Can u do a video of exculpatory evidence and the benefits of it like soon?
@GustitisLaw
@GustitisLaw 4 жыл бұрын
That is an excellent idea for a video, in theory, however. That’s because exculpatory evidence depends upon the case facts. This type of evidence tends to suggest the accused person, charged with some crime, did not commit the crime. It could be evidence related to the identity of the offender, the mental state required for the crime, or some other evidence showing an element of the charge cannot be proven. The benefits of exculpatory evidence help the accused person show there is potential doubt about the prosecutor’s proof and that the accused should be acquitted, accordingly. Since exculpatory evidence is different for every case, making a video about it will take some serious planning. Thanks for your comment.

Could you do a video on how to cross examine the expert witness?
@GustitisLaw
@GustitisLaw 4 жыл бұрын
Thank you for such an interesting suggestion and I've been thinking about how such a video could possibly be created. Effective cross examination takes many years of practice. No book, no class, and no video could adequately prepare someone to question an adverse witness who knows MORE about a subject than the examiner knows. That's the public battle the cross examiner faces when the case is on the line and that's why it takes so many years to get good at it. In fact, that's why I created this video about the secret to great cross examinations. I wanted to boil it down to a single idea that people could begin with and build upon. With that said, I would say the most effective cross examinations of expert witnesses occur when the examiner gets the witness to admit what they MUST admit. And that's the trick . . . learning what an expert witness must admit to benefit the client's position.

Are you still giving pointers about criminal defenses?? I was illegally trespassed from our local school board and then later arrested biased on this illegal trespass. I am a disabled veteran, so I don’t make enough to pay a lawyer, and make just enough to not qualify for help. So I am representing myself pro se… I have everything on video, and believe I have a good chance. Can you please listen to what I have and give any pointers if you can?? I am in the process of watching your videos, and so far I’m getting a ton of stuff… figured I’d try asking too. Thank you in advance. Hope to hear from you

I appreciate your question. However, any "pointers" would actually be legal advice. Since I am only licensed in Texas I am not qualified to help you. I wish I could do more.

I have a preliminary hearing on December 13 2019 do I go to jail even they found enough evidence to go to trial?? Do I go to jail after preliminary hearing??
@GustitisLaw
@GustitisLaw 4 жыл бұрын
A preliminary hearing is where the state must prove-up probable cause. In Texas, we don't do pre-lims. Consequently, I cannot answer your question with any degree of confidence. A defense lawyer from your state should be able to easily explain the pre-lim process and what happens afterward. I do appreciate your question, nevertheless.
