Ive thought about many of these issues myself. Ive been with my gf for 14 years now. I built a house after 8 years, bought many motorbikes over the years and bought her a car. I decided to put a mortgage on the house as a safeguard , just in case. However it's nearly paid off now. I did the same with her car, just in case. Our house is 2 doors down from her parents. They have never asked me for anything substantial, and I made it clear from the beginning that I don't believe in sin sot so that was something that was never going to happen. We all get along really well. Lastly now that everything is almost paid for , I kinda don't worry about getting screwed. Just made sensible precautions. I decided that I would never commit more than 20-30 percent of my net worth in Thailand , just in case. I have a truck in my name, and her car is in her name. I could be divested of everything except for the truck if things went south. Ive also made precautions for her financial security in the event of my death in the future. Not a lump sum as the temptation to spend it all foolishly, or invest in sure thing ideas, of which there are no shortage in Thailand. No, instead in ensuring a monthly decent income for life. My thinking is that a younger woman had dedicated a lot of her life to our relationship, and so naturally I need to think about what comes next after me. I love living in Thailand, and its a very rewarding life.

My wife and I have a similar arrangement to yours. She owns some land in Thailand, and we are going to build a house there. She will pay for that house with her own money, while I pay for our home here in Norway. If we where ever to divorce, she keeps her land and her house, while I keep my assets from Norway. If we where to buy some land in Thailand together, we will put it in the children's names. They are all Thai citizens, so there is no problem with ownership of land there.

I purchased 2 Rai a few months back in my wife's name. When we registered the property we set up a 30 year lease in my name, (you never know what might happen). We are also working on our Wills and the property will transfer to our kids upon any unforeseen circumstances.. I met my wife in the UK, she was a chef there. I consider everything as ours, but it's ultimately for the kids.

I am curious why did you end up lease not usufruct which gives you a lifetime right to the land without money transactions. Last Wills and Testaments are for sure important in case she dies before you -Jay

@@PloyandJayinThailand we done it at the point we registered the land under my Solicitors recommendation. I think it only cost about 300 baht. She said there are several ways this can be dealt with and they all work. This was just the most cost effective and simple method at the time we registered the land.

If you are a foreigner and you are about to buy land on the name of your Thai wife or your kid, you can sign the usufruct or the superficies agreement at the same time than buying the land at the land department, i imagine it's done at the back of the chanote. You must be assisted by a real estate lawyer to do it and avoid scam from the seller. If your wife refuse to sign it's a red flag, don't buy (better renting).

@@PloyandJayinThailand I was reaaally disappointed for that fact thinking that I would never be comfortable having all the land, house and stuff in my wife's name just bc as said, u never know what can happen, we are humans and things can change really drastically from day to day but after watching these comments I've been searching about usufruct agreements and it seems to be a really safe move to take in order to be almost the owner in regards with the stipulations of the agreement been able to manage from what you use the property for with respect to any activity that can generate an economic income to the possibility of living alone in it until the day you die and it is transferred to the children or something like that, and as felix said, if she refuses to sing u know that 100% a red flag taking into consideration that u are not going to leave her with nothing within the agreement if the marriage goes wrong. Really good to know, now I'm back planning to go someday, if possible, to build a life over there. haha

You can't put your name on the land but you can register your name on the house 78 baht that way you can stay there all your life If you get divorce you have to come to agreement you've done well

I forget the word they call this agreement I got all my info from Siam legal had an email from them but unfortunately lost it But I'm one hundred percent sure once your name registered on house no one can sell without your permission incase of divorce your entitled to half if you've got proof of payment

I agree that the most important things is getting things clear, no matter the topic. Those with bad experiences are usually the louder ones, and doesn't mean they are worth to be listened to (most of the time). Me and my wife, both non-Thai, are looking into moving to Thailand in the future, it's unfortunate we will not be able to buy land (unless thing changes) but there are other options at least.

