Hey Jay, I am a general contractor and general engineering contractor in CA. I just got my CDL and have been watching your videos because I want to add trucking to our services since we already do excavation & grading. I have worked as a contractor in both CA & TX. In each state, before I begin a project as a contractor, I send the prime contractor and the project owner preliminary lien notices. Sending these notices preserves my lien rights. When I submit an invoice for a progress payment, I include a conditional lien waiver with the invoice for the amount of the invoice and once I am paid, I send an unconditional lien waiver for the portion paid. Once a project is complete and I have received my retention, I send an unconditional final lien waiver for the balance of the project. As I venture into dump trucking, I wonder whether this practice will also apply.
