In this week's free concealed carry video Tim Schmidt, aka "Tactical Tim", talks to us about the definition of constitutional carry. This can be seen as a controversial subject but Tim tends to disagree. He explains that no other constitutional amendment gets scrutinized the way that the second amendment does. Do you need a permission slip from the government to speak freely? Well, Tim doesn't think you should need a permission slip from the government to be able to defend yourself either. People will claim that there will also be a lack of training if we adopt constitutional carry. Tim thinks that the "training" we get from state classes and certain instructors can lead people to be tricked into thinking they have had enough training to responsibly carry a firearm. Every responsible carrying gun owner knows that you need way more training then a 4, 6, or 8 hour class which the state can give to you. We, as responsible gun owners, know that training is a frame of mind and a lifelong pursuit. What do you think of constitutional carry? Do you agree with Tim? Let us know why in the comments below. We need a way to tell the good guys from the bad guys. A simple background check is not infringing on your rights, while it is making sure the bad guys are the only ones carrying illegally. The cops need our help.

@@timhallas4275 i can buy guns waiting on my LTC they found out i had a class b misdemeanor which has been expunged... After waiting 3 months... Now i got to mail them paper work that it has been dismissed.... So if im in public i could be possibly charged for busting someone... I do have texas law shield... So here i wait again

The NRA is the only thing holding us back in TEXAS !!! To get a CHL , you have to go through a certified NRA Instructor $$$ !!! The STATE OF TEXAS & THE NRA are making MILLIONS !!!! WE WANT CONSTITUTIONAL CARRY IN TEXAS !!!!

Texas does the same regarding getting a motorcycle license. Instead of passing a written test, getting a permit then taking a driving test as is done with an automobile you have to pay a large amt $, drive what can be a long ways a few times to take a course from a private company who issues a course completion certificate which you then take to DMV, pay $ for a new license that shows a motorcycle endorsement. The only way around is if you have it from another state.

My father and grandfather and great-grandfather didn't have a gun license. My great-grandfather was the town sherrif. Gun license and training are second amendment infringements. "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

One could argue that being trained is a big part of a well regulated militia, but being in a militia isn't a requirement of the 2A. I think everyone who owns a weapon should train themselves, but I don't think the gov should have anything to do with it.

William the state of Florida is in violation of the supremacy clause of the u.s. constitution any law in opposition of the u.s. constitution is null and void a pistol permit is illegal under state law it's a Bill of attainder not allowed under state law.

william bresinski you can carry a pistol with you as long as you state your constitutional right to carry under the second amendment of the Bill of rights no state has the legal right to curtail constitutional rights the supremacy clause of our constitution overturns pistol permits in each state the judicial system has to take their oath based apon the supremacy clause it's easy unite the one percent has but you believe it's all psychological.

For those who would like some NOTES on constitutional carry . . . . . . there is no need for State constitutional amendments or State laws in order to enact Constitutional Carry. The Second Amendment's SHALL NOT BE INFRINGED was enacted against the States in 1868 and no laws concerning how you carry a firearm has been constitutional ever since then. (That does not mean such laws are not on the books, just that they are unconstitutional (and therefore, null and void). The understanding that the Federal Government could not enact any restrictions on carrying firearms was made clear by the Kentucky (admitted to the Union in 1792 under George Washington) Court of Appeals in 1822 by clearly stating that a Kentucky law(act/enactment) concerning concealed carry was unconstitutional and that court’s lone DISSENT found it to be constitutional only because the dissent believed that the Second Amendment of the Federal constitution did not apply to the States. See Bliss v. Commonwealth, 2 LITTELL, 90 as found in THE AMERICAN DECISIONS by A.C. Freeman, Vol. XIII. Even if the dissent in Bliss(case above) was correct, with the Second Amendment now(i.e., since 1868) being applied against the States (and their political subdivisions), not just applied to Congress, through incorporation of the Fourteenth Amendment, clearly, prohibitions against enacting concealed carry laws not only applies to Congress but also serves to prohibit the States from enacting any concealed carry laws - the only exception being the type of arms which would not be useful in warfare (which certainly does not encompass ordinary military weapons line pistols and machine guns). Yes, the above historical analysis also means that the National Firearms Act of 1934 and the Gun Control Act of 1968 are unconstitutional based on historic inquiry. The above is as to the *manner* of bearing arms: as for where and when arms could be borne, Dred Scott v. Sanford, 60 U.S. (19 How.) 393 15 L. Ed. 691 (1857) clearly suggested that would be anytime and anyplace . . . “to go where they pleased at every hour of the day or night without molestation” […] “and to keep and carry arms wherever they went.” , This, of course, would not include those places that people were not allowed with or without firearms (ie., restricted access) such as behind the counter (beyond the lobby and public corridors of government buildings, etc.) Today, at many government buildings, only a short entryway allows unrestricted access and, in order to conduct business, one must be cleared to enter a restricted area. Because of requiring that disarming in order to conduct business with the government, the clearance should provide for checking(i.e., like coat check) of firearms for temporary secure storage until the owner of the firearm is ready to leave. THAT, dear citizens, is Constitutional Carry ---- according to the Constitution and those who charged with its protection shortly after it was ratified.

