Legitimizing a child is not criminal law, it is family law. It is the process of filing a paternity petition with the court. A DNA test is usually ordered to determine if the child was produced by the father. The paternity petition can be filed by either the mother or father. It is heard in the Family session court in most states. Once paternity is established by either a DNA test OR in some states the father can accept paternity, he then has full parental rights (custody, visitation, child support, etc). Just wanted to weigh on on that issue... Great video Mike!

Legitimizing is to declare/admit paternity. Until then, he has ZERO legal rights to the child, especially visitation. Then child support could be sought.

I always wonder the same thing. I've watched so many of these videos and people say, "I don't know," to legitimate questions that they should know the answers to..like "when did you leave the house? When did register your car? Who's your insurance carrier? Where are you now? Who's your baby's daddy?" I know court can be nerve wracking, but c'mon! 😉

I’m from Atlanta Legitimizing a child is where the father signs acknowledgement of paternity papers. Typically it is completed at the hospital when the bab is born.

This is an example where I think an attorney could have helped the woman in Judge Manning's case present it much more coherently and probably meet the elements of the TPO with ease. But she was clearly struggling under the pressure and anxiety to convey her thoughts in a cogent manner.

Legitimizing the child means to have a paternity test to confirm that he is the father. Without that confirmation a court cannot give him visitation of that child if the mother contests visitation.

In re: legitimatizing a child: when an unmarried couple have a baby, the father has zero rights/responsibilities to the child legally without an establishment of paternity. There is no establishment of paternity until A)the father acknowledges it by signing the birth certificate and/or filling out an acknowledgement form/affaidavit or B) by some court/administrative process it is determined they are the father. There's a bit more to it than that depending on state law but that's the gist.

If that Iorio guy is abusing Xanax... and he intends to quit doing that in order to get contact with his daughter... well, he is in for the most intense misery ever. I've never taken a benzodiazepam, but I've talked to experienced drug abusers who have gone through withdrawal from heroin after years of heavy use and they describe that as a cakewalk compared to the nightmare of withdrawal that quitting benzos leads to. If someone who has withdrawn from heroin says some drug isn't for them because the withdrawal is worse, that's a drug I don't want to get dependent on...

I worked for Butler County Clerk of the District Court at the very tail end of the last century. Webber wasn't one of the judges back then. I was the best little file clerk they ever did have. Worked in the jail kitchen too. Inmates loved my chow. I was fired for turning the boss into the Sheriff was not providing insect free flour. Fired me! 😂

Not a lawyer or US citizen but would appear in Georgia that any child born out of wedlock isn't considered legitimate and the biological father does not automatically have any parental rights to the child unless they petition the Superior Court of the mother's jurisdiction. In this case Judge Manning is instructing the father to file a petition with Fulton County Superior Court and they would then have a hearing about that, the mother can object to legitimization and other factors come in including: paternity, fitness of the petitioner, best interests of the child and the child's relationship with the father