Wise words mate. Nobody wants to think about the doom and gloom of these situations, but a little forward thinking and planning can mitigate some huge disasters in the future. An Usufruct agreement on the land is another solution, and your name is placed onto the Chanote title deed. We went this route. All the best!

Never really had the urge to tell my story like you mentioned in the vid but here I go: I met my wife about 15 yrs ago when I lived in Thailand for a few years. We were friends at the time and I went back to study in Netherlands, then holidays I went Thailand again and we hit it off. I was so broke at the time but she didnt mind. Came to live with me after a few years. Now we are happily married n have a 2 yr old son. Have a house in NLD and looking to build one in Thailand. Trust her 1000%. Also Im happy to be able to provide some for her and her/our family when needed, as I earn more money now. Even though they never ask, I can help out sometimes. We're in it together!

I met my thai wife in Thailand as I was leaving there. We got married at the French Embassy, my son was born there and I took them both to France because I wanted him to be educated here. My wife and I have been a happy couple since...1986. There is no rule in mixed in mixed marriages, regardless the nationalities. Some are successful and some are failures. It's all about compromising...exactly the same when you get married to a fellow citizen.

Foreigners should understand how the Thai hierarchy works. In order. First is the mother, then grandmother, grandfather, sisters, father, buffalo, brothers, pigs, chickens, the dogs, and finally you the foreigner. The key in my opinion is the family. If your intended comes from a good family, and you were introduced by a reputable person, you should be ok. Meeting a bar girl, and expecting your relationship to work out, well, good luck on that. Remember , Thai bar girls are the most charming girls on the planet. Some will have a husband and children back in the province, and after pledging their undying love for you, and you return home after your wonderful vacation, suddenly their mother will need an emergency operation , and you are expected to pay. Divorce is normal all over the planet, so just do your best.

My mate got divorced and his wife had to pay him half. Kids had grown up. He had paid for everything. His wife didn’t argue and both just grew apart. It was a legal decision handed down.

I have met many guys who lost everything. There are ways to protect your investments here. Legal ways. Highly educated guys loosing everything to a beautiful un educated Thai girl. My answer Education comes in many ways. Great topic.

My ex from isaan we were together for 10 years, after having a kid i thought ok, time to buy the car and house, so after getting the land i said you need to lease it back to me, this was a deal breaker for her, so she took the kid and the car the land and buggered off.

Ive been in Thailand 24 years now , married to a Thai lady for 22 years. Our son is now 21 in the military as is the case. Our house and all the land we have ( 2 small farms) are in his name so I'm perfectly ok with this arrangement. He will own it all one day anyway. Don't know how I'd get away with just biscuits and flavored milk mate. The apartment in Bangkok is and has always been in my name.

If you have kids with a Thai lady I'm guessing it don't matter if you lose the house because it will go to your kids so that's a good way to see it and a positive one. Its not directed to you its for anyone reading this and thinking about building a house in Thailand. I haven't been to Thailand but I always think when I hear the really horrible stories that the man must not have a lot of experience with women back home. Because women do the same thing when they can everywhere. Plenty of men go through divorce in the west and end up homeless. So I say be careful no matter where you are.

The plan for me in 3 to 5 years once I have the house paid off and I can use the house as a rental, the plan is for me to try out Thailand. I've picked Hua Hin as my landing spot. I'd love to buy 2 acres and build a nice large house on it and the rest plant all of those fruit trees you have. The fear I have is what your video is about, if I find a Thai lady in her 40's, things get serious, we buy the land and house and 5 years later she leaves me and wants everything. I'd be emotionally broke as well as financially broke.

Sounds like a good plan. If you are selective with whom you marry in Thailand, that 40-something lady will be educated, have a career, have her own money and won't have to mooch from you.