Got pulled over a week ago for barking my tires when I left a local bar. Not speeding , not swirving , not crossing any lines , nothing. Just barked my tires a little in an old 4 cylinder Ford ranger. Like that old truck will bark much. Young local whipper snapper cop pulls me over and gets my credentials then calls for a hwy patrol car to come take over the traffic stop. He tells me to get out the car and do some sobriety test and I passed about 3 of them and then he says I want you to close your eyes tilt your head back and hold one foot out 6 inches off the ground and I said with all due respect sir Im not doing that. So he said then I am placing you under arrest. I said go ahead then cause my video up to this point is good and when you take me in I will not take a breathalyzer test either. So he placed me under arrest and asked me if I had a weapon in the truck and I said yes. My glove box is broke and falls down so it is safely stored under my seat. And it's a one owner gun registered to me from a gun shop. He writes me a ticket for unlawful possession of a firearm. That's just dam wrong.

I seen a news clip where they said if it was passed to not have to get a concealed carry permit that law enforcement wouldn't know who was carrying. I think what they wanted to say was they would lose all those millions of dollars they make allowing u to have that permit!

I agree with Tim. We don't need a permit, but we already have one, it's called the 2nd Amendment. I carry, concealed, and I've never had a government issued permit. I'm also a convicted felon. I was convicted of forgery, for signing my own name on a document that I unintentionally dated with the wrong date. Many people, who claim to be 2nd Amendment supporters, support the Un-Constitutional law that denies a convicted felon the right to keep and bear arms. However, the 2nd Amendment clearly says that the right to keep and bear arms SHALL NOT BE INFRINGED! Therefore, any law enacted that restricts the ownership of a firearm, is Un-Constitutional, felony or not.

2:07 Alot of states actually make you apply for a permit to protest. Which I don't agree with. They're literally stripping you of your rights & selling them back to you under the guise of law. You wanna hunt for food? Gotta have a hunting & fishing license. Wanna travel to a different location? Gotta have a state issued DL to operate your vehicle legally. Wanna carry around your gun? Different states make you apply for different licenses (either for open or conceal carry). Hell in some states, you have to have a state issued permit just to buy a firearm. They've already infringed on our rights..

Glad I live in Alabama, open-carry & no class or training to obtain a 'Pistol Permit' aka: Conceal Carry Permit. You just have to fill out a form online, choose between 1-5yr. permit; $20 per yr. if under the age of 55(maybe 65), and as long as you're cleared- you go pick up the permit at your local sheriff's department. I actually bought my 1st pistol without a permit, just had to wait 3 business days(they will call & notify you- if you're not cleared)obviously they didn't call me so I was clear.. went and picked it up.

Hell yeah Arizona is number 1 for firearms rights. Constitutional carry or concealed carry. No permit required unless a free citizen requests a concealed carry permit. This is the real deal. God bless AZ and the U.S.A. United States Constitution forever!!!

