What is the Crime of Issuing a Bouncing Check? (BP22: The Bouncing Checks Law)

Note: PERSONAL service to and receipt by the offender of the Notice of Dishonor is STILL the RULE, and as much as possible, MUST be complied with. For purposes of answering exams, the ONLY acceptable answer is that the Notice of Dishonor must be PERSONALLY SERVED TO and RECEIVED BY the Accused. The Comment of sticking the notice to the gate and taking a picture is NOT the rule, and while SOME trial Courts have allowed this because of the absolute refusal of the Accused to personally receive the Notice of Dishonor, this is merely a rule which sometimes is availed of in actual PRACTICE.

Ang rason naman po doon ay dahil wala po akong acceptable na valid ID, I didn't know that Phil health ID is not considered as an acceptable ID in creating a gcash account and I don't have any other valid ID's yet. I also don't have a bank account. Nag text po kasi sa akin ang union bank na they did not receive the payment and further explained na I have to request for another transaction to process my MTC and RTC clearance by giving me a new QR/Reference Number to proceed. Instead pumunta na lang po ako ng MTC and RTC to get a clearance at sinabi ko rin sa kanila ang nangyari kung bakit hindi ako nakabayad kasi nga po I was unable to create an online account, nakakuha na po ako at nagbayad na lng din in person. Ang tanong ko po is kung may na violate akong batas at makakasuhan ba ako under BP 22? Medyo kinakabahan po kasi ako ehh. I don't much about the law. Sana po mag respond. Thank you.

Wala po bisa yung kasunduan kasi sinusubukan nito iwasan ang batas. Sabi ng batas pinaparusahan ang paggawa ng cheke na alam na walang pondo. So pag tumalbog ang cheke, maaari parin ito makasuhan ng violation ng BP 22 o Bouncing Checks Law, maliban na lamang kung mag Deposit ng sapat na halaga para bayaran ang naisulat sa cheke sa loob ng 5 araw mula ng notice na tumalbog. Ah yes very sorry. Will make an erratum. The rule is if the presumption of knowledge of insufficiency of funds is not available, the prosecution must prove that the drawer had such knowledge. If they cannot prove it, then the drawer will not be liable. If the prosecution proves such knowledge, the drawer may be held liable.

Existing what? Kulang po yata yung message nyo. Existing loan? If yes, first of all, technically, answering your inquiry is already a paid service. But considering your situation, ang masasabi ko nalang is to try to talk to your bank, inform them of your situation, and politely request to renegotiate the terms of payment. However, you cannot force them to change the terms. So you will have to find some way either to convince them or you will have to find money elsewhere to pay the loan. If they deposit your PDCs and they bounce, then they can file a BP22 case, and the fact that you can't pay is immaterial because BP22 punishes the mere issuance of a check which has bounced. Hi Atty Javier, the drawer issued me a check pdc dated March 20, 2020 wc we all know that ECQ has been declared by our government with the creation of Bayanihan Act. I wasnt able to deposit the check because of the situation. Can I deposit it now that we are in GCQ? Furthermore if in case the drawee requested stop payment during Ecq which i think is reasonable, is the reason still valid that we are now on GCQ and bayanihan act has been expired? Im worrying because the check will be going 180 days next month and the drawer or issuer always using the current situation as reason and excuse not to fund the issued check. Whether you deposit the check or not, the fact of the matter is that the issuer of the check is still liable to satisfy the obligation to you.

Depende po sa kaso. Kung BP22 o estafa ang kaso, kailangan talaga may proof na personally tinanggap ng tao, Bale kailangan ng affidavit ng server ng lbc. Strict po sa BP22 and estafa. Mas mabuti po talaga na ipaubaya nyo sa abogado nyo ang mga dapat gawin. Salamat
