If the clothing is something you can wear again even if you may never do that, then it’s a personal expense. For an item of clothing to qualify as a business expense, it needs to be ordinary and necessary for your business operations. On the other hand, clothing/accessories with your company logo - these ARE deductible as a promotional or marketing expense. Section 262 of the Internal Revenue Code “To determine whether the cost of clothing is deductible as an ordinary and necessary business expense, a three-part test must be met: (1) The clothing is required or essential in the taxpayer’s employment; (2) the clothing is not suitable for general or personal wear; and (3) the clothing is not so worn for general or personal wear. Yeomans v. Commissioner, 30 T.C. 757, 767 (1958). When the cost of acquiring clothing is deductible” A LV bag is definitely a flag for being audited As a lawyer, I would expect you to know this…..
