All the cops had to do was speak to the dormitory admins for them to search the room and Joel is screwed. Dorms are only half sheltered from the 4th amendment, especially if you sign your rights away to live in the dorms. Also hearsay is usually enough to establish probable cause, so the request for identification wasn’t unreasonable, he’s lucky he didn’t get arrested.

@@jerry2357 Australia beat you to that. Police officers in most states do not need a warrant to enter your home, just reasonable suspicion that their presence might be needed on the property. Experienced this first hand when I had three plain clothed detectives jump the construction fence on my father's property, circle around the house like common criminals peeking into our windows through the curtain gaps and eventually breaking in through the french doors and destroying them before announcing that they were searching for my brother, still not identifying that they were officers, I simply shouted at them to get off my property and barricaded myself into my room. All three of them then proceeded to force entry into my room and pinned me down, reading me my rights until one of them said "He doesn't look like the kid." Mind you I'm the eldest brother of three and the one they were after is my junior by a whole decade, has a completely different hair style, different hair colour, different eye colour, he's shorter than me and has a smaller frame/build than me. Didn't stop these 'heroes' from scaring the shit out of me and making me think my dad had borrowed money from thugs who were there to collect on payments until at long last one shouted in my ear "We are police, who are you? Identify yourself!" All I remember at that point through the fear and tears in my eyes was shouting "My wallet is in my bedside table," Didn't get an apology the station didn't pay for the $3000 in damages, or even mention the fact they traumatised a 25 year old who had prior to the incident been recovering from a sickness. It was that incident alone that taught me never to trust the police, never give them anything they don't have the right to and n ever believe anything that comes out of their mouthes, they are no different to the criminals you dodge in city alleys, just dressed nicely and put through government training to become thugs.

@@matissozols8498 The problem is not everyone finds the same things offensive. What if you're joking around with some friends, but someone on the street near you hears it, and gets offended? Should you then be arrested? Even in the best case scenario where "everyone" decides "this is what we find offensive", that just means that you've now decided that anyone who doesn't fit in the "normal" mold, is now committing crimes simply for being different. It doesn't have to always be that way, but when you make laws about what people can/can't say, you always have to take take the worst case and keep it in mind. What if you make a law, and 10, 20, 30 years down the road it's been slowly modified, just a little at a time, until the people that made the law don't even recognize it anymore?

My friend Kate passed away in a jail cell because of cops just like this. She was there on a traffic ticket she didn't even know she had. They kept her there to squeeze her and intimidate her, meanwhile her withdrawals got worse and worse until her heart finally gave out. The EMTs that treated her in the cell told the jail staff that this isnt a reaction to any drugs she's ingested, bc she wasn't on any, and that she was having a heart attack and NEEDED to go to the hospital asap via ambulance. The jail staff treated her like just some junkie. She died in the cell. This was on a Sunday, jail staff didn't tell her family until Thursday. She is survived by two daughters and a son. despite her addiction, she gave everything she could to her kids. One of the daughters was really little, like 8 at the time. Kate, I miss you, Olivia misses you, your kids miss you, and I'm so sorry the last time I saw you i was a bit curt. Olivia and I both regularly mention how much we miss you. Love you, you'll not be forgotten.

If you’re talking about the second kid, in some states the middle finger is seen as an aggressive gesture/act of aggression. Personally I don’t like that because it gives grounds to law enforcement to do whatever they want in cases like that. Reality is though, if you don’t give people the finger, you’re already ahead, especially when it comes to law enforcement.

In the UK it is a sometimes a public order offence, you are more likely to get away with it if you say it to a police officer than member of the public because it has to be shown that the intent was to cause distress. It seems to me the college folk set the police up to fail.

The only time cops have to stop asking questions is after they utter the words you are under arrest. Even after they say you are under arrest they can still ask you questions they just cannot use what they learn against you in court.

unfortunately courts have decided that saying "I need a lawyer" is not a request for a lawyer. You have to be explicitly clear that you want to speak to a lawyer immediately and that you will not speak to them further without a lawyer present. It's bullshit that a non-legal expert has to be so legally specific with their wording but that's the state of US justice right now.

There seriously needs to be a law making it illegal for cops to blatantly lie during an interrogation to coerce a suspect into admitting to something. Way too many innocent citizens have been intimidated and coerced into admitting to something they didn’t do because the cops lied about something else.

