He wants $45k? After he left the property in worse condition than when you gave it to him? Is the guy drunk? He seems to think you financed him so he can play investor and that there's some sort of undo button he can press because he got bored or in over his head. He seems to forget that there is risks involved with fix and flips, and you get richly rewarded if you get it right. Either he just hands the property back and takes the loss, or it's his responsibility to find some other investor to cash you out for the rest of what you're owed. The gall to say he's going to stop paying AND ask for money back is astronomically entitled. If he continues to fight for money back and wants to risk future projects together, I'd rather foreclose on him just on principle. I really hope you're not about to go all soft because of the holiday season or something. He's the one in the wrong and he knows it and it seems shitty that he wants you to shoulder the burden of the consequences of his actions. The bank wouldn't put up with all this nonsense and neither should you. Plus how good of a contractor can this guy really be? I mean it is like you financed a restaurant chef to make his own dinner and he couldn't pull it off and ended up starving. Pathetic! But if worse came to worse, hell froze over and the Grinch's heart swelled up 3 sizes, I'd only give him a small fraction of the money back and negotiate the rest in future labor since he is your contractor. No way would I allow no consequences and give him all of his money back.

i would take it back unless it was in a sketchy neighborhood and i wanted to be rid of it quickly but i dont think id pay what he paid for it unless it was a Real bad emergency then id give him what he gave me - costs

Yeah, you gotta take it back. This was an expensive lesson on learning what not to do. But if he does all your renovations, the 45 grand it costs you now might be a fraction of the money you lose if that relationship goes sour. Hell, the relationship with your business partner might sour as well. Buy it back, keep the team together and make even more money.
