The Sergeant is totally right. The implied right of access doesn't allow a person to just wander around on that land. It's implied that the person will be using the land to fulfil a process linked with the site. I.e. arriving to visit and enter. Just because there isn't a physical barrier doesn't give an automatic right of access. Think about a postman having implied right of access on your driveway. It's implied he can walk up your drive/path to post a letter. It doesn't mean he can just stand there all day. Same for anyone
@blobrana85152 ай бұрын
Implied right of access is a bit more complex; you could access the mod pavement to simply walk along it. Or you may have a purpose in accessing the pavement (ie take photographs or sightsee ) it doesn't exclude you simply because you don't have an invite or purpose within the actual site. The landowner, bylaw or court order can revoke your right to access. It would similar to walking through a shopping center; you don't need to actually buy something from the shops or have an invitation or purpose in walking through the shopping centre.

So let's get this straight, you go and start filming for an audit? Outside a special forces unit, who by the way actually participate in keeping tools like you safe so you can litreally film! You absoulatey have no clue on what they actually do t keep us all safe. You then have an interaction with the Police, for obvious reasons, which went very professionally on their part. They then go the extra mile and actually confirm the ambiguity around the lay bay to which you then default to a petulant child state and escalate the issue by issuing threats. All because they were right and you were wrong! Just shows what you are and what your true motive is. You should have taken that one on the chin as in line with transparency and fair auditing values. Let yourself down there very badly on this occasion. Very disappointed indeed. Hopefully you will learn a valuable lesson going forward.

@carrot_mctekkit2373 Of course, there are boundaries, and its to test and exercise them lawfully as law-abiding citizens, ensuring that if they dont, we on behalf of the public hold them to account correctly. Not get petulant when one is professional all the way and not like it because they have behaved and acted they way the public expect. Should work both ways, and if you do do it, you should work to the same standard of public service. I know it's disappointing to the amateurs re the click bait aspect for hits, but correct professional behaviour should also be recognised, and if you don't do that, it is you with a great big lack.of understanding re the auditing principles.

Back in 1997 the MOD police raided my house with a search warrant early in the morning while I was getting ready for work. They said they had reason to suspect I was monitoring Police radio messages due to the several radio antennas mounted on my house. I explained that I was a fully licenced radio amateur and my radio equipment couldn't receive Police radio messages. They said that they had never heard of amateur radio. Okay so I switched my radio equipment on to let them listen. When they heard Morse Code they quickly left my house without saying sorry for raiding my house in error. That incident cost me one day's pay. I therefore conclude that the MOD Police are not professional at all. Amateur radio stations were Policed by the Radio Communications Agency at that time, nothing to do with the MOD or civilian Police. I wonder which stupid brain dead Magistrate gave them a warrant to raid a house that was perfectly legal and licenced to use the amateur radio bands. I requested that the MOD Police should reimburse my lost days pay but they ignored my request. Where was I employed at that time you may wonder. I was employed by the MOD as a contract project manager for radio communications for the MOD Police !. You couldn't make this up. They say that truth is stranger than fiction and my story proves that to be true. Comments welcome.

The thing to realise is that many sites that exit onto a main road require a visibility splay so that vehicles can stop at the exit and have a clear view of the main road in both directions whilst still being within the site. This creates the situation where the main gate is set back from the boundary giving the appearance that the 'boundary' is not where you think, but yeah, if publicly accessible and all that.. Cant really fault the PCs on this one as they stuck to their code of ethics..

The thing is, with Ministry of Defence Establishments, is that the Civil Servants who have signed the Official Secrets Act are told to not draw attention to themselves, to not even reveal that they work at the MOD, to just say "I'm a Civil Servant" or "In Admin" or "Office Worker" because they risk being blackmailed by our enemies to steal Secrets, info. Then you film them & their friends or even family see them going in or out & start asking questions. So you are probably committing an offence by filming them because it's a risk to National Security. The Police are not the same, they operate in Public.

This process is about growth and evolution though. Adapting to changes in attitude, behaviour and the power shift owing to technology. It is a very interesting experiment. This vid has propelled AB far beyond any other auditor I've seen. He tested, pushed and teased the PCs. We know AB is no pushover, but he wasn't combative ,instead reciprocating the manner in which he was approached and engaged. He gave as good as he got and still managed to meet both on the same level of respect. This was the most enjoyable watch just because both parties tested each others boundaries. But ultimately, sensing no threat enjoyed the exchange and ended on a really positive note.

I don't think the jolly cop has an understanding of 'implied right of access'... but apart from that they handled the audit well

When they came close to you 12:21 that was for a reason, they were shielding the driver who is from the camp (if you get my drift) he was at first going to put his hand over your cam or try to block it, then thought better of it.... And that's both them vehicles.

Not comfortable with you doing the army barracks etc. The cop shops are fair game.

AB the best thing you can do to bridge the gap is to take good officers names and email addresses along with the general email address for where they are based so your fans can email them directly. It only makes the whole station watch these videos. The sheer number of good emails will be seen by the whole force then you have done your job and in turn taught indirectly the whole station how to act. These guys off the back knew what you were up to so they were being nice.