What it does mean is that you should remember to say nothing until you are charged and they are forced to publish any evidence they do or do not have. That is true even in countries with fewer protections than the US. It's their job to gather evidence and not yours to supply it if accused. Let them make arses of themselves and cost the taxpayer a fortune then if not charged litigate for wrongful arrest or if charged dump your alibi/counter evidence down their throats. Costing them money is the first port of call when they misbehave, often it's the only satisfaction you'll ever get. BTW, why are most US cops obese?

im not into law but i dont quite understand. if he is suspected cause someone report it. it is not enough ground to do a check? what else do you need to do that? surveillance footage to catch redhanded? like how much ground do you need to make it a 'lawful order'? policing in the states seems like a nightmare and i guess that's why crime is frequent as well

It's also a bit stupid of you to talk about what's happening in the States when someone brought beer into a dorm room... And the fact that the police don't have the same rights as in totalitarian countries and most post-communist countries is good in my opinion. In Poland, the police in a small town can come in and search non-stop because someone claims that someone has kidnapped their cat and is keeping it in their apartment... The only thing I don't like is the fact that in the US you can use vulgar words towards a police officer... that is not optimal in my opinion.

Miranda doesn't guarantee or compel the cops will give you one. The court actually has to order one to take your case. They can still ask questions. Not good for their case but, they can. There will be no penalty for refusing to answer them. If you choose to, that's on you.

They kept bringing him back to his cell and would let him withdraw. He came back one time because it sounds like they promised him methadone, and the second time because they offered him a coke. Thats why the detective kept marandizing him, he was treating it like a "new" interaction, instead of what it really was. A junkie going through withdrawal and he was trying to take advantage of him feeling weaker, except Jeff didn't break. It's really slimy when you think about how this is probably a common practice

They have all kinds of tactics to get around even that. Example: you say "I want a lawyer before I answer any more questions." They say, "that just means you said you would have liked to have one, not that you're requesting one. I can say I want to be a billionaire, I'm obviously not requesting a billion dollars." There are many examples of them playing these kinds of semantics. Sometimes it even actually holds up in court, sometimes it doesn't. But even if it doesn't, you've still been jammed up for however long they want to fuck with you, and they face no repercussions. It's all a game and the game is rigged.

Depends on the evidence. There is an insanely high burden of proof, guilty beyond a reasonable doubt. Their evidence has to be enough to leave zero reasonable doubts about who committed the crime. This is why most convictions of robberies and violent crimes are either confessions or they were caught in the act.

Most people are convicted on their own admissions, talking to police thinking it will help them (regardless of guilt/innocence). By far the majority of people questioned by police and ultimately prosecuted/convicted began by making admissions in some form or another. Some will admit and confess to their actions, though not many fall into this group. Most will attempt to validate/justify their actions, thinking if they can make it sound "reasonable" they might be let go. They usually do this by giving a narrative that closely resembles the truth of what occurred, but changing the part that makes them criminally responsible. Talking to the police, innocent or guilty, limits your ability to later change your defense. This just gives police the ability to pick apart any plausible defense, element by element, and negate a persons defense in order to achieve a conviction.

I have a kid with mild autism and have instructed him to politely decline to answer any questions from a law enforcement officer and to demand we be present if they continue to ask questions. Rather than tell him to demand you be present you need to tell him to demand a lawyer - “I will not answer any questions or make any statements I request my attorney” - demanding parents be present is not enshrined in the constitution. But having an attorney is….

As a person with autism, who has been through the process of being arrested over a misunderstanding - what you're teaching is incredibly stupid. "Mommy and Daddy" aren't gonna be a factor in a cell. Between arrest and court, you won't even see him. Prepare the guy for how to handle police interaction, don't just.. "demand you be present" because that's not a legal requirement even in places with very progressive mental health policy. If you're under arrest, you don't have the right to demand anything except a lawyer. Teach him to do that. Also, the blanket "answer no questions" is kinda stupid, too. Say, for example, cops are searching your residential area at night for an active at-large criminal, and you're outside smoking or something, one of them shines a light in your face and asks who you are and why you're there, you're going to make your situation really bad for yourself by not just dropping your name and stating your business. "Don't answer questions" kinda depends on the circumstances. Suspicion of guilt? Silence. Confirming you're not who they're looking for? Answer away

Keeping us safe from beer drinking college students...I live in an area with a lot of colleges/universities/academies, it's called the 5 college area but idk why, there's a lot more than that! Perhaps because several are quite notable. But, lots and lots of students in a more rural area so...students & farmers, odd combo? We understand that drinking beer in your college years is the right time to do it? It's when you're drinking like a 20 year old and you're in your 30's or older it becomes a problem. Not drinking & driving tho, that's not cool. Bad idea all around.

Freshers week can get a little messy, but mostly they quickly realise they have to ration the student loan. Wednesdays, after the BUCS sporting events, can be a little noisy, particularly the rugby teams, but mostly they are as good as gold and the cops leave them well alone, they have real criminals to chase.

