The clarity is amazing in this video. I learned more watching this than I did in the first tort lecture from my introduction to business law at my university, and that was an hour and 15 minute long lecture...

I had to take a tort law class in 1985 as part of a Data Processing course I was taking. I was surprised at how much about law I already knew but didn't know it. We had cases to discuss and I was always correct as to what the outcome should be. I was also one of two guys in the class. One morning one of the ladies asked me why/how I got all the cases right. I told her that when it comes to matters of law you have to think with your head not your heart. The teacher agreed. My journey in understanding law started on active duty trying to figure out how the Uniform Code of Military Justice(UCMJ) works and how to make it work for me. I have been sued twice and both cases were dismissed. My company's assigned vehicle was hit while being legally parked in front of my house. What they did not know was while on active duty one of my duties was to photograph accidents. The second guy who sued I'm thinking did it intentionally. He also wanted to be reimbursed for medical bills. He did not realize I had pics of him lifting a heavy case from the car trunk and walking around uninjured and not in any distress. He even left the scene in someone's personal vehicle not by ambulance. The vehicle was whomever he called to come get him. According to the lawyers my company had, with my pictures, accident report, diagram he didn't have too much of a leg to stand on. Federal law/regulations require a certain amount of light reflecting markers/tape. I had more than the requirements but they did not see a vehicle that requires 13'6" by 8'6" clearance?

So, the reason for releasing certain law sources of information is because I didn’t look them up and I wasn’t there yet in learning about them. I’m barely trying to get to my beginning not because of lack but because of unneeded interruptions in my data that changed my future plans that I’m trying to fix and those who tried to change my dream plans were doing it on purpose and were cyber bullying me not leaving me alone and slowing things down for me. You Tubes fault mixed in with those responsible for the bullying.

But if you try a tort by jury... I 100% understand what you're all saying. I'm speaking ethically, if someone has already been found "innocent" of a crime, OJ, then how is to be held civilly liable. I get reasonable doubt and preponderance of evidence one being harder than the other to hold liable, but if found not guilty of the crime, how is it ethical to try it to another jury just because it's a different structure. That's literally saying, " I couldn't get you under this law structure, so I'm gonna try this one." Apart from being the people v Simpson and the family v Simpson. Am I explaining this thought on ethics correctly?
@marisastevens36906 жыл бұрын
Beyond a reasonable doubt vs. preponderance of evidence (more than not)
@jackkabano59936 жыл бұрын
ı am with you Joe. the principle of accessory follows the principal, shortly means that the crime is the principal and the damage is the accessory. you cannot be liable for the damage caused by a crime to which you have been found not guilty.
@josephreyna60656 жыл бұрын
I would agree with you IF a finding of criminal liability prevented a finding of civil liability. You touched on it slightly, but ethically, it is important to give an individual a right to plead their own case against a wrongdoer. The state has its own goals it wants to promote and likewise for individuals. It is not about going after someone in civil court just because they could not get them in criminal court--it is because criminal proceedings are not victim oriented. In criminal proceedings, the state is seeking to punish an individual because they have caused a societal harm (i.e. People v. Accused Wrongdoer). In civil proceedings, individuals seek to punish an individual because that individual has caused them a personal harm (i.e. Person who suffered v. Person who is accused of causing the suffering).
@Checkersss6 жыл бұрын
@@marisastevens3690 this. There are different standards between criminal and civil law...in criminal law the standard is BEYOND REASONABLE DOUBT. In civil law, the burden of proof is BALANCE OF PROBABILITIES. In the OJ case, they proved that there were some doubts, leading to him being acquitted. The standards are lowered in civil proceedings...
@fiddletown20025 жыл бұрын
Acquittal on a criminal charge is not an affirmative finding that one did not commit acts that constitute the crime. It is merely a finding that the prosecution did not prove beyond a reasonable doubt that he committed the acts that constitute the crime.

Joe Allen Yep. Distinguishing between civil and criminal can be confusing. The easiest way to remember is that criminal is paid (only government can pursue) with jail time and civil is paid with money (civilians pursue damages). Jail vs Money.
