It’s hard to feel bad for influencers when they’re the ones who forced the FTC to step in and regulate their shady dealings. If they had been above board they wouldn’t be forced to devote precious content seconds to disclosures.

My biggest pet peeve that you mentioned is these huge Influencers technically disclosing, but putting it under the text or in a hard to see place. You know for a fact, with them being as big as they are that this is not an accident or oversight like they are trying to make it look like. They have an entire team editing and proofing their videos, so it's 100% on purpose no question. But they think we are stupid and will think they just didn't realize it when they made the video.

Since they only care about the money, not the passion anymore, the only way they will stop is when brands and the influencers will face legal actions. When it goes into the money, people start to care. Which is sad.

This is such an interesting topic tbh. What do you think about music artists or labels paying social media accounts with large followers to make a tweet or ig post or story or TikTok promoting the song? I see those all the time and none of them use the appropriate disclosures. I saw a guy on twitter last year accidentally expose himself saying he was paid to say "I'll get my purse" to encourage his followers to buy a song.

For people outside US dealing with non US companines on non US platforms like TikTok do FTC guidlines have any bearing? For example nikki tutorials is dutch citizen based in neatherlands, nimyah is (as far as I can tell) as dutch registered company & she's posting on tiktok from the neatherlands which is incorporated under Byte Dance UK subsidiary. She is then subject to UK/Dutch/EU laws in regards to nimyah. So the question is then are the EU laws on social media disclosements on par with FTC? Very interesting topic, thanks angelika!

I believe that the FTC guidelines are applicable to any content that will be reaching American consumers? I’m not 100% sure on how exactly it works but I assume because Nikki makes money working with US companies, advertising to US citizens she’s subject to the same rules as someone like Mikayla is? It probably does get a lot more difficult to enforce these rules for people who aren’t directly in America though so maybe that’s why she feels like she kinda sort of get away with it? I think the EU guidelines/laws on disclosure are little more vague than the FTC (or at least more general to advertising/media that having ones specifically for influencers) so you probably would need that to be more inline with the FTC to be able to truly enforce it.

I have a genuine question about FTC guidelines and content creators outside of the US, to anyone who might know: From my understanding, FTC violations can lead to civil penalties like hefty fines. Since the FTC is an American branch of government, is it more difficult for them to penalize creators who are outside of the US? (If so, I wonder if that could that be part of why NikkiTutorials has stopped disclosing properly.)

I’m really not sure on the front of how they pursue legal action. I know that no matter what, if you are reaching American consumers, that you are under the jurisdiction of the FTC, but I’m not too sure how actually pursing things goes. I would assume it’s easier with countries that have a decent relationship with the US, or that the FTC can work with the countries advertisement agency of that country to pursue action.

Maybe because YT is an American brand, they can just take any fines out of whatever money is earned on YT? I'm sure that, at the very least, they can make it so you can't be monetized on YT if you don't pay the fines.

I’m gonna be honest and just say if you’ve been online since 2016/2018 and you still think you NEED a disclosure to be able to tell if they’re biased or not, you almost deserve to get scammed atp. It’s too easy to see how they’re bsing. It’s more an argument of principle than necessity.

algorithm help yeah not disclosing is so weird to me. I personally run a blog where part of it is beauty and I write reviews and because of tiktok, I put a disclaimer at the top of every (not needing to disclose) post now “not sponsored or pr or affiliated” just to feel like I’m actually being transparent with my readers. Like. because of tiktok girlies (gn) like this. I don’t even HAVE tiktok and they made me do this
