Someone bought a car from an independent dealership, Motor City of Philadelphia, Nathan Kriegler. It was financed by Credit Acceptance. After making all payments on time for 10 months to Credit Acceptance, Credit Acceptance closed his account with them, leaving him the customer with a 0 balance due. The dealership now states that he must return the car to them because the bank rejected the loan. The dealership also stated that the customer would receive nothing and that they the dealership would have his car towed back to them. I can't believe this is legal. He never missed a payment, nor was he ever late with a payment. Do you have any thoughts on this?

A lot of the dealers in MD use the USB drive to provide all of the paperwork, which is DocuSigned. It causes a lot of problems - people lose it, not all of the docs get uploaded to it, etc.

@@WhitneyLLP Thanks for the information. I think this is a ridiculous way to conduct business, People can review paperwork MUCH easier than digital files on a USB. I guess there are some shady car dealers in MD to be sure. I will say that I've been very lucky in NYS with dealers who are mostly above board, and the documentation fee is limited to $75.

I’m sure they hide behind the paper act as if they are saving trees… but the usb is easy to misplace and people have to look it up and sometimes don’t have access to it. My house when it was shortsaled had the paperwork on a cd that the realtor had for “my convenience” but now I’m realizing that I never had to leave my house because the bank would not allow me to pay after I had applied for a refinance. It took over 90 days and I suspect they were paid by the insurance!

Good afternoon I asked Kia Motor Finance to send me the original copy from the dealership and it doesn’t match my copy that the dealership gave me. They signed a part on the contract which said “assigned with recourse” but on my contract it doesn’t have that signature. Is that fraud?

Also look to see what the gap addendum laws are in your state! Often GAP addendum is somewhat similar to an insurance policy and the state may have regulations on if it is legal to even sell the addendum depending on what you are financing in relation to the NADA value of the car

I noticed in my Honda contract that numbers weren’t adding up. I raised the issue to my finance company and was told that they had the original contract and I would have to abide by it. She stated that I purchased my vehicle June 15 but my receipt I kept shows I purchased the vehicle on the 11 four days prior. She condescendingly read over the contract with me and all the numbers where different. I asked her to hold on and verify the form she was reading to make sure we had the same contract. She sent me her copy I sent her mine. ALL the signatures on her copy where different (forged) I was shocked. But she wasn’t, she stood on her statement that she had the real one. I’m like it’s not about real or fake Honda dealership committed fraud. I called a lawyer and was told to go to the dealership and see what they can do. Should I take any money they offer and still sue Or should I refuse to take any money and sue Or should I hire you I know this is an open shut case Like the dealership deadass forged my signature on all the documents. They added insurances that I never asked and the itemization of amount financed is all wrong they stole my $5000 down payment.

I’ve contacted so many attorneys. No one will take my case because it was used and price was $8,350 (but later realized he charged $8,600). But the contract was the least of our concerns. Title was washed, vehicle was in multiple accidents which resulted in water seeping in and destroying electrical. Just at 6 months, my vehicle is a total loss, about to get towed to a junkyard, entire motor is fried. He erased diagnostic codes, vehicle left me stranded in the middle of nowhere 2 days after purchase. I wish we had attorneys who look out for people and not just what they will profit.

@@cdubz265 definitely look into your state laws and fight. As soon as my vehicle failed, I had some bogus debt in a collection on my credit report. I tried to dispute it, they sent a validation letter. They removed it from my report, I assumed they realized it was the wrong person. After my 30 days to dispute it, it came back on and restarted the clock. It was from 2016, I had been approved for medical assistance. They had my middle initial wrong, so my ER visit wasn’t covered. They had the wrong address, so I was never aware of this. The hospital no longer exists, so my credit score dropped almost 150 points. I can’t see being approved for a loan and rollover what I still owe on the vehicle that failed. I never imagined being scammed, then having something from 2016 come destroy my credit. The odds are against me. Still paying my note on the vehicle that doesn’t work, but lost my job because the motor blowing.

You have to threaten to file a claim against the dealership's surety bond which they are required to post in order to DO BUSINESS in that particular state, especially for fraud ...

@@leeann5442 I filed complaints with the BBB, my states attorney general, the Louisiana used motor vehicle commission, the FTC, and others. He refused to respond to any of them, laid low for a while and now he is back to scamming people. Someone purchased a vehicle over 6 months ago and they cannot get the title, one paid for a triple transfer for the title, and every one has said he deleted the diagnostic codes and after leaving the dash is lit up with warnings. With as many people he has and continues to scam and the amount of government and state agencies I’ve contacted, I don’t have faith he will ever be stopped. I left reviews every single place I could find and just hope that people will see them and not fall victim. With how many people that “like” my reviews and other reviews that are warning people about him, him not getting any likes on the reviews his family is leaving that are positive, that is the most justice I get. I continue paying the note, despite not being able to drive the vehicle. On the positive side, I learned how not to buy a vehicle. With 4 children, a $10k loss is fair if it prevents me from buying a failing vehicle for my kids and putting them in danger

Is it legal for the dealership to electronically transmit your signature to a different contract that you didn’t sign? I just went through my usb from my recent car purchase which was also my first car purchase and it’s one document I didn’t sign, they didn’t even go over this information with me but it says signature transmitted on the buyer signs here line. I’m pretty sure that’s not legal and the dealership got over on my since I was a first time buyer and didn’t have anyone there to help me

My husband and me are going through this right now. They sold his truck within 2 or 3 days and the deal was just finalized last week (3 months later). They were supposed to give us a 1500 dollar check as well and only gave 500 and told us if we dont like it we can give the car back and the 500 or just be happy with 500. They've made us resign 3 times all about a month apart. They dragged their feet and made us go through hell even though I went into labor the day after we traded in our vehicle and drove off with the new one. They ruined our maternity/paternity time, put us in a financial hole, had to issue 2 60 day tags, didn't give us the 1500 dollar check that's in the contract AND sold my husband's truck before anything was finalized. My husband tried to return the car and get his truck back but the dealership said absolutely not they will trade us out if anything and didn't say anymore about it just had us resign a new contract.

