Like most people, seniors try to pay their bills on time in order to keep their credit scores high. The better your credit, the greater the chances of getting a loan, mortgage, and credit card at a low rate. But too many seniors skimp on their onw needs trying to make payments on old debts in order to maintain a higher credit score. In this video, Attorney Eric Olsen explains why it's OK for many seniors to let their credit scores sink and focus on paying on necessities instead of old debt.

In this video, Attorney Eric Olsen, Executive Director of the HELPS Nonprofit Law Firm, explains why low-income seniors struggling with debt shouldn't worry about paying bills in order to maintain their credit scores. The former bankruptcy attorney details why seniors don't need high credit scores like younger people do. Among the reasons:
* much of their income like Social Security is protected
* they don't need to buy a car, and may not be able to afford one
* they may already own their home
* if they need to rent a new home, the HELPS Nonprofit Law Firm will help explain to a prospective landlord that their income is protected and why they would make a good tenant.
The former bankruptcy attorney also lays out that if you’re a low-income senior, even if your credit score is high, no legitimate lender will lend you money. He recommends paying for your needs instead of trying to pay off your credit cards. If you want to keep a single credit card with a low balance, go ahead, as long as you use it, but low-income seniors should let the high-balance cards go.

These videos are great because they not only help the senior, but they help the people that the seniors are interacting or doing business with. Those business people are clueless about what Seniors rights are. Many landlords are seniors themselves and don't know these things

Most "landlords" are now corporations. They know, but they ignore laws. They will take as much money as they can and do zero repairs.

What rights are those? The right to take a out loan - with no intention of repaying it? And then, getting new lines of credit because the previous lenders we ripped off can’t ask for repayment from our SS benefits? I love how people conveniently convert a sin into a “seniors right.”

Thank you for this program. I am 80 and struggling to pay off a lot of medical bills that got dumped on me because my insurance carrier said another insurance company was responsible…so neither paid and the doctor offices came after me. Of course I am on Medicare and have no savings and live on my SS check. If I didn’t have my little mobile home, I would be on the streets. Rent is $1200 or more plus elec., phone etc and I only make $1389.00/mo and that is too much to pay for low income housing. No we are not treated fair.

Don'r pay them. Medical bills are now weighted less by credit bureaus. You're insurance company may indeed be liable, even if they claim they aren't. Talk to a consumer law attorney.

My City charges me $600 a month in property tax A MONTH for a three bdrm house. No relief for seniors or at my income level, which is only Soc Sec income. Savings dwindled after ten years of retirement ,(I'm 76). How can that be fair or sustainable with a mortgage remaining on my house where I live alone?

Seniors are seen as a depreciated asset and we are treated as such. Imagine we worked all our lives and in the end we get the craps.

@@mcleanblades9234 seniors PAID all their working lives, too. The hardest thing for some of us is the FORCED premium payments for Medicare from our SS. $150 may not seem like much, but on SS, it is a hefty reduction.

Thank you. A few years ago I got into credit card debt and couldn’t pay, now my credit rating is 509 and it makes my car insurance higher. I have to disagree, good credit is very valuable.

It is valuable. But the video tries to point out that good credit isn't valuable enough to sacrifice basic needs like food, medicine or heat etc. Look at it this way continue paying $300 in credit card debt you can't afford by cutting back on basics to save $27 per month in car insurance. Here is a quote from one website on the difference: "If you have average credit, the same full coverage costs around $173 per month, on average. And drivers with poor credit will pay, on average, approximately $202 per month in premiums." Also not all states allow credit to affect insurance. The point is many seniors don't need credit like they used to especially if they have lower income or are poor. Higher car insurance is a comparably a drop in the bucket versus continuing to make high payments for old debt you really can't afford to pay. Eric HELPS

I ran up some credit cad debt doing some work on our home. It is sad that the agencies that do your score don’t take into account that we have the deed to our home, are exempt from property taxes and have no vehicle payments. They hammered me for $20,000 of credit card debt which is all I have. I make pretty good money retired also.

@@melaniesue8170 There is really no answer. Usually above 55, but some places you can get senior discounts at 50 and others it is 60. For my property tax exemption it is 65.