@@cabovermike Definitely, as I said above, I need to get my feet wet in Hua Hin first. I'm thinking around Hua 70 as it seems to be the middle of everything in town. That way I don't need to buy any bikes/cars and rent seems to be okay for $500 a month. I can walk to the market, bank, restaurants and beach from there.

My rule is never go all in financially. Never. It is good to understand you adhere to that rule as well (separate land in Spain). Relationships today seem to have a chance of lasting about 50/50. Many former couples as they fight each will grow vicious and seek advantage over each other. In Thailand for the native, they hold the ace card of owning the property. The foreigner had best be aware. Thai girls for sure do not have the exclusive on being manipulative! Bar girl? Almost impossible to take the bar out of them, especially if they have been working the entertainment zones for any length of time. If someone is reading this and gets all bent of of shape about this statement; I wish you the best of luck finding that unicorn or perhaps you already found one!

I agree with you. However, from what I have learned online, it seems the *real* problem often isn't the wife herself, but rather her bigoted, Farang-bashing, Thai-supremacist relatives.

I am one of the lucky ones, meet my wife at a beach bar in Pattaya 25 years ago. Still happy married. Worst thing I can say is my wife does like to gamble some. I totally trust my wife. We spent less than a million baut on our home and land. If something should happen I would never sweat it.

Be wary of the gambling , canadian bloke i know lives on coast south of surrat thani, sichon, got a lovely big bungalow and pool right on the beach, his thai wife gambled the house and lost, he had to pay over a million baht out keep the house, and he's still with her, i dont know if the house was in her name or not, but be aware,.

@ricebarnandrooms It’s always a good idea to have a lease back. When you go to buy the land have your lawyer prepare a 30 year lease for you that is lodged at the same time as you get the shanod. Have that lease registered at the land office. It’s like a lean against the house so your ex can’t borrow from the bank etc. using the land and house as collateral. You can then get your yellow house book and then your Farang/thai ID. People fall out of love, it happens so just cover yourself in case.

On a tangent, when you get your yellow house book you can buy your vehicle in your own name without messing with immigration or embassy letters. I've bought/financed two new vehicles here using my yellow house book - one through Toyota Leasing and one through TTB financing. The yellow house book works for buying scooters too, but those I never worried about financing. 🙂

Yes, having the Spain villa in your own name offsets your risk of having the Thai estate in your wife's name alone. The strategy of the truck being in your name further protects you, but only for as long as the depreciating truck has value. Your wife sounds entirely trustworthy and everything sounds great for you, personally. For the benefit of men *without* an overseas investment in their own name, I make the following points: Even after 10+ years of marriage elsewhere, that hypothetical man cannot safely assume his exotic wife will remain reasonable when she returns (with him) to her native country and its blood-is-thicker-than-water influences. Also, her family's initially-kind attitude towards him and his alien culture may deteriorate once he invests in a new family home there. In the end, the glow of the wife's love for that man may be lost in the glare of the wife's loyalty to her birth family. This is akin to how, after the 2004 Indian Ocean Tsunami, the Muslim Indonesian government very graciously asked for worldwide aid, but promptly asked the non-Muslim aid workers to leave the country once their contributions were made. Again, I'm glad you're protected from all this.

Very refreshing to hear a mature attitude to the possibility of relationship breakdowns, but as you also say, couples can live a very happy and long life together, and it doesn’t matter what nationality or race the mix is, the way western lawyers decimate “the opposition “ no one is safe.. 90% of foreign men who met their Thai wife happened to be in a entertainment venue, bars, message parlors or other entertainment or pleasure services. These men are normally twice or time and a half the age of their wife's, they have alcohol problems, drugs, loneliness, they have an inclination to like young girls, ....ect. Their would be Thai wife would see through them, and they take them on a ride and clean them up, because they met in wrong place and under wrong circumstances. You meet your wife on different planet compare to the majority, you and her are on the right path as a couple, but the majority of cases are nightmares, especially when kids are involved. I think watching the bad stories serve a purpose to warn people who in it for the wrong reasons, hopefully one or two will heed the advice, or they take some precautions, and ask questions.

