Rules of War in a Nutshell - script
Since the beginning, humans have resorted to violence as a way to settle disagreements.
Yet through the ages, people from around the world have tried to limit the brutality of war.
It was this humanitarian spirit that led to the First Geneva Convention of 1864,and to the birth of modern International Humanitarian Law.
Setting the basic limits on how wars can be fought, these universal laws of war protect those not fighting, as well as those no longer able to.
To do this, a distinction must always be made between who or what may be attacked, and who or what must be spared and protected.
- CIVILIANS -
Most importantly, civilians can never be targeted. To do so is a war crime.
“When they drove into our village, they shouted that they were going to kill everyone. I was so scared, I ran to hide in the bush.
I heard my mother screaming. I thought I would never see her again.”
Every possible care must be taken to avoid harming civilians or destroying things essential for their survival.
They have a right to receive the help they need.
- DETAINEES -
“The conditions prisoners lived in never used to bother me.
People like him were the reason my brother was dead.
He was the enemy and was nothing to me.
But then I realized that behind bars, he was out of action and no longer a threat to me or my family.”
The laws of war prohibit torture and other ill-treatment of detainees, whatever their past.
They must be given food and water and allowed to communicate with loved ones. This preserves their dignity and keeps them alive.
- SICK & WOUNDED -
Medical workers save lives, sometimes in the most dangerous conditions.
“Several fighters from both sides had been critically wounded in a fierce battle and we were taking them to the closest hospital.
At a checkpoint, a soldier threatened us, demanding that we only treat his men. Time was running out and I was afraid they were all going to die.”
Medical workers must always be allowed to do their job and the Red Cross or Red Crescent must not be attacked.
The sick or wounded have a right to be cared for, regardless of whose side they are on.
- LIMITS TO WARFARE -
Advances in weapons technology has meant that the rules of war have also had to adapt.
Because some weapons and methods of warfare don't distinguish between fighters and civilians, limits on their use have been agreed.
In the future, wars may be fought with fully autonomous robots.
But will such robots ever have the ability to distinguish between a military target and someone who must never be attacked?
No matter how sophisticated weapons become it is essential that they are in line with the rules of war.
International Humanitarian Law is all about making choices that preserve a minimum of human dignity in times of war, and makes sure that living together again is possible once the last bullet has been shot.

Edgelords will tell you that nobody follows these, but here's the truth. Yes, people fucking do. Obviously there are exceptional dickheads, but war has always had precepts of proper conduct, from antiquity, in which war was most often fought through challenges of single combat, to modern times where we have lain down codified combat etiquette. It was commonplace to follow some form of code of ethics in wartime, as it is true to human nature. Most armed groups, nations or otherwise, see themselves as the good guys, the heroes on a mission for virtue through violence. As a result, they want to do the good works of liberators. Studies show that most soldiers in a combat setting don't even end up firing their weapon, simply because the act of attempting to kill a man outside of a 1v1, immediate emergency is contrary to human nature. Not only is it innate for people to avoid unnecessary violence, it's also just practical warfare for several reasons. First, an officer's primary concern is his men, and their ability to perform in good health. As this includes mental health, he must remain sure that his men are confident in their actions, and not performing undue harm that could weigh on them. During Vietnam, the rate at which people fired on the enemy when presented an opportunity rose dramatically. This resulted in greater combat fatigue, which meant a greater number of stress disorders, harming overall morale and the effectiveness of the men. Second, since much of warfare relies on the support of a civilian populace or allies, it is necessary that one maintains a good reputation among them. If you lose this support, your ability to fight a war will deteriorate. During Vietnam, the reports coming out of places like My Lai and Hue City eroded public support, and, as Johnson put it "I've lost Walter Cronkite, which means I've lost the average American." For these reasons, any officer or NCO worth his salt will strictly enforce the Geneva Convention and the ROE. I personally interviewed an NCO with the Nightstalkers, a US Army Special Forces group specializing in night raids, who unabashedly declared that his men never broke protocol. I heard him admonish his men with regard to double tapping, or shooting enemy injured men. "You better down them on the first try" said the Sergeant "because if I catch you doubletapping, I'll have your ass". There are always assholes who don't think of themselves as subject to the rules. Or those who become irrational and no longer see the situation with clarity. But on the whole, wars are fought with a code of ethics in mind.

