Gorsuch's opinion in Kisor explains well that Auer deference is the tipping of the scales of justice in favor of the government against the citizen. On the other hand, the intellectually small reassurances in Kagan's opinion are good for those who want to live in an administrative state rather than a republic. Roberts is in the latter category.