You have no idea how you have just alleviated the stress I have had over the past 4 months ! I am a 74 yr old on a fixed monthly SSI with no other income and have been drowning credit card debt since having to move back to NY and incurring an increased $1350 monthly rent and utilities debt

This is very interesting because I was just turned down from renting a senior govt subsidized apartment because of 'derogatory credit'. So I definitely will be in touch to get a Landlord Letter to enclose with my next application. Thank you.

That was very educational. I just went and filed chapter 7 at 62 years old. I felt very bad that I had to do it. I have never been behind on my credit card payments. I had Bank of America for 20 years. I called Bank of America to see what they lower my interest rate from 20% during the coronavirus they said the only way they can lower it. I would have to close the account and they would give me 2%. Send me a letter to say if they approved it or not. I continue to pay $600 a month they continue to take $500 of it at least. Because of Bank of America I was forced to file chapter 7. I take full responsibility of charging so much I will never do it again I do not want to see or hear about a credit card. Unless it's a unsecured card. These Banks will take advantage of you watch out.

Bank of America, which has branches in many Walmarts, is awful about bouncing your account , and that's why I never bank with them. They'll hold your deposit, and let your transactions go through, in case they can find any transactions they can bounce. I've been banking with Wells Fargo, and they treat me like gold. They haven't done any of the nonsense Bank of America has.

Banks are crooks anyway,they're all crooks and they come up with all this bull because we don't know the game and we work all our lives and finally retire and like me you get cancer, now here comes the outrageous medical Bill's that Medicare don"t cover and your monthly check is barely 1000 dollars a month. They all get rich off less fortunate seniors. I may have to stop my treatments because having cancer your out of pocket money is unreal. 😢

My husband and I are both disabled. We had credit cards that ended up being used for bills and meds during the time waiting for approval. Now we are 10,000 in debt, still making payments on 5 cards with an income of 2100 a month with rent being 1000.00

Wished I would have known this 4 years ago. Thought I was secure in my job but got laid off at 65. One year before I was of age to collect all my SSA. I 85K in my IRA but spent every last penny paying down debt and supporting myself until I could collect my full benefit a year later and I still have some debt left!!

I once applied for a low income apartment for seniors and was turn down become of my low credit score, i had to get my score up to where they wanted it to get the apartment , so i guess in some cases we senior have to worry abour our credit scores. that's also for lower car insurance rates and lower down payment to get electric turn on etc.

Thank you for the information . I am 61 and disabled . My husband is going to be retiring next June at 65 . We will have our car paid off 5 more payments so that is no stress . We have $8000 in credit card debt plus some medical debt incurred during the pandemic. Now I can breath .

I'm 73 years old. Have 10 credit cards (some have limits under $1,000) that I pay EVERY month. I only was late on one payment because I was on vacation and thought I had put all of my cards on automatic payment. But one of them I did not because I would be home in time to pay it. My bad. As soon as I noticed that it didn't get paid, I paid it. So, with my good payment record, shouldn't my credit score be good? It shows I use 67% of my available funds. But, NO! My credit score is around 570!!!! So I have nothing to lose by contacting you guys and trying your method. So glad I came across you videos.

It's great that he was able to write one letter and change one mind for one person, but as a landlord when I can't garnish income or checking accounts it makes payment history that much more a factor in my decision making. Also industry data shows those with bad credit average over $1,200 a year more for car insurance in the U.S. With good credit I pay $38 a month for full coverage including roadside assistance and $200 deductible. Perhaps no reason to meet one's obligations, but definitely something to consider when doing the math.

It is difficult for seniors with money, who can afford to travel, and are landlords to understand the difficulty lower-income and poor seniors with debt have maintaining their credit. It is necessary to listen to the video and not just read the title. The video discusses why lower-income seniors don't need to go without basic needs to pay the debt they can't afford simply to maintain credit. Some states do not allow credit to affect insurance rates. Most lower-income seniors do not have expensive cars that reflect the $100 extra in insurance referenced. Your discussion of how you rent is exactly the reason for the landlord letter discussed. Seniors who apply to rent from such landlords will save the $50 application fee. Seniors as a rule, including lower-income seniors, are excellent tenants. Lower-income seniors' income is safe, can't be taken, and is available for rent. I am one of those seniors at age 76 and are concerned about keeping my credit in good standing while I am on Social Security. I am a veteran but I am not a disabled veteran. Debt relief programs will never tell a senior that their income is protected can can't be taken. Instead they sign seniors up putting some in utter poverty making payments for old debt they don't need to pay. What they don't tell seniors is that they have a prearranged agreement with credit card companies to take 15-20% of whatever they collect as "donation." They have a classic conflict of interest and even the nonprofit debt management companies thus take advantage of seniors Eric HELPS

