Dude this is a federal charge. How a judge even allowed this to be placed on their docket is mind-blowing in itself. 8 years ago if somebody had attempted this not only would the judge have not entertained this even for one second but if it had actually beneficially placed on a docket then not only would it have been thrown out immediately but the individual prosecutor involved would have been disbarred without hesitation and on top of that very likely would have been brought forth on criminal charges and would have been civilly brought forth on civil rights violations. Judges and juries would have ruled against them in a matter of 10 minutes of deliberation if it even took that long. States cannot bring forth federal charges. They literally have zero jurisdiction to do so and anybody with an IQ of 80 is aware of this even if they have no knowledge of US law or judicial case law. This is one of those things that has just simply common sense.

@@baigandinel7956 I’m pretty sure they can enter a motion to dismiss based on merits. A court of appeals can only act to overturn a decision. Their argument isn’t about a bad decision, it’s that there is no case to begin with. It’s only an argument to confuse people because there is obviously a case or we would not be at the point of a trial. The no case argument was defeated by the arraignment.

The appellate court can review every aspect of the case, including whether it is a valid basis for conviction as a matter of law. One should not confuse the procedural posture of the case (that the trial court is allowed to proceed without prior review) with the validity of the underlying charges. The trial court always moves first, no matter how in error it may be.