Congress passed Constitutional Carry throughout the Republic, open or concealed, on Dec. 15, 1791 and stipulated it "shall not be infringed". They did so, by the way , at the insistence of the States in return for the States ratifying the Constitution. Additionally, here's the Supreme Court's own, repeated definition of "to bear arms", to wit: “… to ‘wear, bear, or carry upon the person OR IN THE CLOTHING OR IN A POCKET, for the purpose of being armed and ready for offensive or defensive action in a case of conflict with another person.’ ” Heller v. D.C., 554 U. S., at 584 (quoting Muscarello v. United States, 524 U. S. 125,143 (1998) (Ginsburg, J., dissenting); alterations and some internal quotation marks omitted). NOTE: "...or in the clothing or in a pocket, ...". [EMPHASIS MINE]

NYC can’t continue to hire and control their own army (police forces’ of tens of thousands of armed individuals) if you slaves can have guns to protect yourselves... and then they wouldn’t need all that tax money for them to embezzle and skim off the top from..... it makes all the sense in the world for corrupt tyrants to keep you slaves in check. What does NOT make sense is why you slaves stay there and lick their boots when you could sell everything you own and go elsewhere.....

I've said for years that those "classes" were an absolute joke. They "teach" just enough for someone who's never so much as held a firearm to THINK they know what they're doing. At the same time, they're just one more financial obstacle for those of us who are on very limited incomes; but, who've carried safely and responsibly for decades. Personally, I'm SO looking forward Nov. 1st, here in Okla., when CC goes into effect!!! As a disabled senior, on a really low fixed income, I'll FINALLY "be legal" again! It's absurd that one faces legal issues for simply insuring one's ability to defend one's self by exercising a right guaranteed us by the 2nd Amendment!!!

IMO it's not Constitutional Carry if its regulated where you can and can not carry. The Constitution doesn't say that you can't carry a gun in a Courthouse, Sheriff's Office/Police Station or a Bar/Saloon.

I hate it that I can’t just buy certain firearm JUST because it has a certain look or handle , while it’s perfectly ok to buy other firearm .. why should one firearm be restricted for purchase unless you get permission from the government in a form of a permit , when All store bought firearm goes through the same background check .

I agree with you Tim, wholeheartedly. Constitutional carry should without a doubt be implemented across all 50 states. BTW, Pennsylvania doesn't require anything except $20 to issue a ccw, we call it a ltcf. I mean nothing, no training, no class, no qualifying, only a background check. I thought you might find that interesting.

$20 bucks is 20 bucks. that's a GD CONDITION and nothing more than a poll tax. What if a man doesn't have 20 bucks? Same thing as when there was a poll tax levied specifically against the Blacks and poor people. BUT NOW IT'S OKAY? Every human has a right to use and match common deadly force. I am working on directed energy weapons and fuck the bullet dispensing bull shit anyway. Bullets are as ineffective as a bow and arrow when matched up against MANIPULATED ENERGY FREQUENCIES.

So? If everyone has the right to self-defense. Under the constitution. Where does it say that a felon can not own a fire arm? Just a question. Just because one is a felon does not mean that they are a bad person. Just means they made a bad decision. There are a couple of states that do restore your so called right to carry.

The Bill of Rights was integral to the passage of the Constitution, which would not have been approved except for the guarantee that these Rights would be approved likewise. In that sense, these are not Amendments. They are foundational.

Illinois is a mandatory 16hour $150-250 for the classes then you have to apply with the state police for your CCW $150 and wait 90-120 day to see if they decide to give it to you..

When I lived in Missouri in the early 70's we had gun racks in our pickup trucks. We openly carried rifles and shotguns in those racks. It was a none issue it was a right. To carry is a right, the law of the 2nd amendment say's so period.

I get what you’re saying, I’m a new gun owner moving to NC from NYC. I’ve shot at ranges so I’ve always had a basic understanding of how to use a gun. Maybe not break one down until becoming a gun owner. When I did my conceal carry permit class in NC I thought the course was extremely important and feel anyone should have to take one before they own a gun. There was questions being asked that someone who already owns a gun shouldn’t ask. When a new worker starts construction you don’t hand them a tool and say go cut some plywood. You show them, teach them and although they can still get hurt the chances are less. A gun is a tool and anyone handling a tool should know how to use it before carrying one. That’s my look on it. I feel all US citizen should be able to own anything they want as long as they have the training and mental capacity to handle one.