I'm 73 and I have lost much $ from being a victim of fraud and those that have been in my life for the last 24 years. I tried to get a $2,000 loan to at least pay back rent. Denied. I'm tired of all of this, I get a nice amount each month from SS. So I believe I will recover. I owe $ for medical, but I'm not paying them, they got enough from my Medicare. Probably better to go Chapter 11 bankruptcy. She can get a new secured CC, and within two years have a good score again.

First I was taught to always pay credit cards or any debt. 5 years ago I got a loan through FHA for a small home that had been under foreclosure. Great deal and has doubled in value in 5 years. I had a run down home, but required so many updates I just worked on it through the past five years. Painting, small repairs, replacing carpet, and with housing prices going up up, I did sell it, and very pleased with what I received. I cut out all unnecessary items including landline, cable, Terminex, only liability insurance, new clothes, and ate healthy food with no eating out. Even at my age of 77, I saw no reason to be the victim, so planned as though young. This is on minimal SS.

Also, good credit rating saved a bundle and aggravation on many things including car insurance. I used KZbin to make home repairs.

This is great. You are to be commended. However, all seniors are not in the same boat so to speak. Some simply have debt they are unable to pay. The point of the video is that for many seniors maintaining good credit is simply not an option nor a good idea. Especially if they are sacrificing basic needs. Eric HELPS

I have been disabled for two years when I was young, and I crawled Around from one piece of furniture to another to clean, and cooked on a walker. You have to keep a fighting spirit through all the trials that come your way.

Agree, necessities should come first. Healthy food, medical care and food should come first. Credit cards are unsecured and are usually offered.

This Q for someone I know: 1) What about if unemployment in WA is taking all of a persons money (a # of years ago)? Accused, and was unable to defend self (was in jail). it was a woman putting in claims on him, who is now deceased. He doesn't know how to fix it. They garnish any money he gets. Is there a statute of limitation? 2) is your tax return refund protected? What age is one a senior? He is a senior at 65 correct? Thank you!

One problem I see is that if Grandma is able to escape a $20,000 credit card bill, at some point can't the money be considered as income for tax purposes? Now she is on the hook for whatever taxes is needed to be paid on that $20,000. Since the taxes is a government debt, that cannot be wiped away.

Not the case for a number of reasons. You are talking about a person receiving what is called a 1099c (c stands for cancellation of debt) where a creditor sends this form to the IRS and the canceled debt can be deemed to be income. If a person is insolvent which means their debt exceeds their assets there is no tax. Form 982 can be filed with the IRS. Many tax preparers are unaware of this form or rule. As a result, some seniors pay taxes they don't have to pay. Additionally, it is simply not the practice of the IRS to send notices regarding 1099c to seniors on Social Security and if they did IRS form 982 could be filed later. Also if a senior did owe a tax many lower-income seniors would qualify for non-collectible now status and have to pay no taxes. Finally, it's not true that government debt can't be wiped out. My wife and I were in a rental apartment in NC for over four years. The lease was up for renewal and the apartment complex was not renewing the lease so it would extend on a monthly basis if they did not notify us in writing that we needed to vacate. Rent payments were auto debited from our checking account. Two months before the lease was up the auto debit did not occur. The leasing office stopped the auto debit from occurring and they shut down my access to the online payment portal so I could not manually make the payment. The leasing office then filed an eviction notice claiming we did not pay rent. We went to court and explained that they stopped taking our rent money, we were able and willing to pay. The magistrate sided with the apartment complex and we were evicted. We had 30 days to get out. I was 69, wife 65, both Veterans, 2 dogs put out on the street homeless. We went to Florida found a new house, paid cash. That was December 2019. The same house is now double what we paid. The rental complex has a collection company wanting us to pay the rent they refused to take.

With people being allowed to not pay rent, I’d won’t be renting to anyone right now. We are about done with a rental out of pocket and I, in no hurry to finish it and rent it. Between material costs and renters not having to pay I can wait a few years. It doesn’t cost me anything sitting doing nothing.

