Imagine police coming to your house and accusing you of rape or murder that you didn't commit. You will be abandoned by your own family, friends and society and what's worse is that if people demand lynch mob or death penalty, you wouldn't get a chance to even prove yourself innocent. Even if you did prove yourself innocent, the entire society will see you as someone who committed a crime and persuaded the corrupt government to spare your life. That's what happens if we don't have fair justice system which tries to atleast proof the accused not guilty.

Sexual harrasment is not a just harrasment of body but harrasment of soul, this remains as bad memory for her whole life which victim can't forget even if she wants... but justice can reduce her pain and that can happen only by capital punishment or by very strict punishment. There are a punishments for common crimes which affects the crime rates somewhere then why not this high punishment level would give a thought in the mind of a person before committing such act. Girls in India also not complain because there is not serious action takes place, they return home not with justice but with shame in case of nirbhaya the culprit were hanged after 6 years if her mother had given up it would have delayed more. One of my friends, friend is a judge and she told us that our judicial system is so fucked up that even the judge somehow knows who is the victim and who is the culprit in most of the cases but they can't do anything because they have to abide the law and it's sad that a lot times victims don't get justice because a lot of factors in which the major two reasons are that defense lawyer will take advantage of every loophole that they can, second they try to remove the evidence by hook or by crook because money or I should say greed is involved. We need to change a lot of laws for a better society but more than that we need to change the mindsets so that society becomes better from the roots itself. It's a long walk but begins with a single step and you know what charity starts at home.

I believe getting to know the mind set of an offender is the most crucial aspect here. We get to understand why that person did such a hideous act on the first place. People have to dig into the phycology of that person before the punishment and work on the social depth to avoid such incident. It's our social learning and insight that can help us to lower down such heart throbbing accidents and bring the society at a better platform.

@@rajupatnaik7776 I don't know everything that has been discovered. But I do know that there is enough to seriously question the existence of free will. Neuroscientist Sam Harris talks about it extensively. If free will is not present, it means that under different circumstances, with different genes and different upbringing I could have been a sociopath. I am a child sexual abuse survivor and suffer from multiple psychiatric disorders. I know that a lot of what I experience is beyond my control, even the places where my behaviour stems from, like breaking down randomly. Consciousness that human beings is unique and we're still unfolding it's makeups.

1. The research results quoted are for a population sample size for countries having no similarity to India at all. Not sure if the same conclusion can be formed with India too unless capital punishment is implemented & data is collected for 10 yrs. 2. Hyd police had already collected DNA samples & established evidence against the convicts. They were shot while trying to escape,not encountered. Please check facts. 3. Law cannot work as per society/societal pressure on victim etc. Developed countries ensure society abidr by the law always & have strict rules in place. 4. Still believe that Kasab's hanging was delayed more than necessary. Crores of taxpayers money were wasted on his safety.
