There is a misconception for non- U.S residents who want to form llc in U.S which mostly do amazon and/or online business within U.S. When we search for benefits of forming llc one of these four states, We think that as there is no “income and sales taxes” in these four states, it is good to pick one of them over the other states but You’ve said, for non-residents all the states are the same! Thank you for sharing this James. I am forming an LLC in the US. Initially I thought about Wyoming but now I am considering New York. I know the initial cost is high($200 filing fee then another 375+ for publication requirement of NY). But it will feel more credible to my US/Canada clients when I can say my agency is NY based. And what I like the most about NY is that they have very low recurring fee like only $9 USD every two year. But I did not find any useful information about is it same like Wyoming or New Mexico in terms of tax for non-residents? I will be mostly providing services to my global clients and receive payments with stripe. No physical establishment or employee in the state. Also, do I need any license to provide web dev and marketing services? Would be grateful if you could share information about these.

Since delaware does not issue reseller certificate what options do i have ? Close delaware LLC and open another LLC with a state that issue reseller certficate ? Will an out of state reseller certificate work ?Any suggestions you may have would be great.

@@muhammadsaqib3474 Please go for florida LLC as its renewal cost is 125 USD vs 300 USD for DE LLC. Thre is no renewal cost for texas LLC but its more expensive to make and also requires an additional 500 USD deposit. Reseller certificate i got for out of state (NJ) and i have no problems using that to open accounts with distributors and wholesalers for my amazon business. I am not a CPA so do your own due dillegence before making a decision and keep following James channel as his vidoes are very good. All the best and good luck !!

Hi James, I am non US resident and created my LLC in washington but now my suppliers in US ARE ASKING ME A RESALE CERTIFICATE TO avoid paying tax on my purchase of inventory. This resale certificate need to be done online 1 tax permit and second resale certificate. However washington gov website need an ssn or itin that i dont have as non us resident should i moove to new hampshire or oregon ? thanks

You can request a resale certificate in those states with the same LLC but you may have to register it there.

I appreciate your videos. Your insight and knowledge is on point. My concern is Shopify is allowed in the Caribbean ( Jamaica) but not Shopify payments. Now we could switch the country to USA ( for example) and start selling ( to the USA market). Is that ok? If and when sales reach taxable levels open an LLC?

Hi, if you form an LLC and I use it to open a brokerage account with a US Broker such as Charles Schwab are the taxes and withholdings the same as an individual account? Capital gains would be 0% Tax, but withholding by the IRS if it’s an individual account you are subject to the double tax treaty between the US and you country of residency, but if it’s an LLC what is the withholding rate? It's going to be non US income/ App membership selling and no physical person there. Is New Mexico a good choice or should I prefer Wyoming for any reason ( like any other corp taxes or issues with opening bank account)? Please share your opinion.
