Its actually not about wits, its actually about how this scene couldn't happen in a real court. Thats why the real lawyer dude was so shocked. Because in a real court both the prosecution and the defendant must be aware of all evidence and reports. In a real court if the prosecution had a "surprise" autopsy, that the defense was not made aware of, it would have been thrown away because the defendant would not be able to make a case (defense) against it. But in this game it happens all the time for climax and drama to keep it interesting. But at least in the U.S that is not at all how the court system works. (Sorry you just got a 3 page essay out of nowhere today)

You can have a different autopsy done by a different medical examiner, but the original autopsy is still valid, and then the lawyers fight over which autopsy is more representative of the reality of the case, as opposed to this, when the old autopsy just... stops being valid.

For the replies, this is not possible if you follow AMERICAN court systems, in japan (and also the nation of the developers) bringing in new evidence in the middle of a trial is totally legal. What this says about japan's system, I'm not gonna make an assessment about the 99% guilty rate or anything but... yknow. Japan. In any case, the english version of the AA series takes place in San-Tokyo / Japanamerica due to localization efforts (which is why the names also have many specific puns as a running joke of the english port). So their court is a mix of US and JP.

What's got the lawyer upset is that in courts based on British Common Law, you can't bring surprise evidence, like a second autopsy, to court. You are obligated to notify the other side, and the court, of any new evidence you wish to present before presenting it (however, you don't have to say how you will use it, iirc). I don't know how the Japanese court works, but I doubt it works this way. The idea behind a court system is that it is supposed to be fair and balanced to remove all elements except the facts.

@@doandadrestarahma5290Due to multiple reason, that of which being... 1. The police do their own digging and make absolutely sure they nailed the criminal before arresting them. 2. They follow a guilty until proven innocent ideology. 3. The culture around criminals being that they're guilty of the crime regardless of the fact if they did it or not. And also stuff like this. The best defense attorney in all of Japan won only 5 cases in his years of law. That's abysmal.

Other fun things: - The prosecution is apparently legally allowed to whip people. - The chief of police can literally just threaten people IN FRONT OF EVERYONE and no one bats an eye. - A very obvious murdering mobster can nearly get away with murder simply because he likes roaring at people like a tiger. - A prosecutor no one has seen before with no trial record or any kind of personal information can easily just waltz right into the prosecutors office with no objections and immediately prosecute a robbery/murder trial against the man who has only lost 1 case. - A serial killer is not only allowed to testify as he’s currently the target of a high speed pursuit due to him kidnapping someone, but can also once more threaten the defense’s well being in front of the entire court with no objections, clarifications, or reactions. Even in the case of him holding the defense’s friend hostage, no one but Phoenix and Edgeworth know that. - A prosecutor’s gargantuan Batman Gambit requires a different prosecutor to confess to a crime he believes he caused when he was a child. Not only is this objection not noted then dismissed (or they leave the courtroom to discuss with more qualified legal experts), the prosecutor pushes to have the trial RIGHT AWAY in order to keep to the statute of limitations. Firstly, the statute is specifically regarding being charged for the crime, meaning that if Edgeworth has confessed, the fact that it’s the last day to do so doesn’t matter anymore. More importantly, even in a Japan-based Court System, giving a Lawyer quite literally no time or resources to handle a brand new murder trial specifically predicated on a nearly decade old murder, especially one that had the hidden caveat of requiring a spirit medium, is literally insane, and only works because Phoenix Wright is the only one to realize that the window was broken after nearly a decade.

I did some research into Japanese law out of curiosity after playing these games. Half the nonsense in Phoenix Wright is actually based on the actual Japanese legal system. For example, in Japan, prosecutors do not have to share evidence with the defense.

Phoenix Wright trials often feel like a kangaroo court stacked against the defense (and rightly so), but I'm told it's actually a pretty good representation of the Japanese legal system, which doesn't really have innocent until proven guilty, and often seems more concerned with making sure someone is successfully accused and punished than finding the right culprit.

To be fair it's mostly plot related. Von Karma and all his protégés (Edgeworth included) are unethical as fuck and try to do what they can to win trials, that's why all the trials in Ace Attorney are bullshit. Edgeworth only has his redemption from the second game forward, but at that point you go against Von Karma Jr, which is basically the same as first game Edgeworth, so nothing really changes.

Some of the things that are really noticeable: The law of self-defense is a lot stricter than it is in the US.It's tough to make a successful case for it in Japan, and even then you might not escape punishment. That's the real reason Phoenix didn't want to go for self defense in the second case in JFA. The system is inquisitorial. The prosecutor is actively involved in the investigative process and collects some of the evidence himself. The judge is much more involved in the court proceedings and may even question the defendant himself. In Japan in particular, the judge tends to favor the prosecution, since they are essentially on the same side. The idea is that everyone is trying to find the truth, but in reality they're trying their hardest to convict. Confessions are SUPER important, which is a carry-over from Neo-Confucianism. Back in the days when Confucianism was highly influential in government, confessions were considered to be the only 100% reliable evidence of someone's guilt. That's why you see people like Manfred von Karma so hell-bent on getting confessions and why the judge considers confessions to be pretty much the end of the case. Prosecutors tend to be pretty high-class, which is a carry-over from feudal days when government officials were pretty much nobility. Defense attorneys on the other hand are considered commoners with a "dirty" profession. That's why Edgeworth and Von Karma are dressed so nicely and live in mansions and Phoenix can barely afford his office rent. It's unusual for a defense attorney to win more than a few cases in his entire career in Japan (the average loss rate being something like 98%). Phoenix going 3 years without a loss would be considered miraculous in real life. Von Karma, and to a lesser extent Edgeworth, are parodies of the popular perception of prosecutors in Japan, who are often seen as trying to convict anyone accused of a crime without caring about actual guilt. The Judge is a parody of popular perception of judges in Japan as being incompetent and ineffectual.”
