This is BS. In the event of the buyer not being able to buy the house they signed for, most contracts include a timer clause that would force you to pay 10% of the agreed price. Lets say a house is 450K, you could end up paying 45K if you cancel or breach the clauses in the contract.

No, you would not have paid for the house. The contract would just have been dissolved.

Nope it doesn't just get dissolved if you've signed the contract. You'll have to pay a fine of a percentage of the mortgage for not obliging your contract.

@@Tim_van_de_Leur Depends a lot on what he exactly says, but most agreements/contracts are "under condition of financing" "Onder voorbehoud van financiering". So it is not quite clear what happened from his explanations.

You should always have the getting a mortgage as a condition for getting out of the contract without liability.

You should alway's get under condition of getting the finance. Then if if the bank does not approve you can disolve without cost. After the term it is usualy 10% of the house price if you want to back out.

@@Tim_van_de_Leur No. Not getting the mortgage gets you out of the contract. That's like the most basic part of getting a mortgage for a house in the Netherlands. People would be going broke left and right losing a (usually) 10% upfront fee over not getting the financing. The fine you're talking about is for withdrawing AFTER you've gotten approved for the mortgage.
