Why I Had To Sue Ace Frehley

Күн бұрын

Long before session guitarist and composer Gene Moore met Ace Frehley, the lead guitarist for the rock band Kiss was Gene's idol. At 14, Gene was just learning guitar by listening to Ace Frehley's guitar licks on some of those iconic Kiss songs of the '70s. Fast forward about 15 years and, as fate would have it, Moore was hired for a recording session and Ace Frehley was helping produce the project. The two met and Ace complimented Gene on his playing. The rock idol invited the long time fan to the house. The two jammed a bit and Frehley asked Gene if he wanted to write together and gave Moore a cassette with some rough sketches of song ideas. Gene took a raw eight-measure riff he heard on that cassette and turned it into the hit song "Insane".
A few days after Gene created the song, laid all the tracks down including vocals and song structure, the two reviewed the song back at Frehley's house. That was the last Gene heard of the song, or from Ace, until a couple of years later, at 3 a.m., one early morning, when MTV was playing Ace Frehley's new music video release, entitled "Insane". But the story doesn't end there.....

It was not a robot! There was a guy inside! In 1982 I worked at the hotel, the band was staying at and actually bought football padding equipment for the guy in the „costume“! Maiden were playing Düsseldorf with Trust supporting. The guys name was Joey DeCurzio and I remember shopping downtown with „Big John“ Harte. After the show, I took Steve, Adrian and Dave to a Hard Rock place in the Altstadt, called the „Litfaß“! We met Doro Pesch there and I introduced her the band! Yeah… these we‘re the good times!

Sounds like Ace did the guy wrong. But let's not forget that Ace was completely wasted in the 80s. "Second Coming" was a difficult album to produce because Ace wasn't much help due to chemical influences (Eddie Trunk tells this story since he worked for the label at the time). So I'm not surprised if on Monday he thought he came up with a riff or song somebody showed him on Sunday. He barely knew where he was most of the time. I'm not making an excuse for him, just saying it doesn't surprise me in the least.

I love ace he is my favorite member of the real kiss. I saw him in 86 opened for Iron maiden. In New Orleans when I read his book he talked about his mindset after that show.new Orleans can be a weird city on your psychological functions. I know I was born and raised here.Ace always had trouble with his smoking guitar every time I saw him there.but anyway I still love ace regardless of any bad stories I heard about him.He is the true and only spaceman!

@@conti2000 no it funny every time I saw ace with kiss in the 70s twice and twice as a solo artist. Every time he would activate his smoking device in the guitar it didn't smoke. Well once it smoked for about 10 seconds. In 86 he was about 12 feet right in front of me when he tried to activate it and it didn't work and he froze for a second and shook his head in disgust. He was quite wasted that night. The blonde haired singer in frehleys comet kept gesturing that ace was drunk. It was very funny to watch.

Hey Gene, I was a full time musician and jingle writer too. I also write songs. I had to sue in the 80s and it made me furious that judges don’t understand intellectual property. I won but it took forever and was so stressful. Wasn’t Ace Frehley, that must have put even more pressure on you. Like you I’m a successful graphic designer, you are spot on that songwriting and graphics are the same mental process. People like us see the end result then figure out how to get there. Sorry that happened to you.

That Frehley’s Comet/Iron Maiden tour was my first big concert at 13 years old. Met Ace not long after at an in-store appearance he made in Danbury CT not long after. He was completely wasted. Ace is the reason I picked up the guitar and I love him but I felt let down when I met him and he’s greeting fans in that condition. Later I understood better. Listening to this guy’s story reminds me of that obviously. I’ve had bits of songs stolen from me occasionally but luckily nothing ever happened like what happened to Gene here. Honestly I think he was a bit naive to expect much to come of whatever loose, one-or-two-time collaboration he had with Ace. Live and learn, I guess

When he played live, He's just in autopilot. He has 0 business finesse. Sadly, mid-80s he was selling-hocking guitars at manny's and other places. Wasn't a good time for Ace. No, you aren’t required to have the song writer to the video shoot, but I do believe they are supposed to be present for the first recording session. If I recall correctly it’s called liability of creation. My late recorder producer said, Frank Sinatra wanted to change up a song he had wrote and he said, hell no and wouldn’t allow Frank to record it.

