With my mom's passing mom's funds were frozen. This occurred as soon as we talked to the funeral home. They reported Mom's death and it set in motion the freezing of all her accounts.Definetly have a stash of cash.

The funeral director informs the SSA. Our bank accounts were joint so not frozen. The credit cards were in the decedent’s name and were frozen.

My spouse died last Month. The kids from his first wife, wants to get rid of me, disregard me, bullied me. They ask me to sign a waiver of rights. I got death certificate but the bank doesnt release the money and asking for letter of admin . My spouse didnt have a last will, Do you think i need to get a probate lawyer.

It might be a good idea. You have to go through probate court and the judge will make sure it is fair and lawful. If you were on any of his bank accounts as a signator that money is yours. You will need to put a notice in the newspaper to notify anyone whom your husband owed money to , so that they can be paid. It is a long process that takes up to a year. Try to get widows benefits from Soc. Sec. You need to educate yourself as soon as possible. Are you the beneficiary on any investment accounts or life insurance policy?

Even if you were a beneficiary ,you have to have the death certificate to access the acct which may take several days to receive…

So my grandfather passed in 2019. My grandmother, his wife, didn't do a open succession. The insurance company for the hose is saying that in order to take his name off the policy she needs to do this open succession. My grandfather has a will naming my grandmother to receive the house where she still lives. The will also says that if my grandmother should pass ownership of the house goes to me. My grandfather excluded his two sons from the will because they are irresponsible. My grandmother is afraid to do the open succession because she doesn't want this to end up in court. She is 92 and doesn't have the money for a lawyer. What should she do?

Did your grandfather name an executor? That is the person who needs to be probating the will and assuming the executor role.

I have I Bonds and EE bonds with various adult kids named as POD (payable on death). Do they just take them to the bank to get their money, or is there some other procedure?

Old series EE bonds have to be mailed in to be cashed out. You'll need a copy of the Death Certificate. And the trustees paperwork and a copy of the trust.

If a childless couple (with no beneficiaries) has a joint brokerage and one spouse dies, if their portfolio has had a significant increases, theoretically the surviving spouse can immediately liquidate 1/2 of the portfolio with no capital gains due?

Please help ! My sister died in California last year with a spouse of 25 years. She had a previous marriage that produced 2 adult children. No children this marriage. She died age 71, without a will in California. Her children want everything she had, including the marital seafood business. She and her current husband also have a marital home in Soquel California. Paid for. She and her current spouse also own 2 townhouses in Lafayette Louisiana. These were paid for and used as rental income Bought and paid for with marital money. . Attorney in Louisiana forced the surviving spouse to give the properties to the 2 adult children. They have put them on the market to sell. * What type of law forces you to give Real Estate that you purchased with marital funds during your 25 year marriage to grown children from a previous marriage, after the spouse death. We were thinking of moving to Louisiana, but not if my husband dies and I have to give my home to his 3 kids from a previous marriage. We have been married 44 years. His kids are awful.

little confused... Step-up Basis - if a surviving wife sells a house after 2 years of husband's death, will Step-Up Basis be applicable in this case? Or Step-Up Basis only applies if children inherit a house and decide to sell after wife's death?

In community property state, whole house will step-up. Non community property, half will step-up.

For me was totally different my husband left his sons to take care of everything in a new will before he die leaving nothing to me except to stay in the house not more than six months till I find a place to move they took everything I have no papers nothing from him and now I supposed to do my taxes and I don’t know what to do because I don’t have anything from my husband who died August 2023 if anyone can help me please even when I stay in the house for three months I pay all the other ExtrasLike water heat and everything else the only thing I did not pay was the rent
