if the defendant in a civil suit has committed no crime, on what basis are they being sued? If the person suing them is claiming they or they're property has been damaged, then some law has been broken and this is a criminal case. Also, we don't get different trials based on the severity of the crime in question, so someone committing a small infraction would indeed get the same cases as a murderer.

If there was a crime charged in a civil case I think it would go to a criminal case in a second session if the crime was deemed severe enough to enforce a case on. Otherwise, there might just be a fine assigned depending on the ruling.

Say, if a person is considered guilty in a civil case, does it make him a criminal? -- is he/needed required to declare as such in, say, 'criminal charges' column in the job employment form?

No. Generally the court does not use the word "guilty" in a civil case. You are "liable" or "not liable." There would be no criminal record from losing a civil case.

Generally, civil protective orders are not criminal matters although an employment application might ask about them.

Say if you didnt agree with what the court agreed to you could appellate to the a court right but could you appellate from circuit cour directly to supreme court

Each state has its own hierarchy of appellate courts. And typically, if there is a mid-level appellate court, it cannot be bypassed. Federal courts have their own appellate courts that usually cannot be bypassed on the way to the Supreme Court.

Generally, no. There would be no automatic compensation for an unsuccessful prosecution.

@@legalyou8412 You are not learned in contract law. If you don't get the replevin bond check from the plaintiff/prosecutor who loses you are to be compensated just like if you crash your car or if the police harm you wrongfully. All public officials are bonded, meaning they are indemnified with surety in case they screw up. Whoever sues or puts a suit against must bond their claim in case they lose the defendant must be compensated.

Hi I lived in a state group home and I was wronged by staff on multiple occasions including Verbal abuse mental abuse and he even got one girl to fight me that’s physical abuse this went on for years and the executive director didn’t help they even encouraged a relationship with my child father I was 14 he was 23 this is a state agency am I able to sue them

What is a higher burden of proof? Is it for the criminal case or the civil case

Criminal, insofar as the prosecution must prove their case beyond a reasonable doubt, whereas, a plaintiff bring the same claims in civil court need only prove their case to a preponderance of the evidence (i.e. greater than 50% probability). Think OJ.

Rules of procedure and evidence in civil and criminal cases usually differ. The civil judge would make his or her own rulings on admissibility without regard to what was admitted into evidence in a criminal trial. Having said that, sworn testimony from a criminal trial may be useful to impeach a witness who testifies differently in a subsequent civil trial.

I hire someone to plant a tree in my yard. Their contract says I will not sue if a person on my property was harmed, as long as they follow company safety rules. They don't follow rules and hurt someone so I wanna sue. Is this Criminal or Civil? They broke the law.

That would be civil because it is you bringing the action, rather than the state. But not all rule breaking gives rise to a civil cause of action. You would have to have been harmed in some way.

So A criminal complaint is where the government brings a cause of action against you. and A civil complaint is where anyone other than government brings a cause of action against you.

What crap. it is the difference between legal and lawful, to break the law is to commit a crime. to break legislation is an offence as there is no victim. that's why its offensive hence called an offence. one is government court and the other is the people court, thus a jury. hence the people vs O J Simpson case. all legislation is civil law, the government even employed its own lawyers called the police. or government policy enforcer. they claim legislation is the law but the government will never enforce it for you, only against you. thus you only have rights if you can afford to enforce them AKA get your own policy enforcer / lawyer. I find it incredible that the government call legislation law, is legislation given the force of law by the consent of the governed or is it made law by the consent of the governed..... thats right force of law, not making it law. the things they dont want you to know. lol. legal government , lawful is the people, and oh yeah, the common law or peoples law stands with or with out government legislation. if the government fell tomorrow There would be no offences but there would still be crimes and a court to prosecute law breakers. its to make you feel as though you are truly dependant on government, no government no law. or so they want you to believe. to get power over you, they will never accept that you have not consented to being governed (signed the electoral register form). because to live lawfully without legal grants you freedoms against the rich. no longer can it be their legally owned land and you can live on any land you like and build a house, or spend your entire life in full time employment paying for a house you could build yourself in 5 year max. in england the first land registry was called by the people (the dooms day book.)
