You know what, I'd do that, if it's a shop and Joe's a plumber, I'd order pipe, fittings, maybe a boiler and just walk out with them, they've committed fraud anyway, in fact I'd use the mini to pick the stuff up,ha,ha.

Put it on the company books, use it as a courtesy car or runabout and depreciate it as heavily as your accountant will let you over the next year to offset your business taxes. Hopefully by then the finance will have been paid and 🤞you’ll be able to offload it. Good luck.

He wouldnt win in small claims. The original buyer is still paying the finance. What judge is going to find in favour of the dealer who basically messed up his deal?

Agreed, using it as a service loaner or similar would be the least miserable solution. I would definitely run it by your attorney to ensure you’re not opening yourself to any sort of liability. $1900L is not that bad of a lesson in the big picture. not sure if you7 can insure a car on your name with finance still outstanding (albeit being paid) on another persons name. in the event of a crash there would be a headache between the various companies on the legality of driving it knowing it's financed up on someone else's name. who do they pay out etc?.

You're a business, that has a use for a van. To go through all the scenarios you mentioned, the time scale would be close to 12 months anyway. Keep, use it, then revisit in 11 months.

As I see it, it Close Bros’ problem. The car was on hire purchase in which case it is Close Bros property until the finance is paid off. Close Bros need to take action against the plumbing company who have, as I understand it, illegally sold the vehicle. Get back onto Close Bros mate. I am sure you cannot sell a car on HP - even if you are continuing to make payments. Surely your legal people can advise on this. I would imagine this is a common problem. Good luck with it Joe.

Jo, To keep this basic and uncomplicated. 'Knowingly selling a car with outstanding finance to a buyer without informing them is fraud' so this is a police matter as they did not tell the last owner there was still finance owing, or that it had been paid off. Chris

Sometimes things don’t go the way we planned and you can either spend a load of time worrying about it or just put it down to experience, which in this case is probably the best thing to do. At least it’s a car you can drive for the next 12 months and even if you then sell it at a loss you’ve had good use out of it, which will then no doubt balance things out. It’s not necessarily the mistakes we make but what we do, so we don’t make them again that’s important.

My understanding from working in HP finance is that if you buy a gar from a garage it cannot be repossessed as you are protected. However if you buy the same vehicle off an individual the bank can take it back.

Use it as a shop van going for parts and such like stick a sign on it put it on the books let the accountant sort it out regards tax. As soon as it is clear either sell it or keep it as a shop van.

I’m surprised it hadn’t sold as Clubvans seem to attract a premium because they are a car derived van and so can be quite tax efficient particularly if you don’t want to drive an actual van. Any that I have kept an eye on locally usually disappear quickly. I wonder if the reason why the plumbing business are paying the finance is they don’t want a black mark on their credit history but perhaps needed the cash at the time? I think a previous comment suggesting messaging the MD via LinkedIn is a good one…. Be a shame if they got all their credit/banking facilities called into question over a couple of grand of outstanding finance 🤔. Good luck sorting it and thanks for the awesome videos.

Pretty sure their existing banking suppliers would like to know what they do with property that's not theirs whilst breaching their finance agreements... Could imagine it'll be quite hard for them to future finance...

Keep hold for the 12 months you mentioned , use as a mobile detailing/valet unit and offer 1 free home visit valet (usable within 6 months) if it earns it keep then hang onto it , if not flog it after 12 months , worth a go .

You always come across as a really genuine guy. - I'm a bit confused, though, as to why you took the car in P/EX when you knew at the time (because you checked it) that it had finance on it? Why didn't you just the seller 'sorry. we can't accept this as P/EX.' Am I missing something?

What happens if you drive it and have crash. insurance? Will pay the finance off before you get sorted, and you still will have an insurance clame against your policy. The depth holder will owe nothing! Anyway, good luck with your choices. It's nice to see honest trader for a change

Small claims court is a pain in the "you know what", good luck with that one. Put it down to one of those things, and use it until the finance is complete would be the sensible option perhaps.