We should be teaching everyone how to budget while they are still young. Young people don't need top of the line cars, jewelry, fashion or non-essentials. One of the first things to buy is real estate within you means and work up from there, plus putting (even if it's $5) something aside every month. Don't fall for these sales people that talk you from overbuying.

i just retired for my life (very high bp 220/110 numbers) i thought retirement was going to be better than it is, mortgage, truck, takes 1/2 of my income. gasoline, and utility's take the other half. most of this past year i had to just sit in a hot dark house. now it is a cold dark house(winter). the bill on the truck is the only one not going up. taxes is the power to destroy. yes i need the pu, i try to take care of my mom, she is in a nursing home. i need to add in to her checking account to keep her solvent. ( aka: not kicked out of where she lives now). some of my creditors are very mad at me. but at least the calls have mostly stopped. no way could have the moneys to pat them, as i am on a diet now. only X amount of food each month. not starving. but just making it month to month. people say buy a cheap eico car. but with what money? and then how many years will it take to break even on the cash flow?

I'm 74 and disabled. I got 8 credit cards to get my score up to get a car. I haven't had running water since 2018 because water heater burst, no HVAC, no workable kitchen. I have someone coming to clean my home in a little over a week for over 2k. There goes my car. And still have a broken HVAC, mold, need a subfloor and water heater. Don't know what to do😢. I'll go to your HELPS to try and get an answer. I only get $1200 on SS. Interest is eating ne up on these cards but I'm 100% up to date. Ty for your advice. 🙏

Try to rent a home or apply for assisted living, they will check your credit to see if you pay your bills and a poor credit rating can be a barrier to getting approved.

This is great video! My parents are 83 and 75 years old. They were charged $1400 when they moved out of their apartment after living there for 6 months. Yes, for 6 months they charged $1400 + $200 deposit. Reason for the charge was two or three scratches on the wood floor and they replaced whole floor on the unit. The apartment wasn't even a luxurious apartment. It was so upsetting. Now my parents are getting bill from debt collectors. My question, do my parents have to pay the debt collector? My parents live off of SS.

If your parents are on Social Security or other retirement income, their income is protected, they don't have to pay their debt. They can use their Social Security for their needs. Eric HELPS

He kept saying "They're not going to be buying a home ". I'm 70, a disabled veteran, moved from Florida to Oregon last October. I AM buying a home, or wanting to, but prices are ridiculous. A quarter of a million bucks for a house that might have listed around $30,000 in 2004... it's out of reach. And the V.A. won't loan on a manufactured home. I'm now considering owner finance properties. I live on S.S. and a V.A. check, I can buy a house if they'd come back down to Earth with the pricing. Will a bank loan me on a mortgage at my age? I was under the assumption that they would. It seems that monthly automatic payments would give them some confidence.

These videos with Senior Living and HELPS are primarily directed to the nearly half of seniors in America over 65 who have incomes within 200% of the poverty line. I suspect your income is not that low. They retire owing more debt than ever before. Some statements are generalities and of course, there are always exceptions. I certainly don't want to dampen anyone's dream. The point of the video and its important to listen to the entire video is that many lower-income and poor seniors don't need good credit like when they are younger. That's because credit availability is difficult for lower-income and poor seniors even with excellent credit. Would any legitimate lender extend a loan to person with $500 payments if their income was $1200 even if they had perfect credit? There is no extra money after basic needs are met with which to make a payment. The video points out that it doesn't make sense to go without basic needs like food and medicine to maintain credit that isn't available. In some ways your reply kind of proves that point. There are areas of the country where housing is far less expensive where it might be far easier to obtain financing. Eric HELPS

I am a senior. I applied to get a home, and obtain another credit. In both cases I was denied because of inquiries, and income to debt issue. In all cases to include trying to get a loan to consolidate. So, as a Senior, how do I get new accounts? Credit history is exceptional.

Good credit is just about how well you pay your bills. Sounds to me like the problem is income to debt. You pay your bills but you can't afford any more debt. A consolidation loan is looked at like the last step before bankruptcy. Every time you pull your credit history that is an inquiry. I would say your biggest obstacle right now is income to debt ratio.

I only have ssi. I was taken by ambulance to a hospital. One of the doctor's failed to file his bill with medicare and supplemental ins, he attached my SSI and took it before I ever knew.

