👏 👏 👏 I bet those restaurants don't use a separate kitchen, prep area, or dining area for anyone ordering anything that uses any type of nut. You know... just in case someone dining in has a nut allergy. I bet what happened here was that some customer saw them seated with their dog, and like a Karen in the wild, complained to management. Pointing out health code violations, but not knowing that federal law supercedes state and local laws and ordinances.

What ruins all of this are the people who slap a vest on their pet and say, "Emotional Support Animal!" so they can bring the pet into a restaurant, onto a plane or some other place. The pet gets into it with a real service animal - the real service animal is traumatized and unable to perform its function without VERY expensive retraining, if it ever can again. The people who have these animals love them - they form a bond. Now you've got a need and the animal can't perform it, but you love it and don't want to retire your animal for another (at a cost of as much as $35k or more), all so that your pet doesn't have to sit home while you're out.

Here's an idea, and wow...after looking at the general costs to 'buy' a service dog....don't necessarily sue if needed, but if an establishment is in violation (excluding if the closeness to 'kitchen' is a health factor...shouldn't have been made to sit there, and may be as much of a distraction for the dog)...but getting back to the idea, no law suit, no fine...but with violation proof, by the ADA would give a citation charge like, resulting a cost of between $10,000-$15,000 of one trained service dog, to be then donated to a needed recipient, for free!.....maybe then the $HUGE hint would be heard far and away to come...a 'WIN - WIN' situation!

I am so glad to hear that someone is taking her case. I have a medical alert service dog. She always wears a vest stating her job while in public. I have been discriminated on American Airlines (on my 4th and last flight home). They claim she was a therapy dog. I have been isolated in my own tiny room from my party at Barton G. in Los Angeles because I had a service dog. I have been kicked out of the disabled / appointments line and verbally assaulted by a DMV worker at the Inglewood office. I reported it to the state. They said he could abuse me and kick me out for no reason. I have yet to hear back from the Feds. There are many other times I have been refused service at a restaurant. Also people will not rent to me, even when I tell them they are breaking the law. A lot of times I try to choose my battles. Would I want to eat or live somewhere I am not wanted? But in the case of the flight and at the DMV, when it is truly effecting my life, then I speak up. (When I did, the Inglewood DMV then tried to take away my license). So I am so happy to hear that this is being taken seriously. I know there are a lot of fake service dogs (they are the ones attacking/bothering service dogs in stores), but people who need them, need them.

For people saying it’s “unhygienic” for a sd to sit in a restaurant with the handler, service dogs are regularly groomed, my dog gets bathed every other week, brushed every other day, and regularly sprayed in a cologne to keep him smelling nice, if he gets his paws super dirty they get cleaned off. This is what every good handler does. And if the dog is literally gross and stinky and just plain disgusting, the restaurant can ask them to leave for that reason. But the dog here doesn’t appear to be ungroomed and gross. Service dogs save their handlers lives, everyday, sometimes multiple times a day. They have a right to accompany their handlers everywhere. It’d literally be like telling someone they can’t bring their wheelchair because the wheels are dirty, it’s discriminating against disabled people. Not to mention, unless a dog is literally running around, shaking everywhere, jumping on the seats or table, putting their heads on the table, they aren’t contaminating anything (not to mention a real sd won’t do those things) they literally lay there, unless they need to task

Not to mention, you genuinely wouldn’t know you’ve been seated next to a service dog (in a restaurant that is) until the handler stands up and a dog emerges from under the table, because actual service dogs are really well behaved, to the point people don’t know they’re there until the last minute ❤️

Often I find people who are giving me a hard time don't even want to listen or read the law they are just bullies. I used to go to IHOP for breakfast with my service dog (before covid) and I would always ask for a table that was out of the way so my dog would not be a problem. I was treated fine. I think they appreciated that. It doesn't hurt to ask to be seated where it will not be a problem. Sometimes you have to meet a business half way. @@lideabarker8161 I appreciated your thoughtful and sensible comment. I'm also a service dog handler, I've had six dogs and have dealt with these types more times tha I can count over two plus decades, and I've worked with service dog handlers with a variety of disabilities and needs. Your thoughts are valid, but I also think that there's a lot of nuance and fine details to each situation. We don't know all the details of this specific case; from an outside perspective, it may be easy to say the person may be going too far in taking legal action, but only the person can make that determination. When a handler says calmly and clearly that she didn't feel like she was being listened to, that is a valid concern and reason for the business to deal with consequences. In some cases, a lawsuit, unpleasant as it can be, is what is necessary to get a business to change their attitude and practice. And prosecute the fakers. Those are the people that you should be angry at and sue. Not the people who actually need a service dog. The issue is people use the "I'm allergic to dogs" card frequently as an out; I'm not saying there aren't those who don't have severe reactions; but people often don't go and get medically tested to find out the specifics of their allergies, nor do they educate themselves. It depends on too many factors to list here, and it isn't always the "dog" that is the actual cause of allergies. In practice, accommodating both a service dog team and someone with allergies can be safely done; the key is to have a conversation with all parties and come to a mutual understanding... that doesn't happen often.

