Am I the only one thinking: This is madness. Saving money on the cost of justice, worse, even threatening people into pleading guilty rather than goint to court. This is not Justice. Offenders who are likely to be convicted get off easy and those who fight for their rights are forced to gamble. This is seriously fubar.

Maximilian L Thanks for commenting. If you are interested there are a number of articles regarding plea bargaining that you can quickly find on the internet. The topic attracts a lot of interest from different perspectives: social, legal, game theory etc. One other issue I don't think I mentioned is that people will often reach an agreement with the prosecutor to plead guilty to a crime, then testify against someone else, and the prosecutor will ask the judge to be more lenient in exchange for that cooperation. There are some very good discussions of these issues readily available and you might find it interesting to explore a little deeper.

Also the possibility of plea bargaining allows so many BS laws to remain on the books.

But if you're innocent and being falsely accused, a plea bargain is a way to avoid bad court trial which could sentence you for a maximum sentencing.

understood, however think about it this way. Imagine you're innocent and accused of murder, you're offered a plea agreement. Basically they are saying "you can attempt to prove your innocence if you want but if you can't then you'll spend far longer in prison. so just admit to this crime you didn't commit and spend 15 years in prison instead OR attempt to prove your innocence and face 30". It's madness, imagine being in that situation!

I just had this discussion. I don't believe in plea agreements. Nor do I believe in waying right to trial. I'll take my day in court and I want to be right beside council during.

If you lose the trial however, you would've gotten more years than if you were to take the plea deal.

We need to scrap the plea deals and give the convict the necessary time for committing crimes. Convicts will always take plea deals for lesser sentences

Let's say David commits a serious assault. He shoots someone's leg or arm, causing huge medical bills and loss of work for a long time. The victim may never fully recover, and lose his job forever. He's caught, and evidence against him is high. He threatens to learn to be an even bigger criminal, more dangerous and skilled, if he goes to prison. "You ain't breakin' me, you MAKIN' me!" He plea bargains to 4th degree Gambling, pays a $25 fine plus court costs, and is out on the street again. And then he says he was coerced into pleading guilty, that there was no evidence he was gambling ... and gets his $25 back.

What if someone with a gun but the permit is expire and someone called that person out but you never used the gun the permit just expired

nice video, serves sell its purpose! however,I have some more questions regarding plea bargaining: given the discretion in the plea bargaining process between the defendant and prosecutor, how does this system prevent subterfuge between the two parties?

It doesn't matter what I think. Why not research the topic and reach an opinion based on evidence now that you have familiarity with plea bargaining? Do other countries have a similar system? Have people suggested alternatives to plea bargaining that received support from experts? Go explore...

Let's say a person committed perjury to obtain a restraining order and the person violated the order to save the life of a innocent person and now the defender is changed with violation of a protection order based on perjury how just and fair is that