SSI is a form of Social Security and cannot be garnished. Twice the amount of SSI deposited into a bank account is protected from garnishment by your bank under federal banking regulations. Even if the money was in a different account a challenge of garnishment could have been filed showing the money came from SSI and the court would have ordered the money released. Eric HELPS

I work at a home Depot and many of the senior citizens work full-time because it keeps them fit and healthy and can't get themselves to retire even though they can afford it! I'm in my early 50s and I'm already thinking of retirement and can't wrap my head around working full-time job at that age but I have to admit they look amazing and I myself can't keep up with most of them have the time!!

I was doing good on my. Credit and then I had a slip and fall, I have to used the money for my car and credit cards to spend on medical bills and Uber for therapy and doctors appointments 3 times a week and Costco (where I suffered the slip and fall) did NOT pay a cent for my medical bills. I was 79 years old at that time . Lawyers failed on handling my case. They had my case for 1 1/2 years and dropped it. Now pandemic came and no lawyer will take my case for offices were closed. Too many surgeries until now I’m suffering from ache and pain I don’t have money to pay doctors. Five months ago I suffered a stroke because of no immobilizations afraid of falling down again. I’m allergic to pain killer. I need help.

I disagree. The balance between paying your debts and paying your current expenses is the same at any age. Seniors may have more exemptions and less need for credit, but they usually have more to lose.

Say for example $1500 per month in Social Security after the husband died. $20k in credit card and other debt would require at least $500 in monthly payments to maintain good credit. Mom simply doesn't have enough money to maintain payments without sacrificing basic needs. She can't afford a car payment. True they can't touch Soc Sec or other pension payments, but they can go after other funds in the bank account. I am on SS, and I sell online to supplement that check, which falls far short of even paying the rent. They can seize that income, and if it goes into the same account with the SS, the bank will freeze all of it claiming that they can't distinguish which is which. Be careful before just walking away.

Hi, I am so glad I scrolled and stopped on this video. Yes, we worry about our credit scores. We don't have enough to pay bills on time. So, our credit rating is in the mid 500's. We tried to refinance our mortgage buy were denied by our bank because we were late twice on our mortgage payments last year. We owe $39,200 on our mortgage but our bank raised the payment to 1067.+ last year. That's the main reason we can't make ends meet. But, last year, we asked our bank if we could defer 2 months on our mortgage. They approved it but they turned around and reported us late to the credit bureaus. What can we do?

As the video explains a senior could have very good credit and be turned down because their income is insufficient to make a car payment. If you had good credit and were turned down then you are an example why good credit for lower-income and poor seniors often doesn't help. For seniors with minimal income sacrificing basic needs like food and medicine, etc. in an attempt to preserve credit that they won't be granted is not a good idea. For lower-income seniors, there are often better options for transportation than a car payment they can't afford. I get dinged on my credit scores because I pay off my credit cards every month. I put expenses, food, car repairs, etc for cash back. My income is $2200.00, I paid off $13,750.00 in a year (HOA assessment) and 450.00 HOA, no other bills, ( other than car ins, senior rate property tax, etc ), and I still get lowered because no revolving acct. 0 on 3 cards, 2 cash back, 2 credit unions-- go figure.

I am 73&just bought my 1st house. It is against the law to NOT SELL due to. Age.. I have family who live with me . According to the law they can take over that loan as long as they will be living in the house at the same rate of interest. I looked into it. That is why I bought the house.

Seniors are preyed upon. It's called predatory lending. Let's not forget about the Ponzy scheme and how many seniors have had their homes stolen. What can you do to help these people? Drove my relative into $25K debt and stole a $325K property, clear title, after losing spouse.. Not paying the CC debt but need the property back. Can you help?

Problem is auto insurance and qualifying to rent a lot base their decision on your credit score. Amount charged for insurance part of its charging amount is based on the credit score. How can you deal with that? Thank you, so appreciate all your time and care.

First HELPS has a program free for our clients called 7 steps to a 720 credit score for seniors. Credit can be reestablished, easier than one might think. Not all seniors are worried about their credit. Many are more worried about enough money for food, medicine and heat. More than a few states don't allow credit to affect insurance rates. There is a moral issue that's not being considered. If someone stiffs their creditors - as a karma thing - it makes the senior's life stressful and unenjoyable.

