My son is a college student and was pulled over for a tag light and police said he smelled weed so the police searched the car and found the vape, the cop went by a box that was found in the car saying how much the vape held and my son told him that’s not even the box that goes to the vape, cop said it didn’t matter because it’s the same manufacturer. So he goes to to jail which now he has a felony. We get a lawyer and was told it would be dropped and expunged off his record but now he is being told without even going to court he will try for the pre trial diversion, is that the only way he can get it cleared is going through pretrial diversion? Oh and the lawyer is making him go to AA meetings and something else that he had to pay for before court. Which none of this was said until we paid the attorney. Which he will be clean when he goes to court, I just feel like this is too much for a vape and a tag light.

I was arraigned and in the police affidavit it states that there was “no evidence of criminal activity” and yet they coerced me into a taped confession. As of right now, that’s all they have. At arraignment, the judge even questioned the strength of the case and said he “almost” couldn’t find probable causes to the charge. My lawyer is already filing a motion for discovery, and is already looking into a motion to suppress, and ultimately to dismiss if that works out.

So after I’ve submitted a motion to suppress evidence and a memorandum in support of my motion, I waited 14 days and have not heard anything back from the prosecutor or seen anything filed in the court through that prosecuting office. Strategically, I know that the prosecutor was out of the country during my last period, and they’ve also now submitted a brief because they’re wanting to have a first-year law student assist the prosecutor in the case. But my question is, should I maybe get a hold of the prosecutor and just make sure that he is not planning on sending any response to the memorandum? Because I do understand that he wasn’t there, and I am not only doing this on my own case, but I actually am in law school, and there’s just a lot of ethical and future foresight thought, and so I just want to know from a seasoned standpoint, should I go ahead and submit a supplemental memorandum just knowing the reasons why to exclude the evidence or suppress the evidence and submit a request for a decision on that motion before I give the prosecutor the courtesy of making sure that he’s aware? Because we do have a hearing that I requested for oral arguments on a motion, but it is not for this. Most of this motion was made almost 2 weeks after the request for the hearing, and I’m not sure if maybe the prosecutor, who is out of town, is misunderstanding and thinking that this is the opportunity to argue all motions, and I’ve only requested the hearing for my motion that the prosecution already submitted a response to, which was a motion for particulars, and he responded with a memorandum disagreeing, but that motion hasn’t been decided, and so I figured we should orally discuss it so that we were on the same page. And as I said, part of me tells me to go ahead and file what I need to file because this is my case, this is the one that I need to go for, but then the other part of me says I’m going to be working with these people in the future, and I personally want to have the kind of ethics that say, I know I can beat this case, surely on my talent and my ability rather than having to play a sneaky game. Accident I was taking to hospital they medicated me for my injuries than police officer asked me to sign something and arrest me shortly after in hospital. Sir, my business was raided nearly one year ago by dtf, they had a search warrant, they approached me as was exiting my vehicle and presented the warrant and began patting me down while I was reading the search warrant. I went in the building with them as they began their search. After approx 3 hours, I had contacted my lawyer and was just waiting and watching. They claim they found a significant amount of ice in my office which I did not have. But they never showed it to me either and still as of last I heard from my lawyer no drug evidence had been handed over in discovery. As they were wrapping up they escorted me through the building to lock up and shut down. I heard the, call the city for a transport. At this point they haven’t toLD me my situation, my charges, but they had got in my safe and took all my money, and my guns and they took my motorcycle. Obviouly I knew I was in big trouble due to the collecting all my stuff but they never toLd me that I was being arrested. The city officer arrived and was directed to me I suppose and patted me down again and cleared my pockets and allowed me to put it up on site. The officer was very kind and he told me that he was going to cuff me and I said wait, Am I being arrested? He asked one of the agents if I was under arrest and I heard someone say yes. I asked what were the charges and again the officer had to ask the agents and I heard one say a possession with intent. He then cuffed me and put me in the car and carried to county jail. Once presented ther the officer at the desk ask for the paper work. He said they didn’t give me any. The officer said officer you can’t. Ring a man in here in cuffs with no charges. He then called the agents and got the charges. They didn’t read me my rights but they weren’t going to question me. I was arrested on May 11, 2024 and two the date of writing this I have not had a trial. I live in the Portland area Oregon. And the reason for the delay is because I’m waiting for a public defender to be assigned to my case.
