My employer told me I won't be working on sites that require vaccination. In short I'll lose money and stay home if the client request vaccination. This seems like a form of punishment and a form of coercion and discrimination in my opinion. I'm still waiting to hear back from a lawyer

My employer said about the same thing; If their client wants vaccination proof and I don't supply, they will put someone else in my place. They have done it once so far. Another employee said to me today that I won't be there long.

May you folks be ever-blessed. Your two sessions - one now and the other one prior to the elections, have provided loads of valuable info and clarity; and helped us save time to focus on solutions for a post-dismissal setting. I've watched many of your videos over the past week of so. Every video has been very good and very consistent but I don't know if people aren't actually watching the video or they just don't like what they are hearing but it seems like many still want to call these measures illegal or trying to tell the lawyers what's up with the law! They are simply telling you what is allowed from a employment law standpoint. No amount of yelling, or complaining or emotional outbursts will change that! I feel there's two conversations going on here. The one in the video about the laws in Canada and people's interpretation of what they think is the law.

Thank you for this information. If anything, you are at least spelling out that it may be shortsighted, wrong, even illegal, but it doesn't matter, they may fire you no matter what, and then that is when you seek compensation. I do like your idea of coming forward to your employer/supervisor/manager/owner and make your views known; if they value you as an employee they will likely find workarounds to make everyone happy, if they don't value you, better to know now (as hard as that may be to accept) and understand that your time is limited whether by a vaccination policy or by some future policy.

What about temporary substitute teacher jobs. They are flexible day by day jobs. You work when you want too. These school districts are mandating that vaccine. What to do? If you work for a temporary company and that temp company send you out to work at a school district. That school district says to the temporary agent that you need to take the vaccine to work in that school districts. That temporary agency is following that school district policy. Mandate vaccine. What to do? Its a temp sub teacher job.

At this point, I would've thought someone from the judiciary or the legislative branch would have stepped in to reign in these 'westernized fatwas'. At least south of the border, nearly 15 states are taking the federal government to court, as well as prohibiting mandates issued by smaller institutions like hospitals and universities. No such luck in Canada.

a better question is, once you get your severance, it will run out eventually. What are you going to do then? A lot of companies will be pre-screening your status before they even consider interviewing you. Seems people are trapped.

I'm being put on unpaid leave Nov 15. Since we came back in the summer from the last lockdown , I haven't been allowed to work when the store is open because I'm not able to wear a mask for health reasons. So, my hours are half than what I was getting.

An employer can't change the terms of an employee's job (hours of work, for instance) without the employee's permission. An employee may be able to treat the change as termination, and secure severance pay through a constructive dismissal.

Yes, severance (in Canada) is owed even after a short stint with a company. And, just because an employee is on probation, it doesn't mean that they can be fired without severance. As an example of a potential outcome (depending on the numerous factors) for a short service employee, we recently secured 6 months' pay for a client who worked only 6 months with the employer.

Do these rules also apply if the union is also the employer? Also, since there are single dose vaccinations, can an employer require you to be double vaccinated? I am currently in a situation where I am being Denied shifts due to not being vaccinated. They have not threatened to fire, they simply have not given me the shifts. If you are looking to start a new job, where there is no mandate for employees, can a potential employer force you to get vaccinated before accepting you as an employee?

22:50 Re Bill 201 is quite clear and simple in its definition of a "genetic test" which means a test that analyzes DNA, RNA or chromosomes for purposes such as the prediction of disease or vertical transmission risks, or monitoring, diagnosis or prognosis." As I understand it, it does NOT make a distinction between genetic information of the virus and that of the host individual. Having said that though, even if the genetic material refers only to that of the virus and not to the individual human being where the sample material is taken, it does not make sense to differentiate it because the material to be analyzed is still contained in the individual's body. Besides, the purpose of these covid tests is to predict disease, transmission risks, etc which the Bill defines.

EEOC confused the narrative. They are federal. They gave the green like but if you look closely, they indicate mandates under the EUA, which is all we have despite their false narrative. Exemptions apply but that’s federal law and each state has independent laws. At the end of the day....why are we being asked to submit to something that does not work, FACT, and is experimental, FACT, and has no legal ramifications for the manufacturer in the case of injury, FACT.