Agree with some of the other comments - its a rare thing - get Quicksign to brand the whole car in 'Berrow Motors' signage and use it for a year. I'll be sure to give you a wave when ever i see it :)

Ask Close Brothers to convert the hire purchase agreement the plumbing company has into a loan to the plumbing company as they have breached the terms of the agreement ie sold the vehicle. But if that doesn’t work providing they are paying the agreement id just keep it as a courtesy car.

Use it for the next 12 months has the "Lunch" van - everyone takes it turns to taking the luch time orders - and picking parts up would be a good one too. Then after the 12 months just lob it over to BCA - problem sorted.

It looks a nice little mini Around Preston where I live there's a lot sign written for advertising there businesses so that could be an option also. I am surprised your lawyers didn’t have the answer. Ask the guy who sold to you to assign the contract breach and loss to you, then threaten the plumbing company for fraudulent contract breach. If you sell a vehicle representing that the loan will be paid off immediately after sale and then you don’t do it the loss suffered by the new owner is recoverable in contract law. I think it is maybe too late to demand the rescission of the contract but you have 6 years from the default to peruse an action.

But it's not currently in default in terms of payments, but is in terms of breach since selling it on without settlement is I'm sure would be a breach of the finance agreement/contract... Like others have said, if the payments are being made, then the finance house has no incentive to kick off, so they won't.... Rubbish situation really.. Joe really needs to tighten up his procedures as this is a silly mistake to make...

Had a similar experience and contacted the MD of the company (via LinkedIn). Someone who owns the company would be interested in the fact that they are paying for something they dont own anymore. The person at the top would definitely want to know and do something about it

It’s probably a one man band and the boss/owner knows very well the situation. I agree this very small company had short term cash problems and wanted instant money to pay off a debt but wants to keep his credit rating intact. You have created the current problem and I agree with others on here you have to take a hit, use the van for your company hack until the finance is paid up then out it for whatever you can get.

The easiest and most sensible thing to do would be to use it as a runaround for service/courtesy and write the cost back in the books month on month.

These Mini Vans are pretty scarce, I think cool (what do I know?) and should be a future classic. I saw it several months ago on your site though and thought it massively over priced. Pretty sure you could not take the plumbing co to small claims as you do/did not have any sort of agreement or contract with them. It's a smart looking car. I'd quite like it.

Ooo, that’s an interesting one..! If you use it, the value goes down, if you don’t use it, the price goes down. If you sell it, you will need to pay it off, you looses money, if you use it and right it off, they get paid. Fortunately, it’s a relatively small about of money, in the great scheme of things. But at £160.00 per month, it’s not going away anytime soon.

You’ve said before you have a plumbing company. Is the van any use to that as an asset for a year, or is there an apprentice coming through who’d take it off you in the future? Failing that, raffle it with a ‘reserve’ amount of tickets to guarantee covering all costs. Or drive it through the window of the plumbers merchants. If you can’t have the money, neither can they.

That's a strange one . Because I had a car on finance through moneybarn . And I accidentally signed it over to my step son on the V5C a week later he gets a letter from moneybarn, alerting him to the fact that he was in possession of a car still under financial interest with them and was he aware .

When did the plate change happen? If recent could the outstanding finance not have shown yet when you did your check? I'm suspicious that the plumbing firm may have needed some cash quick.

Keep it and run it down over the 12 months as a courtesy car as other people are saying and then get rid of it. Human error but something which can be done to resolve this is also to do it as a rental...👍🌞. Best of luck with it Joe and the gang.

The law on this should be simple in a way that the car cannot be sold whilst finance is outstanding or if an owner flogs a car that has outstanding finance, they are liable to the finance company and not the new owner.

Definitely keep it for a year as a courtesy car OR put it on car sharing platform like Turo and rent it out for a year and let the car/van earn its keep or depreciation for the year.

