How long takes to the court order the family to take out belongings of a tenant who dies in a rented room who was being in the process of court eviction?

Wow that sounds like a tough situation. I would just finish the eviction process which ends in a lock out, typically performed by the Sheriff's office. Once you get the lockout the landlord can then clear out the unit and move on. Out of respect, try and contact next of kin to take their possessions.

@@DeRosaGroup Thanks for your kind answer! Indeed is a tough situation. His Mom got this place for him and then she ignored all my contacts with her, because this 33 years old man wasn't good news. Last month she was missing him and the police came and found him dead of drugs overdose. They sealed the room in my two family house, they took the key and they told me that the court will order his family to take out his belongings and that was all. Today I went to the precinct to find out what is the process, an officer told me that I have to hire a lawyer because this case can take a long time.

So you said not to touch the property before working with an executor, but how about if the renter dies in the apartment creates a bio hazard situation and coroner says to have a hazard cleanup done? Just found out one of my mother’s renters was found decomposing in their apartment today.

Hello, I have a tenant who’s husband passed away (in a care home facility) and she is continuing to live in the home and has been paying consistently , we have developed a good relationship however she just informed me that she and her family decided to cremate him and she now has an urn of his ashes, which she’s currently keeping in the garage of my unit (and they are debating whether they will spread elsewhere). I’m personally not comfortable with this situation , and I don’t want to be insensitive but I’m wondering if I have any right to request not to keep the ashes in the unit. The unit is in California. Any insight is greatly appreciated.

Wow, that's a very interesting situation. Not sure if ever heard that one before. You need to check the California law to see what human remains like that are considered in the state. The lease may not govern what they can keep with regards to human remains in the garage. If the lease doesn't specifically disallow it, then they are likely allowed to do that. If I were you, I would just express your discomfort to them in writing, and ask that they work on spreading the remains as soon as possible, with of course as much compassion that you can give them. Just my two cents

Ames lake did that to the family of my neighbor adult children who has to clean out the personal care items for their children to move out or give them 1 day to get rid of family members too moved out now being able to take care provider for the next few months to get rid of them mom who died by ruined the family credits rated by the owners to make sure that they paid the balance off.

What if they were on section 8 does the landlord call them to stop. The payments?

Yes, the landlord would need to reach out. If the landlord kept recieving payments while knowing the tenant had passed away, the landlord could get fined by Section 8, or even accused of fraud. They inspect the unit once a year and the case workers do check in regularly so the landlord would get caught on this easily.

What if your renter passes....and you dont know who ended up with their keys? Depending on the situation and where they pass.....any number of people/relatives could end up with the key to your property. And they could let themselves in to go through the belongings.

I would change the locks the moment you find out that the tenant passed away. You have the right to do that as the landlord and it's smart to protect your asset from family members or friends that may have the keys.

In the event the person does not have a will and 'The State' becomes the executor... I wonder how long that process takes and what the odds are of a landlord getting rent during that time? You know 'The State' is going to get theirs first and probably charge all kinds of 'fees' for their service. People like landlords will get whats left....and like you said youre legally obligated to keep their possessions you cannot just go over and get them out so you can get on to the next renter. Will a landlord get the monthly rent payments or will the state let it drag on for months and tell the landlord you will get your money at the end when its all settled .... IF theres anything left?

You would discover the death quickly in that scenario also - many unanswered calls eventually followed by a property walkthrough to confirm they didnt move out

You should turn them over to the executor as they are the "property" of the estate at that point. Or you could call the local shelter to make sure they get a good home.

The executor is not responsible to fulfill the remainder of a long term lease.... I know you said a landlord should try to reach a written agreement with the executor with dates so both parties know financial obligations and when a property will be available again to rent.... But are they at least responsible for the rent up until they have removed all of the deceased belongings? If they take 3 months to get over there and finish getting stuff out? Are they legally obligated to pay up until the property is turned back over to the landlord to rent it again? I assume the estate would be responsible for any damages to the property just like the tenant would have been at move out?
