If you've been following my bad PPI on my latest Ferrari purchase you are aware of the issues I discovered. The Dealer who did the PPI has taken a very GFO attitude about it, so i'm having to escalate. Especially because I am dumping thousands of avoidable dollars into making the car right.

Glad you're following through with the suit. This is ridiculous. It's not even my car and I'm pissed.

Hey Rob. Long time listener first time caller. I had a similar situation in the state of colorado. I ended up taking legal action against a dealer. I cant get super specific with which dealer due to settlement terms but initially we had a losing case. There could be no liability established based on the legal language in the PPI agreement. We ended up getting to the discovery portion of the case, we got surveillance footage of the vehicle only being in a bay for 30 mins with a tech there. We reached settlement, their liability insurance paid out under a “professional negligence” term. Total damages netted out to 37k. We settled and agreed to an amount that helped cover legal fees. I maybe lost 1200 bucks in filings and discovery type fees. Check out that professional negligence clause though. Might make your life easier when they realize its covered (if they have good insurance).

Did the seller pay someone off at the dealership? I would bet it’s the guy that said we don’t do PPIs.

They definitely knew it was a turd and are just trying to pass the buck. Hell they probably didn't know when they bought it but lost enough on it that they just needed it gone. Sorry you have to go through this kind of thing so often. Best of luck.

I would have thought the dealer could plug their computer up to it and check the ecu to see what miles it reports because the mileage blocker things only block the miles that show up on the dash but other computers inside the car continue to keep track of the actual miles.

About damn time you sued their ass. Ridiculous crooks. The day dealers no longer exist will be a great day.

Gearbox seal is a HUGE expense on these cars. I almost bought this car, so glad I didn't. Dealer that did the PPI was Ferrari of Fort Lauderdale .

Maybe carbon ceramic pads and rotors were taken off when they did all the miles and put back on. Also you can pull engine/chassis data like engine hours and amount of fuel consumed etc to see if there are any clues about the actual mileage.

You might wanna get a fence to go with that gate. The steering rack went out at 35k on a $300K car? ! Unbelievable!!! NEVER buy a Ferrari!!!

Paying anyone 3 or more hours for a PPI on a car, you would fully expect for them to see the fluid leaks, the tear in the skid plate, the check engine light, check all of the stored codes in the modules, check the tread depths of the tires, and briefly look at the brakes for wear.

Your lawyer is going to be able to nail the service department on discovery? Question: Dealership how many PPI have you done in the past year? Like for the money that they charge what dealership doesn't do them? That is unheard of and they did one on your other car. If someone brings a car in for a state inspection do they not do that as well? That's another thing if they lied about everything they said they checked for and didn't, under discovery you should have your attorney subpoena every service over the last 3 years for irregularaties.

I live in Florida and bought a 2016 Escalade from California because it was a really good deal and it was in the spec that I wanted. had a PPI done at the Cadillac dealership and was told that a test drive was not a part of their PPI process. I told them I would pay extra to have a test drive done because I wanted to make sure that the transmission was good. They forgot to do the test drive and the seller was pressing me to make a decision and I foolishly decided to move forward anyways. Now I have an Escalade with a bad transmission, thermostat, and CUE screen failing. They wouldn’t even refund me my PPI which was $200.

Something I learned very quickly, you need to make sure you sue first, file the lawsuit and have your attorney talk to them,. The dealership can turn around and sue you first and drag this on for 4 years, quit being a nice guy you will get the BIG FK being to nice .... Sue them, talk to them , and if they agree to fix your demands than withdrawal the lawsuit...