@@benjaminmendy6930 Britain treated their POWs well in WW2 which helped them win the war. Their German prisoners kept chatting away and give away German secrets. Italy also treated their POWs well (I think. You can double check) so much so that they didn't treat the Greeks too harshly if they did capture one. Their treatment of the Greeks was far better than the Germans. German, Soviet, American, French and Japanese are infamous for their poor treatment of POWs. Especially the Japanese. I think America got better but there were still cases of poor treatment which the FBI had reported. Soviets, Germans, Japanese are easily the worst

The Germans treated the Soviets very badly, in fact except for the death rates of Chinese in Japanese hands, that of the Soviets in German hands was the worst, but except for several massacres of the SS committed against soldiers surrendered as in general the Western Allies They did not have such a bad time in German hands (it should also be mentioned that the Poles, although they were not treated as badly as the Soviets, did have a worse time than the rest of the Western Allies), although it is true that the Soviets and the Japanese always treated badly to their prisoners, the French were not as bad as the others, but they put their prisoners after the war in forum work (as did Denmark and Norway). Finally I will mention that there was a country that treated its POWs better than Great Britain, and that country is Canada.

Based on history, repercussions for not following the rules of war are primarily saved for the defeated parties and/or are used as pretexts for punitive measures levied upon the defeated. Noble intentions, perhaps, but most often used to posture and claim some moral high ground.

@@timjobs3634 Hell yes, medics get shot at. During WW2, the Japanese would specifically target them and would sometimes wait for them to come to the aid of someone in need, so they could pick off multiple targets. It's part of the reason why medics can carry weapons now. If surrendering, the universal white flag has been a traditional sign of surrender, but in modern warfare, it could be a deception. In Iraq, people who were surrendering were usually held up at a certain point and basically told to keep their hands up, get on their knees, slowly unbutton their shirts or show they weren't wearing a bomb, and if everything looked ok, then we'd cautiously make contact and take them. Sounds easy enough, but there were times where we were surrounded by loads of curious people and could have easily been blown up if they wanted it to happen, so these "rules" NEVER work out the way it should. The military does everything backwards.

During world war 2, all sides of the conflict carpet bombed cities, killing thousands of civilians. However, in doing so, they were destroying factories and supply depots, many of which had civilian workers. So my question is this: if a civilian is working in the factory that produces munitions and weapons for your enemy, is he really a non-combatant?

Not defending war criminals but in most modern conflicts like Vietnam, the enemies will try to blend in the civilian population. This causes distrust where enemies are pretty much all around not just “people in tents.” I definitely do not condone what the U.S. did in My Lai though.

Not really... Since the Geneva Convention has existed, typically the people being tried for war crimes were the ones who, considering both sides, really deserved to be treated as criminals. The UK and US firebombing Germany and Japan was certainly not a good thing...but Imperial Japan's and Nazi Germany's war crimes far exceeded any the US may have committed.

No, that position is too extreme. Not all laws are enforced, both national and international. Just because the laws are selectively enforced doesn't mean they are used by "powerful people" "to oppress other people when it is convenient." International law might not always be enforced, but at least it puts to paper a universal sense of what is beyond the pale of accepted behavior for nations. Outlawing war of any kind is obviously a little too extreme..but since outlawing chemical weapons they've been used far less than they potentially could have been in the last 100 years.

I have a question. If an entire military decides not to abide by said rules, and that military happens to be the strongest force in the world, who is it that is supposed to hold them accountable ? Or do we just hope and pray that they are true to their word and hold themselves accountable ? Another question. If it became obvious to you that your enemy was not abiding by said rules, and you were the military general of your factions forces, would you still play by the rules, thereby condemning your brothers to an uneven playing field, guaranteeing larger losses of your own people ? Another question, do you think that introducing international war laws has, en masse, caused: a: alleviation of suffering overall, b: more suffering overall, or c: a totally neutral effect that has been a waste of time and resources ? Has trying to introduce rules into WAR (the only act in this world that inherently CAN NOT, by virtue of its own nature, have ANY rules.) actually brought any order into war ? Or just caused more chaos, confusion and blood ?