Here the short-story: Dude completes and works up a song demo based off an Ace riff , completely on-spec. Demo gets played for Ace who gives a neutral but noncommittal 'pretty good' response; but then, Ace moves the whole situation away from talking of the demo and working together, and Ace, causally steers Dude away from the real purpose of the meeting - potentially working together on material - to just knocking around on guitars, and then, Dude is moved further away to the pool table, and then, further away and finally out the door. This is called: The Art of Gentle Disengagement. Here's the bottom-line: after hearing a sample of Dude's writing, obviously Ace was not interested in working with Dude, or, Dude wouldn't be shooting pool and ending up with a phone number that doesn't work for Ace. If Dude was more savvy as to what constitutes a "fast embrace" in business, and, what constitutes a "Let me slowly and gently move you out the door." rejection, it would become obvious to him that Ace was not interested after hearing the demo. The difference between Ace and Ozzy is that Ozzy will come right out and say "it's not working out, see you."; whereas, many people, like Ace, can't bring themselves to be that cut and dry about their feelings of working with someone - so, they resort to tactics which: distract, diffuse, and disengage gently and slowly. Dude should have simply asked himself this question: "If this guy wants to work with me on developing his material, why do I have a pool cue in my hand, instead of a pen, a sheet of notation paper, and a tape with other riffs from this guy?" Hard lessons learnt the hard way, gentle or rough, sucks either way.

BTW the song Insane has credits listed as written by Ace Frehley and Gene Moore. So what's the problem? He's got the credit on the song. To think ace would take you under his wing is laughable. Ace from my understanding, uses people for the moment and moves on. All you have to do is pay attention to what's gone on around him. Many have done way more with Ace than this guy and have out of nowhere been banished. I don't know of a Derrick who toured with ace as a guitarist. In the 80s it was Richie Scarlett. I can't find any Derrick who played with ace at all I fact.

Gene, don't act like you were the victim, everyone that feels they are entitled, but o'well. Did you have the original meeting recorded? Do you have proof other than hear-say and a friend agrees? Get over it and do better to protect your work if it's work protecting, if this is your profession, you should be smarter than you are appearing!

It doesn't sound like Ace's work at all. I'm glad you got credit, and hopefully got paid. Even though I don't like the song, it sucks they tried to rip you off like that!

Wrong. Ace committed the crime. Theft.

Mr. C, how did he commit the crime of theft when the song was credited to the right person on the record as the guy stated and the fact that you don’t have to get permission to record someone’s song as long as you give them credit which was done and they get payment. If he wasn’t getting payment then that’s the record company’s fault not Ace’s. Ace doesn’t own or run Atlantic Records.

THIS GUY IS NOTHING BUT AN OPPORTUNIST OF THE WORST KIND IN MY OPINION. HE WAS NEVER QUITE GOOD ENOUGH TO MAKE IT IN THE MUSIC INDUSTRY, SO HE DECIDES TO TAKE A SHORT CUT AND CAPITALISE ON THE FACT THAT HE AND ACE HAD JAMMED A FEW TIMES AND HAD "ALLEGEDLY" CO-WRITTEN ONE SONG TOGETHER WITH ACE. ALLEGEDLY MIND YOU. FROM THE WAY THIS GUY DESCRIBES HIS "RELATIONSHIP" WITH ACE IT WOULD APPEAR TO ME THAT ACE WAS KIND AND VERY GRACIOUS BY TAKING THIS GUY UNDER HIS WING AND ALLOWING HIM TO CO-WRITE A COUPLE OF LINES IN THE FREHLEY'S COMET CLASSIC "INSANE". ASCAP FINALLY PAID THIS GUY HIS ROYALTIES FOR A COUPLE OF HIS LINES ACE USED ON THAT SONG. AND WHAT WAS HIS REWARD FOR HIS " CONTRIBUTION" ? $1.75

Gene sounds like a genuine, down-to-Earth guy. Unfortunately he wasn't the first and he won't be the last guy to get screwed over in the dirty World of showbusiness; not just by another musician but by the man he looked up to. A dirty, shortsighted move by Ace and his management; had he paid Gene his dues and kept him on as a collaborator, who knows what good stuff they could've come up with.

Dude looks older than Ace, sure Ace wears a hairpiece but this guy must've had a rough life or something. There's usually two sides to a story (or a coin!) with the truth usually somewhere in the middle. Would like to hear the other side before forming judgement. Have no reason to believe this guy's claim as nobody has ever mentioned it over the years. Plus his timeframes are out of whack which put his credibility into question. Fresh out of Kiss? Ace had to legally sit out 4 years due to signing the KISS contract, he had Frehley's Comet going with Richie Scarlett in '85 & Todd Howarth replaced him in late '86. Howarth played on 'Second Sighting'. Also, the Bryan Adams album mentioned was called 'Reckless' for the record. Not buying this guy's story at all, unless he can prove his claim.
