My head is spinning at the thought that the defendant ripped the tree up by the roots with that giant axe.

Aahhh -- this is SO SO helpful! I'm planning to take my tort law exam tonight, and I wasn't entirely sure if the but-for test and substantial-factor test were BOTH required to prove causation. Thank you so much for making this video! You're a lifesaver!

Question - in the last scenario, how would plaintiff be able to hold defendant liable if it doesn't pass the but for or substantial factor test?
@USLawEssentials3 жыл бұрын
If there is no causation there is no liability.
@justinejackson14098 жыл бұрын
Can you talk about a 3rd element that falls under causation (cause in fact)? 1) but for 2) substantial cause 3) alternative cause

The example is not proper, by lifting weights, properly performed under all circumstances, your back will become stronger and stronger.
@shakenblake93 жыл бұрын
Your criticism is improper, assuming that lifting weights is always properly performed under all circumstances (and that plaintiff could somehow prove that..)
