Affected on F4 category India???
@kuriousminds20194 жыл бұрын
Hi Pari, Yes, it was affected as well based on the original April 22nd Proclamation which was extended in the new June 22nd Proclamation. It looks like it will be affected ONLY if the visa was not approved/stamped prior to the proclamation. Please speak to your immigration attorney as well. Good luck! Here's a link to an immigration forum which explains it in detail: immigrationforum.org/article/president-trumps-proclamation-suspending-immigration/

It effect i130 visa ?
@kuriousminds20194 жыл бұрын
Hi Shama, It looks like i130 petitions would be affected as well since the Proclamation released on April 22nd was extended as well. April 22nd Proclamation was specific to immigrant visas, where June 22nd proclamation is in addition to immigrant visas, it also affects non-immigrant visas. You should consult with your immigration attorney for specifics that might affect your case. Good luck!

@kuriousminds20194 жыл бұрын
Hi Nagaraju, If your wife has at least a Bachelor’s degree, then I would suggest getting evaluation for both would be beneficial. As that is the only way to get additional points for her education.

Hello, My name is Srini. I am exactly like you travelling from Sarnia to Michigan everyday on H-1B visa, but did not travel last few months due to Covid19. The only difference is I am a Canadian. If you can, my question to you is, if My H-1b extension approved in the next month or so, will I be able to go to the border and get it stamped. As you may know, Canadians does not need Visa on the passport. My second question to you is, I am also working in Essential Services but not Health care and plan to go to US from July and will I be able to travel every day between US and Canada? Please let me know. Your video is very useful. Thanks,
@kuriousminds20194 жыл бұрын
Hi Srini, Here's a statement from the State Department's website: "No valid visas will be revoked under the proclamation". So to answer your first question: If your visa is approved, you will be fine. 2nd: Since you are considered an essential worker, you should be able to travel across the border, make sure you have certain documents from your employer which justifies you being an 'essential worker'. We have been carrying a letter from our employer stating what kind of job duties are assigned to us, the nature of our company and why we are considered essential. I hope this helps, Good luck!

Thanks for your response. So, is there any trouble coming to Canada every day? Canada has isolation in place?
@kuriousminds20194 жыл бұрын
No issues coming into Canada from US via land border. They just ask us if we have any symptoms and we haven't been told to isolate.

Will it effect nurses outside USA?
@kuriousminds20194 жыл бұрын
Hi Shova, Nurses could be exempted if they work in a hospital setting directly working with COVID related care for patients. If you have a valid and stamped H1B visa , you could be exempted that way as well but we will put a follow-up video in a couple days after we ourselves travel across the border once the executive order is effective.

Thanks for the video. From what I heard from various sources on the internet (PS: am not a lawyer but just passing on the information I gathered from the internet), it sounds like if you have a valid h1b visa stamp then you're allowed to cross the border. The question I have is whether automatic visa revalidation is still valid if you're crossing the border from Canada into the US?
@kuriousminds20194 жыл бұрын
Hi Sunny, I am unsure of the answer to your question, but here’s a link to this: help.cbp.gov/s/article/Article-1218?language=en_US I will try to find out about it tomorrow.

Hi Sunny, I confirmed with a CBP officer this morning over the phone that automatic visa revalidation is still valid!

@@kuriousminds2019 Hi, I have another question. Would you happen to know if H1B travel into the United States with a Valid Visa Stamp via land gets affected due to travel restrictions between US and Canada Border?
@mounikaravella86014 жыл бұрын
Will f1 visas get affected by this? Do they stop students entering into US on f1 and automatic visa revalidation is still valid?
@kuriousminds20194 жыл бұрын
Hi Mounika, F1 visas are not mentioned in this Proclamation, so we assume that F1 student visas will not be affected. About Automatic visa re-validation, the immigration officer at the border mentioned that they see no reason to deny those individuals. But, when i spoke with another CBP officer over the phone, he said that they do not have a complete guidance yet and should have concrete answers by tomorrow.

@kuriousminds20194 жыл бұрын
Hi Princess J, Looks like at this point he will be affected by this decision. But, please contact USCIS & your immigration attorney for better understanding of this situation. We contacted our immigration attorney this morning, but they said they are still trying to figure everything out since the proclamation was just released yesterday. They will try to get more details within 24-48 hours.

Hi Princess J, I went over with more resources on immigration related and State Department's website. You will not be affected if the case is in NVC. Check this website: travel.state.gov/content/travel/en/News/visas-news/proclamation-suspending-entry-of-immigrants-and-nonimmigrants-who-present-risk-to-the-US-labor-market-during-the-economic-recovery-following-the-COVID-19-outbreak.html We will also post a follow-up video by tomorrow.