So I decided to do my spark plugs since it was overdue . Come to spark #5 #6 coils have been replaced and there’s no record of them replacing it . I had a full print out of my history of my car and no where do they say they did that now there’s oil on those spark plug coils I have picture and videos of everything vehicle is now @ 90k miles never raced or abused always well maintained plus and car was verified pre owned and crevice at dealer up until warranty at 75k any feedback would be great thank you for your time

I wanna know this too. My contract has soo much fraud, violations, and forgery. Numbers don’t add up and there’s missing money and they reported false loan information to the bureaus. I spent at least $5000 in car repairs not even 2 years or 10,000 miles into having the car. They had me sign a second contract after having the car almost a month! I am going to have the contract voided and am figuring how much compensation is fair. I am tempted to tell my story on social media, I have an alarming amount of evidence I saved everything. They may want to handle this outside of court if I have my influencer friends make it go viral. I also have found several reviews of consumers of that dealership make similar claims and complaints. I’m so upset.

The best thing you can do, is never get a car 🚘 financed directly by the dealer, go to your own bank 🏦 or your credit union first and get a preapproved loan 💸 and when he comes to GAP insurance, guess what? you should never get it from the dealer no matter what, always get it from a third-party insurance company, usually you would pay around $35-$50 per year. Just make sure you’re not using the same insurance company that you have for your vehicle 🚗 policy

Salesman said fine but you have to do a personal guarantee I said that was fine because I know it will not show up on my personal credit unless I default on the loan. So the deal went good so I sign and walk out with my vehicle. That is a personal choice that people make - sometimes they do want to press charges, and they do. However, the police here in MD have told several clients they are not interested in their identity theft and forgery cases. They seem to be focused on violent crime, and, if there is a contract involved, seem to like to say "it is a civil matter" . . . even thought it is both civil and criminal .

I’m a try to make this short, especially since this is probably irrelevant at this point. I bought a car signed a contract, drove off and went home on Monday. I got a phone call from the dealership that the bank declined my loan. Then I would have to come back in sign a new contract with a different rate. I said, I found that there were issues with the vehicle listed them specifically and said if you fix these, then I will buy the car or truck. Dealer says yes I will fix that. I go sign new contract leave the car take a loaner and wait for the car to be repaired. I’ll come and pick up the car only to find that the problem still existed. I brought the truck back. They said that they would look at it and fix it again. I go back drop the car off. They have it for about a week and a half and then decide to tell me there’s nothing wrong and they’re not going to fix it. I refuse delivery of the truck and go on about my business. Once I realize he submitted the contract fast forwarding contact a lawyer they take the case I hear crickets for a year and a half ago to the office. He’s out of town couple weeks later he sends me a letter to say he’s not going to take the case or that he was dropping the case. Fast forwarding, I asked the bank to send me a letter they haven’t. I asked the repossession company that went to the dealership to pick up the car for the details. They refuse to assist. to this very day there is no acknowledgment that a repossession had occurred no collection attempts have been made, yet a debt still sits on my credit? Details are missing but that is a long and short of the story I’m just curious did I actually have a case and if so, why would the lawyer sit on it?

I don't know why the dealer would have sent the contracts into capital one then cancel the gap then somehow add a service contract for more money. That cancelation check would have lowered the principle balance while maintaining payment. I think they just sent in an entire different set of contracts for funding at inception.

And they don't stop there multiple lawyers dropping the ball in criminal court not protecting me for the consumer protection act immigrant protection act drugs record for 3 years almost now to not be able to afford to go back for my last court date which results in do I warrant to current situation with that but after getting card from that dealership court proceedings happened during that I was still trying to get my car fixed I took it to a body shop in my Hometown after taking it back 800 miles away from the dealership I had it at to go back home and had that dealership And body shop scream over just the same except it didn't result in criminal action with courts but they held my car for ransom did not perform the work correctly the pain is shipping already after a year or less took it back in they said they wouldn't do any warranty work took a DE Subaru dealership for the suspension parts that they were asked to put on and they said no warranty have this phone calls recorded to have the visits recorded and also the insurance company Would not write in the correct collision As a comprehension collision claim instead they made it not fault and then dropped me off my insurance after being with them for with them for 25 years 4 years ago I bought my brand new car drink car and/or and now it sits with hundreds some 1000 miles on it because I had to drive back-and-forth to court for this situation and then multiple issues because electrical system was tampered with while it was at dealership in Colorado can you help me out man

I went to dealer talked drove cars was told just order was you want if it comes in and you change you'r mind cancel we will be happy to return the money. was not ready went back to dealer talked with sales did more test drive ask sales for price on car I wanted Subaru Crosstrek Limited Pure Red $30,650.OK. I was not ready a short time later I was sales person was out sales manger said I can help and sales will still get credit for sale.I thought all was good he came back with price $2'500 over price given and said there is also a $500.00 process fee. WHAT NO! If I would have sign Contract when car got there I would have been stuck with fake charges picked up my deposit made want to be sales manger give me paper he tried to get me sign and walked out.

A lot of consumer-dealer problems would be avoided if more customers got up and walked out. Listen to your gut - if things seem wrong, they probably are.
