This device is absolute junk. I blew a false positive today. Reaching their 24/7 customer service proved useless because they dont have any reps working at night. Now i have to pay to get a code to unlock the device, pay to have a shop reset my device and also have my length of time extended. Read the reviews on this companies website, theyre horrible. I'll change this comment if they fix how their device wronged me, otherwise everyone stay away and pick a different device TaylorMade Man 100

I blew to start my truck and passed. I let the truck warm up coz it was raining and cold that day. While it was warming up, I went back inside to finish getting ready. Brushed my teeth and rinsed with equate mouthwash . I finish getting ready and got in the truck and proceeded to my destination. About 2 minutes later, I had to take a running test and failed. I had to pull over and shut the engine off and re-take the test. I was blowing and every single time, it kept saying "invalid sample. It done this at least 7 times. Luckily, I was in Hardees parking lot and went inside and got a cup of water, rinsed my mouth out and tried taking the test again. It still kept saying "Invalid sample" Finally, it said, "pass" Well I was on my way to see my dad who lives 3 hours away, and it I passed every running test on the three hour trip. Well, after my 2 day visit, I got in the truck and the device said I needed to take my truck to a tech due to the failed running test. I did and explained to the tech what had happened. He done some test on it and told me , I had a slow fuel cell. So he replaced it. He said if I got a letter through the DMV, to just show them the report he filled and I would be ok. I eventually got a letter from the DMV and I hired a lawyer and requested a hearing. I go next week for the hearing, do you think I have a chance on winning this and if so, will I get my $450 back that I had to pay to request a hearing? BTW Im in NC

You should talk with your lawyer. Definitely sounds like you have some possible defense issues.

Andrew quick question about DUI. If we get taken to the station to blow into that breathalizer or whatever it's called......do we have a right to demand a blood draw instead of breath test?

I am not on probation I had a Dui back in 2015 completed my probation then I moved out of the country . their requirements was when i drive again to have it in my car for 6 months this morning i went to work i work overnight at amazon went in ate some food from the vending machine 😅😅 came out to take the break in my car went to start it it turned red so i waited but did not blow into it again after that the machine kept saying retry . so i called the company they told me what to do and then it turned on my question is was that a violation ? and if so because it turned red . now i called an attorney he said im fine and wont get in trouble because i am not on probation or have an open court case it was just a requirement they out out . im still a bit skeptical but just wasted your opinion

You may not be on probation, but your required interlock time is extended to at least 6 months from the date of your most recent violation.

I am in Alberta Canada and I received a curative (conditional) discharge, no sentence, no fine, no mandatory IID installation required by the Judge and no Criminal record and one year probation which ended succesfully in Oct 31 2018. I found out when I tried to get my licence back that Alberta Transportation decrees that an IID has to be installed for 12 months. I got it installed 6 months after my probation was over. What I cannot understand is that what would happen in my case if for some reason a Fail showed up instead of a Pass because of something other than alcohol which supposedly could happen. My probation is long over. Any thoughts on this?

Sir your talking about a fail violation missing a rolling retest is also a violation if the sample keeps aborting
@Andrewflusche5 жыл бұрын
I don't often see violations for missing a retest, but that would certainly be considered a violation too. Judges might look differently on those depending upon the circumstances.

I have a question? Back in 2016 I was taking care of my dad with stage four cancer, had a very bald tires, and at three in the morning I had to rush to the emergency room because my boyfriend’s leg was gashed open and his guts were hanging out!!! When I was going down a steep hill one minute after I left my house, I went to apply my brakes and slid down the hill causing us to run into a light pole and my boyfriends had went halfway through the windshield and we both got knocked out. I did not do drugs but I did smoke weed like two weeks before. When the cops got there they did not even look at my tires but instead The first thing they said/asked was “what are you fucked up on?!?!” SCREAMING IT!!!!!!! They could clearly see where I just wrecked into a light pole. Ignore the fact that we both had concussions. But proceeded to put me into the back of a police car take me to the hospital and draw blood. I failed for Weed/marijuana! Because of that they gave me a D.U.I & forced me to get a EXPENSIVE $1,500.00 interlock ignition device installed in my car and keep it for a year/365 days!!!!!!!! My issue was not even with alcohol. It was with marijuana which I did not even smoke it that night!!! But had smoked it TWO WEEKS PRIOR!!!!!!!!!! This sounds soooooo unconstitutional to me!!!!!! Breaking my 8th constitutional amendment!!!!!!!!! CAN I PLZZZZ HAVE UR OPINION ON THIS?????
@Andrewflusche3 жыл бұрын
In Virginia, it would be very unusual to be convicted of DUI if all the blood showed was marijuana metabolites from two weeks earlier. In other words, according to your post, the blood showed zero active substances that could impair you.