He literally gave them his ID. They had all his information, they just decided not to write it down. They didn't have access to his room, but it is illegal to refuse to identify yourself to a police officer, and the kid is being needlessly uncooperative. There is no reason for him not to provide it unless the report was accurate, and the cops know that, and the kid is trying everything he can - i.e. inconveniencing them and pissing them off by being completely nitpicky over semantics and minor wordplay - to make the cops job harder, despite the fact that he could just give them his ID and say "I don't consent to a search", and it would've brought the exact same effect. By the end of the situation, they got his ID, and he refused them entry. Why not just make it easier for everyone and start with that. He was making implied threats of lawsuits - despite him saying he wasn't, it's fucking obvious don't be a baby about it just say you'll sue them for any misstep - and catching them on their language. What language? Them trying to put things in a less confrontational manner, unlike him. He thinks he came out with a massive win, like he argued with them and won the argument, but he could've just achieved the same process without wasting 15, 20, 30 or however minutes he wasted on literally nothing.

Theres no reason to to provide anything to a officer unless they have RAS to detain them with. The public isnt obligated to assist in the endeavors or investigations of officers. The kid was there to get a lawsuit out of this ignorant officer and got exactly what he wanted. When the officer said he'd be arrested under the color of the law if he didnt identify he immediately lost their case in court. And they did, its a old story this happened a while ago, the kid won the case you know, said it paid for their entire time in school.

There was a case were a woman was murdered and because she had a argument with her son that morning they arrested him . He had no adult representation and passed a polygraph test . After twelve hours of the cop talking to him without food or sleep they took another polygraph and it was inconclusive based on that test they charged him . When it got to court they got torn apart by the defence attorney .

@@shanghunter7697 The problem is people who like to power trip sometimes gun for the job of Police officer resulting in this, a problem most PDs would stop having if they had a much more stiff policy on social etiquette when it comes to mental dynamic you are to work with the public for the public not against them to stroke said ego so to actually take such things seriously and stop such things from happening. It would also help to force Recruits to go through civil law school to some capacity so they actually know to some extent of what there allowed to enforce. Yes it would make them be more cheeky and not so direct but it would also stop things like this from happening because now they know WHY they cant do that and makes cases like this where it does happen now lack excuse in that they knew no better. Also upping the requirement bar to get a job you make it require more to get it so only those who are qualified in that skillset can handle it but it also makes losing it hurt a lot more because it makes all the effort to get it go to waste thus preventing this toxic dynamic with sunk cost fallacy.

Jeff is an absolute internet legend and one of my top favorites. He managed to keep his composure thru severe withdrawal symptoms and aggressive illegal interrogation by cops. Heroin is a lot cheaper than prescribed painkillers and, for all you know, Jeff is in agony from chronic pain, yet here you are passing judgement as if you have the right to. Are you SURE you're not a thug with a badge? There are several reasons why Jeff could have started doing heroin. Most people on heroin got hooked on opioids legally, had them taken away for one reason or another, and now have no other option but to take heroin/methadone/suboxone. Until/unless you have been in their exact situation, you don't have the moral right to go wagging your finger at anyone. Heroin has wiped out half of a generation in my family so I did some digging and, believe it or not, this is far from a cut and dry issue. You've said you've never done drugs so, as far as I'm concerned, you're just parroting a DARE program or some other, equally ignorant tripe and you have no idea what you're talking about. If there was ever a group of people that deserve society's pity and support it's addicts, yet people with your attitude only make a bad situation even worse. If you don't know what you're talking about which, in this case you obviously do not, then the best thing you could do is keep your worthless opinion to yourself. If you want to help people like Jeff then do some research before you go pointing fingers and getting all holier-than-thou. If you do not want to help, then just go away until you find some Humanity and compassion. The cops have no way to determine which is happening so they really don't have a leg to stand on, they are responding to nought more than tittle tattle. I'm surprised the law student didn't point that out because if they had have arrested him it would have strengthened his litigation against them later.

Catching criminals is not a simple thing. Who would have thought? XD Being a cop requires a lot of mental features that most humans don't have. And probably most cops too, to be honest. By reading the comments under this vid, I can see that most people who have very strong opinions one way or the other would be much worse cops, than shown here. mmmmm, I'm not so sure, if that was true people would be getting off easy all the time. He's been informed and understands that anything he says can and will be used against him and has the right to remain silent so I believe offering any information would be considered voluntary regardless if they keep hounding him. He would be advised to only answer anything else they say with one word. "Lawyer". I'm not positive, so this is an interesting question. I know cops on scene keep asking questions or letting perps blab even after they've said they don't answer questions or "I'm calling my lawyer first", etc.

Jeff's arrest was bad in the first place they needed a confession to legitimize it so that he couldn't sue later on. I don't think many other detectives would have held him for so long with such little evidence otherwise. This is a case of law enforcement just looking for someone to blame.
