are risks.... and hence is the reason why such payout is so high.... 200k basically in one year... way better than in stock market.. However how can a regular person with masters degree in mathematics and cyber security engineering background grasp all of these strategies without breaking a bank? What can I do to see the whole peaces of the deal structuring process.... from taking over payments to adding money to escrow to releasing money from escrow, every single mechanical concept? I understand it all briefly... but not quiet sure that I can pull this off.... by my self... It seems very complex lots of moving peaces lots of moving gears.... Highly sophisticated intermingled creative financing with lease options etc etc etc... Way too complex.... also if I was to go out to private lender who would agree to fund this 181k..... ? Also what about if the seller declares bankruptcy right while you are in the contract.... Then turns around and goes after you claiming predatory case? Would the recording be admissible if owner specifically objected to that? Note questions i ask some of them already been answered... However if maybe they can be addressed in other video.... where for example you go over other possible options that are truly best of the best options for the seller.... I don’t know but to me 200k on 200k seems like a lot of money in 1 year period.... I barely make 12 percent in stock market heck in bank I make 1 percent. Anyway overall it would be cool to see other audio recordings with sellers... I want to see what sellers concerns and objections are... this was a great bonus audio. Thank You.

Hey guys, awesome content. Do you have any videos where you explain the primary lien holders role in a sub-to? I just don’t really understand what happens if you own the home on the deed but the seller is still the mortgage holder… - what happens if you just decide NOT to pay the mortgage? What recourse does the seller and/or the lender have? - What’s your exit if the exercise due on sale and if you’re not on the loan how can the lender pursue you?
