Why did the adjuster get a QME on my case? Should I be worried if the adjuster got a QME on my case?

My mothers treating physician found her P&S, and able to return to work with restrictions. My mother received papers for a QME with a 30 day deadline. Should she go to a QME, if they have already found her permanent and stationary? Are all deadlines 30days, can she request an extension given we do not have a copy of the treating physicians report? Should I be requesting this report?

Often times the adjuster will want a QME if either the PTP doesn't issue a fully ratable report, or if they disagree with the PTP report. If the injured worker doesn't want to go to a QME, and the adjuster does, then the QME will still generally take place. The law changed about ten or fifteen years ago and says that now a party can't file for a hearing to settle a case unless a QME has taken place (generally). You may want to consult with a local attorney, or call the I&A Officer at your local WCAB office to go over your options.

What if you been out of for year and you already seen a qme once and you haven't yet reached mmi the insurance company request you to qme again but you are still having complications still after surgery..

Not uncommon. The insurance company may be hoping that you are P&S now even with the complications, or may be seeking thoughts as to types of treatment/testing/consultations from the QME to help you reach a P&S status.

@@musicunderground6324 I will say workers' comp is horribly slow. When I sign up new clients with very straightforward injuries, I tell them that it will still likely take two years to settle their case. Inevitably, once we are a year or more down the road, they remember me telling them that and they tell me, "I thought you were joking it would take this long, but you were serious!"