You might want to look at some other videos in Senior Living with HELPS and read some of the replies. The seniors HELPS works with are by and large low income and poor. For many, the choice is between medicine and enough food and paying an old credit card debt. Not worrying about having enough money to buy a prescription is less stressful than not paying a debt you can't afford to pay. There are reasons why lawmakers protect seniors' income. Seniors don't take undue advantage, as a rule, they would definitely prefer to pay their creditors. Many simply aren't able. Eric HELPS

So does not eating, skipping meds and not having a roof over your head. But I suppose making sure the banks can pay those huge bonuses, even after being bailed out by us, the taxpayers, should be a senior's priority! I mean, those poor Bankers might not be able to afford that second home in the Hamptons, otherwise. I shudder to think! 🙄

Seniors should be able to live their last years on earth with a degree of peace and contentment, which means having good physical and emotional health, a safe & clean home, food to eat, plenty of supplies, good transportation, etc. it does NOT mean worrying about "karma" because they're not making monthly payments to all the corrupt & greedy banks and lenders and credit card companies that are ripping off good people with obscene double-digit interest rates!

I'm shocked at the info that has been given. I use a credit card to pay bills and buy groceries that give good rewards. I pay it off every month to avoid finance charges.

Problem is creditors will harass you (and possibly even your relatives) constantly. The only way to stop them is to file BK.

Actually that is why HELPS was founded. You can look at more of HELPS videos with Senior Living that explain why bankruptcy is rarely necessary for lower income seniors.

Send them a cease and desist letter. Once received, they can no longer contact you. Of course, that may accelerate the legal filing. But if in your c&d letter you state your income is protected from attachment, they may just write the debit off.

I've got a question...What if the Senior dies and the Credit Card company continues to bill them even after you give them notice of their death? Then they send letters that they will go after their estate, even if none was left. And they continue to send the bill adding interest to it. I'm just not sure how to resolve this for my late mother. And her debt is a little over $3,000. Thank You for the video, I will try to contact this law firm.

Donna 2 years ago my Mom died and she had a credit card and I was secondary on her card, truth is I could never get a credit card on my own I have no credit myself I'm disabled and they would never give me one . I was the only one using the card and I was the only one paying it every month too. So I called the credit card company and told them that she died and the guy told me ok I'll cancel the card. I asked ok so what do I do now? He said nothing. I said you mean I dont have to pay you back or anything??? He said no you dont she was the primary card holder so since she is gone there is no one else responsible for the remainder of the bill..... And the bill was more then 8 grand. Donna you informed them did you call them? If the guy on the phone told you that all is good I would just ignore the letters they cant go after someone who's not there anymore. If it was only your Moms name on the card then that's the end of the story. I never got any bills from the credit card company even when my Mom was alive I used to just call them up and pay it myself my Mom and I lived on op ends of the country so if they sent them after she died I have no clue cause everything went to her to her address. I wouldn't worry about it let them go after your Mom see how far they get with that. And Donna sorry about your loss.

I was wondering if I shouldn't send the death certificate, but chose not to do that either. I heard you got to be careful how much information you give out like that. But, I think I'm just gonna go ahead and take your advice. I'll just keep pitching the bills in file 13 (trash)! Only other one's are the hospital, and they DO have her records. Thanks Bob. You can staple a copy of the death certificate to the bill send it back with a statement saying there was no estate. Eric HELPS

Set off of 15% of SS for past due student loans is currently stayed under Covid and the extension will continue until April 2022. Also lower-income seniors can qualify for income based repayment for past due student loans and often pay zero dollars per month. Curious, what about landlords requiring 4 times the amount of rent in income,this is many landlords in my area,I'm on disability,so is my fiance,but we can't find an apartment we can afford.All the affordable ones ask for 3 to 4 times the amount of rent PLUS first,last ,deposit,pet deposit plus 50 a month per pet.But credit is mid ok.I live in NYS

Landlords should only be considered with if the applicant pays rent period.

Not sure if this has already been addressed, but what about post-judgement/garnishment issues regarding the Stimulus Checks - can they be taken from Seniors. We might be getting a 4th stimulus check in the next month or so - SO will the garnishment take it all? If it's $400 - $2000, can they take it all from one's bank?

The last stimulus check was protected by legislation. There is nothing firm about a future stimulus potential and legislation will dictate if it is protected. Even if it is not it is unlikely it could be touched. But no need to get into details as the law is not in place yet.
