Jan 1, 2120. As an anonymous work, I believe it'll enter the public domain 95 years after publishing (as if it were a work-for-hire). If Content Free Time makes his identity known before his death, I believe it will be life+70.

Actually, since the King Kong novelization of the film was released before the film itself, and never had its copyright renewed, the character and story are public domain as long as it goes off of the book, which does feature considerable differences from the film, and there have been people who have taken advantage of this. But you’re right that the film won’t be public domain until 2029.

Namor is technically public domain because his first appeared, Motion Picture Funnies Weekly #1, was never renewed for copyright protection. As well, the Human Torch in question who will be public domain is not going to be Johnny Storm, but the original; Jim Hammond.

2:43 Fun fact about Kong, he has such a messy copyright history but at the end of the day Time Warner media currently owns to rights to the original film, while Universal to my opinion owns the trademark/character from the 2005 film. But also his original novilization which came out before the movie is already public domain. Hence why he’s in the Monsterverse and just referred to as “Kong.” I think once 2029 rolls around the character at this point should be public domain meaning anyone can use/make their own version of him that doesn’t involve his look from non-public domain versions of him.
@jfwfreo10 ай бұрын
Universal Studios sued RKO over King Kong and won by arguing that the character itself was public domain and free to use. Universal later sued Nintendo claiming that Donkey Kong was a rip-off of King Kong and lost that lawsuit because of the arguments made in the earlier suit against RKO.

Considering how 90s media still feels relatively recent to many despite some already being in the 30 year old range, covering works from that period next should be interesting. It'd most likely take until the 2100s for anything made that time to become PD. And something that struck me after the first video was that, while most classic / golden age cartoon character ensembles like Disney's and Warner's were put together between the 20s and 60s, and thus will begin to enter the PD during the next few decades, there's a small handful of additional cast members introduced many decades later; some even during the 90s iirc (such as Max in The Goofy Movie and Lola Bunny in Space Jam), thus severely delaying their inclusion compared to their peers.

4:38 I'm not an expert nor a lawyer but I studied copyright laws at my university and looked up on google to help me: Astérix will enter public domain in 2091, in France when there's a collaborative work the rights are shared and the countdown to public domain only start when all of the creators are dead (so in this case when Uderzo died). I know he's not as well known in America but I'm surprised you didn't talked about Tintin, who will be free in 2054(at least in France). Also be careful with french and european public domain as there's something called moral rights (droits morales) that doesn't exist in the USAs. It's a right that never expires and get transfered to the familly of the creator when he dies. It "allows the artist to object to any alteration, distorsion or mutilation of the work that would prejudice the honour or reputation of the author".

The difference between life+70 years and 95 year copyright is based on how the work was made, not what kind of work it is. Works for hire (basically stuff made by corporations) gets 95 years, whereas works made by individuals (or teams of individuals) get life+70 years. Most movies are works for hire (95 years), but that's mostly a reflection of modern movies needing huge budgets and not a rule. Home videos fall under the life+70, whereas an instruction manual will usually fall under the 95 year rule. If you live in the US, then US copyright law applies, regardless of where the work was made. If Peter Pan's copyright has expired in the US, then US citizens can use it as they wish (though I don't believe they'll be able to export it to the UK).

The copyright on Thomas the Tank Engine will indeed expire in 2041. The copyright term in the UK is completely separate from the term in the U.S., and in the U.S. all works published before 1978 anywhere in the world have a set term of 95 years. Sesame street is work-for-hire (which means the production company owns the copyright), so it also has a 95 year term, and this includes scenes with human actors (just like any other film or TV series). Namor and the early Human Torch may already be in the public domain, due to failure to renew the copyright back when that was required.

See, it sounds bad when you think about it that way, but I think you're going about this wrong. Whenever people say that characters should never enter the public domain, I think about Robin Hood. We've had so many different interpretations of him and his story only because Robin Hood is public domain. And with people's likeness, that just means that people can make stories about historical characters. If that didn't happen, we wouldn't get things like Six the Musical, Hamilton, movies about Shakespeare and Abraham Lincoln or even things like The Royal Diaries and Who Was. It seems ghoulish now, because these people seem so recent, but by the time they are used in such a manner, they will be just as historical to the people who use them as Abraham Lincoln is to us now.

Registered trademarks do not have deadlines and do not enter the public domain. The trademarked characters are present in marketable products and services. Thus, Disney maintains control over the commercial use of Mickey and Minnie for products and services offered by Disney. Now that these characters are in the public domain, it is considered that any company can use them to create new stories and products, as long as there are no other elements that are protected by copyright, trademark rights or give rise to any type of confusion or undue association regarding their origin, making consumers believe that it is a creation or product launched directly or in partnership with Disney.