The state I’m in, DE, we can open carry no problem. CCDW we have to take a full day course, then a half day at the range. And before you get to the range, you had better have put some time in on your own practicing. A high % in the specified area needs to be hit...100 rounds they have you shoot in different positions. BUT... I put in my own time at the range almost weekly. I don’t let others know I have it/it’s on me/where in the house it is. That’s common sense to us here.... but I just read some doofus lady had her 13 yr old son go get her piece out of the car for her! It was loaded. He came back in, pointed it at his 12 yr old sister, now she’s dead. The kid is being charged...whereas, the mom should be, too. Not all owners have common sense.

I don't understand why it needs to be approved when it's already written into the Constitution? So in essence it's already been approved because it's in the Constitution. What happens if you are in the state and you claim constitutional carry but it hasn't been approved by the state. I noticed a lot of cases it says "may". So this "may" mean that it's at the discretion of some other person that you get to exercise that right?

Tim, I am a member and go to the range when I can, but training is good to a degree. Over the years, I have heard and read of Numerous stories of armed citizens defeating a criminal, using a gun! And, to the gun community's surprise, these citizens had little to no training! Imagine that? Many times, the bum who shoots you first is a "ham and egger" who couldn't hit the broadside of a barn with a cannon! As I said, training is good, but it's not a guarantee in a real situation.

The constitution does not say you have the right to bear arm if you have what is considered enough training to defend yourself. Any law that restricts citizens from carrying a firearm for any reason; defense, hunting, sport, etc. is unconstitutional and I can't understand how our country has allowed this to continue little by little over the past few decades. Once you begin to erode any part of any RIGHT it is a consistent erosion from there forth and impossible to get back. Ask any country that has given up their right under the promise of protection from their government for doing so.

I'm from Pennsylvania we don't Any training as a requirement on a firearm you go to your sheriffs office fill out a form there's your conceal carry permit we area open carry state

You're born with the right to defend yourself but no one is born with the knowledge of how to use a gun. So when you get the knowledge you should be identified, maybe through a peice of paper... you see how that works?

Here in " Comifornia " it's a mandatory 16 hour class + $205 , for the CCW permit ( the class is around $200 + ) $400-$450 when all said and done !

And that is the point.. Training will be automatically "forced" on the masses that choose to carry, instead of the false sense of certified class permit.Training of any kind,for self protection, is a ongoing process.

The problem with getting your rights from the state is that the sate can take them away. The 2nd amendment is already the law of the land. As a citizen of the U.S.A., you don't need your state's permission to speak your mind in public. What makes you think you need their permission to "keep and bear arms"? We don't ask for these rights... we demand they be observed.

Will it restore someone's rights after their license was suspended ? I think every CC law enacted in most states have the proviso that anyone can carry except the ones prohibited by law..

it was meant to mean the people have the right to keep and bare arms and the government has no right to infringe upon the peoples rights.. without being able to be armed all your other rights are just a concept on paper .... it dont say you have to right to ask permission it says you have the right to bare arms and it shall not be infringed even by our own government ..

Pennsylvania has taken an important step in the right direction. You do need a license to carry concealed,, but there are no hoops to jump through to get that license. The only restriction is, you cannot be a felon, or a wife beater. In other words, if you can pass the background check that is needed to buy a gun, for $20 more you can have a carry permit. The way I see it is, this helps law enforcement to determine bad guy from good guy on the street. My right, as a law abiding citizen is not being infringed in Pennsylvania,, in spite of having a liberal Governor.

I wish all of our states would follow suit and allow Constitutional carry! Guns have defended our homes and America on far more than one occasion. I’m so sick of the left telling us Americans that we cannot or will not do anything without their consent! Hats off to all Constitutional Carry states!!!! May the others follow your lead!

Thank you this video Tim! What you are saying makes a lot of sense.. We should not ask the government if we have the right to defend our self. If a criminal sees you open carry... it's less likely they would try to rob you, no more than they would a police officer. And we know this is a matter of opinion. My concealed carry permit has expired for over 5 years. My question for you Tim is this..Can I carry a concealed handgun in the state of Arkansas without a permit? Again, thank you for this video.