@@louissantoni8561 well this is where her case gets complicated cause her condition is considered an emotional condition that manifest physical symptoms. Basically she has hysteria. It boils down to whether it can be proven that her condition counts as a real disability. She says so but that’s not up to her or the restaurant. Technically even iv the restaurant staff incorrectly asked if proven to be her condition is not counted as a legal disability the restaurant won’t have to pay. Honestly there needs to be a line. I throw festivals and all the time people bring their “service animals” and things are let loose, brought right by the speaker arrays, let them poop everywhere and they get in fights and bite people. I can’t say or check or have anything to protect myself aside from sueing them afterwards and trust me I promise you 4 out 5 service dogs at a loud music festival are not service dogs. And a lot of people know they can abuse the law and just take their wild animal anywhere and know that following up on their damage is impossible. This lady got in my Uber when I worked a long time ago brought 5 people and a giant sheep dog covered in stickers and he wasn’t bathed and he was scratching up my seats and when I said something she tried to get me fired. There was nothing clear about her disability and even though I never brought up it being a service dog she got mad when I tried put a cover on the seat and have the dog get back in and have the people who can’t fit get another ride. So I refused and they tried to get me fired but I had video do the company saw she was abusing the rules and the dog was disgusting. I’m all about people having a service dog or pony but there’s gotta be a line. Any non apparent disability needs to have some sort of marker to differentiate that can’t just be claimed arbitrarily yet gives the person in need a way to give the business a way to know it’s not just an emotional support dog versus a dog to help you with a disability which let me tell you in this case and looking at her I’m not sure if it’s a disability or not because based on the information that I understand from my schooling that I went to on the subject this is a controversial ““ disability it’s not really sure if it’s even a disability they just say that because of a persons emotional state that they may have physical actions and symptoms. So basically she has histrionics. So is histrionics a real disability even if you know faint? And if it’s not she’s taking advantage of it. So I don’t have the same sympathy right away because I have a little bit more understanding of what her disability might actually be based on what she told us. And this is the problem is that anybody can use anything and say it’s a service animal even if the service animal doesn’t really even have a way to to service them when they have a problem based on her histrionics there’s nothing the dog could actually do to help her except maybe bark. But in any situation where she might be having histrionics the dog is it gonna be anything but an emotional support. Does that make sense ? that’s the only way the dog can help her because basically it’s all about her emotions so is it an emotional support dog or is it a service dog?

PER the LAWS, businesses can NOT discriminate against service dog teams. Discrimination also includes segregation. Fear and allergies r not valid reason per the laws either. The person with the fear or allergies has a right to move themselves if they want to, they also have a.right to take their allergy or anxiety meds if they want to, and they have the right to leave the business if they want to. They do NOT have the right to force the service dog team to move or leave. The world revolves around rights and laws. Not feelings of Karens. I wish to weigh in on the subject not as someone complaining, belittling or dispariging the use and purpose of Service . Or the service that our veterans have given to our country. As a retired US Army, NCO and a disabledf veteran as well I merely wish to express the fact that as a Veteran we still represent our country and what she stands for. We still have a responsibility to be respectful and considerate of our fellow citizens whether they are veterans or not. If we can minimize the effects that our disabilities place on those around us then I believe that we owe it to ourselves to endeavor to do so. In so doing we are Ambassador's and represent our service well. Thank you for your service.

Having a service dog does not negatively affect anyone else. Having a service dog does not mean u r being disrespectful or inconsiderate. Saying that u should give up ur legal rights just to make some Karens happy is however very disrespectful and inconsiderate, and goes against everything the military fights hard to protect.

@@visegripmechanic973 Switching tables is one thing, but people with service dog being completely segregated to another or empty of other diners is too far! The issue of allergies or being afraid of dogs has already been addressed and settled by Federal and State governments. Besides, I'd be interested in reading a news story about a true service dog harming someone to justify the "afraid of dogs" excuse, or the more common excuse of "allergic" to dog hair. Can you point me in the direction of a news story of the allergy/afraid issue? BTW, do you have any idea of how much animal fur, (cats, dogs, rabbits, etc pets), that cling to people's clothes, and their own hair even though their pet is at home?