You have very good advice. Thanks for sharing your perspective. I know there is a way to bifurcate the house and land in Thailand; House in your name land in her name. I also know that there is a legal instrument in Thailand called a useafruct (forgive the spelling) where the non titled person has rights to use the house until the person’s death. I think an attorney would need to be involved in those actions to ensure everything is done properly. Cheers.

I haven’t got either of those documents. I just got a stamped letter from immigration office, although I imagine thai driver’s license will be even better 👍. (I’m just guessing)

You can also sign a 30 year lease so that your ex can't kick you out of the house that you have built. Sounds like you have the perfect arrangement, but hopefully you will never have to use it

It’s called a usufruct which is much like a life estate in the US and can be out to 99 years…..I believe. Not a Thai lawyer so, pls feel free to correct.

I set up a Thai Company where I am 51% shareholder and the house is in my name. It’s more expensive but never ever put the land or house in your partner’s name. Make it very clear there may be inheritance further down the line contingent on the relationship being a success. It will focus their mind.

If you are a foreigner, you are minority owner 49% - foreigners cannot hold majority of a Thai company, and she is likely the Thai Director. And there must be 3 shareholders, so you can dilute your partner down, and make that 3rd "shareholder" a good friend so you can pass majority votes and quorum...and pre-signed share transfers, resignation and signed ID cards can be very helpful...but never, EVER give a Thai "control" over your assets...

When you think about how society and working women has changed -now women truly do majority of the work as well taking care of children, household duties and multitasking work. Talking about foreign born Thai/Lao women who come to the US who have educated themselves, earned a college degree and are now the breadwinner. Yes everyone have a different experience and that goes for anyone who is in a courtship.

If you are working in Thailand and pay taxes for a certain amount of years, you are eligible to apply for Long Term Residence Permit, and after that you can apply for Thai citizenship, which if approved would give you the same rights as a Thai native. Something to look into for a lot of folks, if you are here working and not just living here on your retirement-assets. If you want you can go straight to Thai citizenship you don't need Thai residency first. Mark Abbott did a video about himself getting Thai citizenship. The video is on KZbin under his name . Mark Abbott official.

If you're married according to the law you will be forced to liquidate marital assets (if you both agree) and so you should be able to recover at least 50% of the value of the house. In practice does this ever happen though?

people who are happy are busy being happy. people are so risk averse these days it just develops the rift from the start. people should always take precautions to ensure they can survive no matter what, but at the end of the day, every marriage needs complete trust and a lot of thai women (and most women) will take offense once you question it.

I have heard that the Thai government is opening up to give more fair treatment to Foreign spouses if they prove they paid for it. Not first hand knowledge but at least sounds more fair if you can prove you paid you won’t lose all. Great advice!

all Land and cars are considered community property - if you divorce property must be sold and split 50/50 - Marriage is registered when you get married, also if the husband is alive and wife passes you have 1 year or what is needed to sell land, if Land is properly registered with Land Office in Provincial office.- what complicates it and you buy a Land with her parents ,well that complicates because it can get screwy. Stay away from any great deal with parents-- also no kids better . also when you register House/Land she is on Title yes but you are also added as husband because they want to know where she got the money-- some offices are different.

You have such a great start because you met your wife in the UK. And as you said, you made money and invested together. However, that is not the case with many foreigners who come to Thailand to meet their girlfriends 😀 The reason why too many foreigners lose their money in Thailand is they don't protect their investments. Instead, all go under their girlfriend's name. You gave great advice to put something like a car under your name. However, if you want better protection, you can always consult a lawyer, get a lifetime land usufruct (although she owns the land and IF she dies before you), put the house under your name, etc. Keep in mind foreigners also have rights in Thailand. My wife and I have been together over 8years, when her sister bought 4rai of land near the Koh Lanta ferry for 2 million baht, I made a legal loan to her for half the land(2rai) for 1million, then a legal lease back to me, that way I still retain control of the money. This method can be used if you are not married to your partner, if they refuse to sign these documents then you know you're in a dubious relationship.

