Oh mate. I feel so much for you. I was a gym instructor in Casterton, Victoria, Australia in the late 1960s. That's a hell of a long time ago for you, but I found a sport I liked when nothing else attracted me. I was a skinny kid, uninterested in everything 'til I found gymnastics. I found rings, tumbling, vault them trampoline. It changed my life. 10lb weakling to competent trampoline instructor. I feel your pain. We were allowed to fall out of trees, crash your bike through a fence, leap into a giant open pit full of water and the only condition was to be home before the sun went down. Oh, a severely grazed arse from coming off your bike? It will get better. Here's a kiss, off to bed. Do what you can with what you've got. You're a bloody amazing boy and I love you for what you've done. Keep pushing the boundaries. You deserve it.

I knew this was going to be an insurance thing before I clicked on the video. This type of business is extremely high risk, even with all of the investments you've made in safe equipment. Our local trampoline gym had an employee, a pro jumper that just happened to fall on the trampoline the wrong way and became permanently paralyzed. Ruined both his life and the life of the guy of the guy who owned the business at the same time. You are making the smart move here.

Government skate parks are open to the public, enforce no rules, and have no supervision, just a sign saying they aren’t responsible for anything. But even to host a skate comp at that same park you need a million or more of insurance and hundreds in fees to the city.

I believe those laws of negligence and liability are dictated by the state, and could allow for someone to sue even if they sign a paper like that. Would have to look into Kansas specifically to know for sure

You have made the right decision. One lawsuit can cripple most people and unfortunately, it happens all the time. You are still going to have insurance liability if you invite people into your garage no matter what you do with the building, so keep that in mind. But you're making good, sound decisions and starting to think like an adult. That's a big step. And kudos for your mom to be there for you this whole time. The very last thing you want to do is bring her down financially too. Be creative with the building, there are millions of uses for a great facility like that. But don't go right back to increasing your liability risks with whatever you decide.

Aww man that sucks big time but look on the bright side. You got to gain so much experience, made friends and got to live out your dream. Even if it was for a short while. You have the memories. Maybe a company will sponsor you or go in business with you, you never know but in this day and age when everyone is suing everyone reluctantly you made the right choice. You've worked hard for your money and it would be unfair to put it all at risk. Keep jumping and look forward to the next adventure.

I'm a licensed agent. First off I'd just like to say you're absolutely right in protecting yourself here. I skate myself and trust me I've dreamed of having ramps ect but end of the day, it can really come back to cost you so so much. Unless you have it as a LLC, then it's more they'll take from the business and not you. But even if you had a 1-3 million dollar Umbrella policy you could still really be in a bad spot with it being just the public. I know this is a wall of text but you could focus your clients down for things like this and more do it as a club. This is when you need to pay a good lawyer and really have them go over your general contract & make sure you're protected. All that being said, it's just like you said in the video. Real life sucks, but it sucks more to put your family & everything you worked for at risk. Respect big dawg!

Can you just put the flip pad in an LLC? That would protect any other assets you have if someone decided to sue. I’m sorry you have run into all these liability issues. Thanks for providing the gym to the public while you could.

Holy shit, this thing was awesome, I didn't realize this was a thing, and I live in Wichita KS. Once you said the state of Kansas, I had to look it up. Damn wish I could've gone. I gained weight over the years, and then I started to skateboard, BMX, inline and dance just like when I was a kid, and starting to drop weight like crazy. Recently I bought a small trampoline, just to have in my house realizing the benefit of jumping. I use to have one in my backyard, growing up.

I don’t know how I stumbled across this video but I did. I am in the inflatable business. Similar to you, but just with bounce houses and etc. Getting insurance for a 2 million dollar policy would probably be 10k a year. I have a 1 million dollar policy at 5k a year. Inflatables are almost more liability because they move from location to location. Set up an LLC, buy insurance, get waivers, and get your inspection from the government! We have to get inspections here in Md as well. I’m sure that you have already thought this through, just wanted to help as I’m 21 and have a profitable similar business going!

You just need a better corporate structure to limit liability. I believe what you needed was one LLC which would own the building, another LLC, which would rent the building from the LLC & operate the business as a franchise, which pays dues to either a parent LLC or S or C Corp. the parent would own all IP & trademarks, whereas the franchise, even if sued into oblivion, it could be replaced. Since the building & IP would be under separate corporate structures, this would significantly limit the liability for running the business. I suspect others in your industry operate a similar corporate structure. I’d look into exploring your options with a good AI like ChatGPT. Fill it in on all your details & brainstorm the best ways to further limit the personal liability. Hope things work out on perhaps a future endeavor or a restarting of this one, as it is 5 months ago you uploaded this video.

Big gyms don’t pay out lawsuits. I’m sure you’ve been to a commercial gym like catch air. I’m sure you remember signing liability waivers every time you go. Those places have iron clad documents you sign. No reason you couldn’t do the same.

If you want to keep it open and let it be free. You can make everyone sign wavers that specifically says if they get hurt then it’s on them. Many skydiving companies have the same wavers

Haven't watched all the way through, but as someone that knows people with kids and the amount of stories I've heard about kids becoming permanently disabled at these parks I can only imagine it's due to insurance or something related to that. These parks are great if you're capable and well aware of your limitations, the issues are when kids just show up and immediately try backflips or the likes, severely injuring themselves. No amount of coverage will protect you from stupidity!

Genuine question here, but could you not set it up on a donation based availability since making money off this isn't exactly the goal and have attendees sign a waiver/contract to not sue and by attending they are consenting to be solely responsible for any injuries that may occur? If I recall correctly, a park in my hometown did something along those lines and was able to avoid any legal issues because all of the attendees were there on their own regard. Somewhat similar to a skatepark or something. Usually community/city funded (in your scenario community) and is an "at your own risk" type deal.

If the injury was from injured person being reckless, it doesn't hold up. However, if there was a way that the business could have prevented the injury/caused the injury, the waiver doesn't hold. Either way, the business will have to deal with an expensive lawsuit itself. Example: a child gets killed by the mum dangling the child over a lion cage (real case, paraphrased and likely incorrect details). The business was liable because they knew people had been doing similar for years and did not change the enclosure to prevent people from doing that. I personally have mixed opinions on that, as I would guess most.