We had this when we had our garage, we hpi checked A P38 RR vouge V8 at the time the value was arout £8000', it was awaiting a new becm and keys that took about 4months,we sold it immediately to a police officer and he had it checked and came back finance outstanding, can you believe we bought it from a finance company repossession 😂

It was always the case if you had a car on finance you could not sell it until it was officially fully paid off and until then it is the property of the finance company.a guy I once knew sold his car knowing it was on finance and the company chased him for the money

Is it on HP ? If so, when the plumbing company sold it & didn’t close off the finance, the agreement should have been terminated by Close as the t&c’s have been broken … Close should be chasing the plumbing company for settlement.

Perhaps. But as the original party is still paying the monthlies'. I doubt Close really care that much; although they should now be doing an update on the plumbers credit rating. Disposal of property still subject to finance is a serious breach of their T&C's, and certainly worthy of a note on their credit file for sure...

Sadly this shows the flaws in the on-like vehicle check sites. No way should the vehicle been sold without the lien transferred or paid off. In the USA states, we have a separate title document from the registration (like your V5) that has to state any lien holders. The lien holder has the original of the title document until the loan is paid off and they stamp it paid before it goes to owner.

It’s actually a cool little van , stick it up at a big silly price £6500 and use the van for your business , in the meantime keep trying the plumbing company- you never know and if someone randomly wants it the settlement might be cheaper and just sell it and take a smaller hit - it’s not fair but you didn’t do the due diligence on it either .

Just bill the company, after 30 days county court action, you can do it on line so it's not really a hassle, it's an open and shut case. Pay the finance off and sell the mini, even if it's mthly payments you'll probably get the money, tbh sounds like the plumbers want to keep their good financial standing as they're paying the loan.

@QuattroUK2011 pay the finance off, send the plumbing company a bill for that figure, send a reminder, send a letter before action, then do a county court claim on line, plumbers probably won't want an unpaid ccj against them, just because berrow have made a mistake doesn't alter the fact that it's basically fraud on the part of the plumbers, it's all fairly straightforward, money claim on line, only takes a few minutes. Tbh I'd be over there in person as soon as it came to light.

Not sure on the fraud part but if it is fraud then they didn't comit it against Berrow so they have no claim against them... the original person who got the car off them maybe.

I think the only thing you can do is use it as a customer service vehicle or runaround until it’s lien free and consider it a lesson learned.

Use it until the finance is paid off, sell it in a year for what it owes you or even maybe a small profit. Alternatively email the company and threaten to take them to court unless they clear the finance immediately, that might just work. Also mention it will affect their credit next time they want to finance a car.

Shame about the Minivan. The risk of keeping it for the next 12 months as a general runabout and maybe a courtesy car is that if the original company decided they're no longer going to pay the finance as they don't have the van, then you'll be left with an even bigger headache. My best advice would be to sort the finance, and raffle it off to recoup some of your losses. I think you'd be surprised by how many people will buy tickets, I certainly would. This van is useful as a dog carrier, or someone setting up as a parcel delivery courier.

Run it round for year and sell it for around 4k to get your money back. Handy little thing to have as a transport motor.

Can you convert it into a five seater and add rear windows? It can add value to the car. We can legally do that in Turkiye and change the vehicle type on the register docs.

Go to court as it’s a liability as they could decide any moment to stop paying the finance and then you’ll get The car taken. And now you’ve got the ball rolling when people have said “we’ll take a look into this” someone may cancel the payments soon

Problem is the court would say your the dealer its your fault for not doing full proper checks on finance even though it missed the net it's dealers problem now and he can't resell the car since it's got finance onit and it same if you brought the car private it be your fault for not doing the proper checks which there's been alot don't do it then repo take it 😂

In your situation I would keep hold of it and use it until someone somewhere stops paying for it and deal with it when or if that happens. If you get 12 months down the line and someone else has paid it off and you've got a year out of it then send it to auction.

Perhaps if your checks show finance outstanding on potential part exchanges then do not accept it as an exchange until it shows as cleared. All cars eventually sell, it may lose future sales but then you will not end up with a headache as this is. I know gate, horse, bolted.

The standard is for the buying dealer to directly settle the loan as part of the exchange, this way they 'know' the agreement has been settled... Most people don't have the funds to settle early, thus rely on the dealer doing the deal to also settle their finance as part of the transaction...