Yes that’s what my solicitor got me to do as well. That way you won’t find out one day that the land you thought was fully owned has been hocked back to the bank even though you have a lease. I’ve not seen many report on this extra step of establishing a loan to the wife. They seem to think having a lease and that noted on the title is enough. Who knows in Thailand

i love your project vids but this one, is a bit off kilter . 1.. you say you are nly married in THialand. well if you are legally married, its global, and so the sum of your global assets is your (joint) estate. your car may be in your name but under divorce law here, its a joint asset. AS IS YOUR PROPERTY. so you are right, you cant wn the property BUT you do have a claim against it were you to get divorced. now why you would choose to live in Nakhorn Nowhere if divorced is a different issue. If your wife DIED, well you then have time to transfer the property to a different name, or company. its not vicious here, jsut different. back to divorce, were you to divorce, AND NEITHER PARTY BEGAN A NEW RELATIONSHIP.. then any assets bought during your marriage are divided 50/50, regardless of who's name. and also if you owned a truck before marrying here, and replaced it, well the old one is yours alone, ( all assets owned prior marriage are yours) but when you replace it, the new vehicle is a joint asset. I dont think you will need this in your case but its important not to mislead. now back to the irrigation and the house finish :)

Just love all your videos Mate keep them coming. As far as the unforeseen future I’ve placed all my (trust) eggs in our basket, knowing that we are in a committed relationship. This takes faith that what God put together man cannot interfere. We have faith in each other as a team working towards the same goal of life together until “death do us part”. More positive than an unstable future Love will always be in our life “for better or for worse” this we take vey seriously without a doubt. You’re quite the man and I’m sure Anna loves you for always ‘cause unlike the horror stories out there, Thai women, especially from the country, are dedicated and faithful. Doesnt a farang who wants to purchase land in Thailand have to form a corporation and have Thia partner have 51% control? That way if things went bad farang would only lose approximately half of the value?

If you and Anna bought your property in Spain jointly and paid for it jointly, why wouldn't you hold the property as tenants-in-common (50% each) or as joint tenants? I realize that these are American terms for holding real property with shared interests, but I don't get why YOUR name is on the title SOLELY when she was an equal partner.

To own property in Spain you need to register for something called an NIE number, and it’s quite a lot of hoops to jump through to get the application granted, if you’re not a Spanish national. It was far easier for just myself to go through this process, rather than involving Anna also (the fact that she was from a country outside of the EU made the process much more difficult). So the mortgage was set up in just my name even though every payment was jointly made. Anna trusted me implicitly throughout the first 5 years of the mortgage, and I trust her implicitly now that the shoe is on the other foot with our Thailand property. We always planned to put Anna’s name on the deeds to the Spanish house once the mortgage was paid off in a couple of years, but when we built the Thailand house we opted against it, just so everything’s kind of “fair”.

Why are you living with the premise that a nasty breakup is possible; that's negativity and will increase the possibility go it happening. If you know and understand your wife, (you say you are only married in Thailand, does that mean you haven't gone to the trouble of registering your marriage legally, it would then be recognised around the world legally,) and your relationship is strong, you will know that a breakup cannot happen; that's positivity and can only get stronger. A relationship is not about what you can get out of it but what you can put into it. If you both put in to it, it can only get stronger. If, one of, you only takes out it will crumble.

