Any first time offender with a falsification of business records conviction in NY, has a good chance of remaining free pending sentencing, and certainly the possibility of probation for 5 years as a sentence. Represented these types of crimes in NY before. Jail post sentencing could be a possibility for Joe Sixpack too, but given the security requirements in protecting Trump the Hump, regular incarceration would be impractical...home confinement with an ankle bracelet could be a possibility however but not likely.

I think that is an open question. He has been convicted on all 34 counts as of the time I’m responding. But he won’t be sentenced until July. If he were to show contrition during that time, be sorry for his crimes and admit to them he might get a light sentence as it is his first offense. But if he keeps his claims that the court is corrupt and a sham and he was not guilty. There is a better chance of the judge giving him jail time just because of that.
