This is why I never initially invest in any start-up venture. Always provide the money as a loan, with a contract, and IF the business does pick up, you can always add addendums to the contract to be repaid your loan in equity in the business. But if things don't pan out, at least all documentation prove it was a loan, which must be repaid regardless of the prevailing circumstances

Bottom line…it doesn’t matter WHAT the defendant used the money for BECAUSE the plaintiff signed the agreement that the money was an investment. She invested in an idea that was not off the ground yet. The plantiff’s ignorance is no excuse. So many people quick to invest in something because they looking to get rich quick and they fail to do the research to make a sound decision. One of my friends asked me to invest in a business and I had them to a sales pitch and write up their business plan and work to get the idea started. I helped write up the business proposal for the bank and got involved to see what all it took to get the business working and found that some things weren’t gonna work. Needless to say, it didn’t happen and my pockets never got lighter. 💁🏽‍♀️ You can’t be too eager to make an investment. Had she consulted a lawyer she would have made a better deal that included her getting her money back should the idea fail. This is what happen when you money hungry and seeking a quick come up. I’ve had so many people approach me with business deals and you have to be willing to do research, ask questions, and consult independent council. If you don’t know enough to do that, you fair game and ignorance is no excuse. 💁🏽‍♀️💁🏽‍♀️💁🏽‍♀️

If they tell you they will use your money for one thing and they use it for something else, even if it's an investment that is fraud. This case would have been positive for the plaintiff if there was a signed written agreement stating that the returns from the investment should come in within a certain period and if not, the invested money should be returned. If there was an agreement like this written and signed by both parties, J J would have ruled in the plaintiff's favor. I think this could be a warning to people giving money to an individual or company for investment. There should be a time frame either 3 months, 6 months, or 1 year when the investment should start producing returns and there should be an agreement for the invested money to be returned if this doesn't happen.

This two ripped off the plaintiff and who knows how many more people. No way would a marketing guy do the work for free two years after an investment was made in the business. The plaintiff said she gave the money in 2011 but the guy said did not do any work until 2013. What did the defense use the money for during that time? My guess is this guy did brochures years later because the two of them ran the scam. Now they can claim the business ran out of money and they closed. Truth is that the defendant is still running the business.

Did anyone else notice that the defendant said the money was invested in December 2011, but the date on the little contract between her and the plaintiff is dated January of 2014? Seems to me like the plaintiff started bothering the defendant about the money, which is evident by the defendant's complains at the end, and to pacify her the defendant quickly wrote something up. I know that doesn't change that it still makes the money an investment rather than a loan, but why write something up claiming potential quarterly gains for a company that by then was going or had gone under? Makes things look very suspicious and I think would be more proof of the defendant scamming that woman out of her money.