I have been married to a Thai lady for over seven years already and she too asks for nothing and we are well suited to each other. We are in the UK at the moment but hope to move to Thailand in the not too distant future; all depending upon how aggressive the UK government gets with its plan to extract as much of our finances as it can. It's nice to build a house. Anyone can come to USA and own half the country if they can afford it. Which is fine. At least, we should be able to own a few acres of land/homes/business without having to be financially vulnerable and susceptible to being scammed in holding assets in other people's names. I consider owning land/business via marriage/partnership a shady means. Too risky. USA's prerogative would be that our citizens in their country be treated as we treat theirs in ours. Their laws are such that they're looking out for themselves. That's fine. We aren't being looked after. We are just preys. The responsibility falls on the shoulder of our evil scu-mmm-bag lawmakers here in the USA for not making sure that Americans have reciprocity rights (minus political ambition) in other countries. They only look out for their club members/themselves. "We The People" is left exposed to society elements. If the citizens of all those countries where we can't own land/business outright (Philippines, Thailand, etc,) were to be treated the same way here (our prerogative), their laws would be different because it'd affect their economy. Everyone is susceptible to being "scammed" if we have to depend on someone else's good nature/intention. There's no recourse. I don't want to have to be married or have business partners via corporation. I don't wish to be a pet. My prerogative. I'd just want to own outright. No nonsense. Equal rights. I'm specifically talking about business/home/land ownership and the ability to build on such land as I see fit. Not condos. It's simply bull-shit! It's beyond unfair and ridi-cu-lous!!!

Could you start a company in thailand and buy the land on the company name? With your wife being 51% owner of the company and you the 49%? Also if you are married and divorce, you should still have the right to 50% of everything you aquired together.. so even of the value of the land.. if she has no money to pay you, she would have to sell the land.. or is that not the same as in the west?

There is also the possibility your wife may pre-decease you (e.g. motorbike/traffic accident). You cannot legally inherit. Your property will then pass to her family, which is fine if you have a solid relationship with them. BUT, if not.....? It might be easier if you have children, as property could be in their name? Otherwise, useful arrangements could be a usufruct or right of superficies agreement. I am currently investigating these myself. But in your video you deal with this in a very balanced and rational way. It's a highly uncomfortable topic to discuss.

On the truck thing oin your name ok but if you drop dead,she may have problems selling it ,a will is a necessary req.not only for the car but if you have the 800,000 baht req.for visa,+ cash float,to mutch to say gold etc.etc.quess am one of the lucky ones 25years and counting,thanks for the vid.regards.

We live in the UK, I met my wife here and had never been to Thailand before that, we have been together about 15years now and married just over 6 years ago, we have a great relationship and are moving to Thailand in about 4 years, we already have land and will meet builders next year…. I trust my wife fully and totally agree with what you say, all you hear is horror stories but you never hear about nice normal relationships….. good luck with your life there, we will keep watching….

Great video, your story is very very similar to me & and my Mrs. I really can't see the problem with the land ownership issue for some people. I am 10 years older than my Mrs, she lives with me in the Uk, chances are she'll out live me, she gets everything I own, as she's my wife. I know of an English/Thai marriage that broke up, they had a house in greater London & a detached house in koh Samui, in the divorce proceedings, both property values were added to together & split accordingly. I know loads of guys with Thai wives in the UK, most, not all, have married the bar girl, they're understanding of Thailand is Pattaya, Nana & Esaan, I know nothing of any of the 3, I don't have to tell you, Thailand is very regional, different people, different way of life, coltures, food & in some cases language. Good luck to you & the Mrs. Enjoy ya life in Thailand, we're be out there in the next 5 or so years, land bought, just need to build.

I just disagree with you all of the Thai women are not the same and also how you are treating them too. I am a Thai woman and did meet my husband here in the United States And married after three years later and he is nothing but a stupid drunk daily for more than twenty years and very low education . I'm just about to leave everything including my mobile home which I pay For before I meet him. For fifty five years here in the United States. I worked hard and educated myself until I retired .

All I’m saying is, because Thai law does not allow a non Thai person to own land within Thailand, it’s better to cover your ass before jumping straight into marriage if you’re not a Thai person.
