All of them to some degree plus higher ups. The point of police is to observe and understand their environment. This is what they are trained on. So the fact that all of the officers failed to observe that the car was parked, let alone themselves standing on the track, tells you it's a deeper problem.

Not to defend these obviously stupid cops, but thats not the procedure for a perceived threat like in this situation, they got reports that the person was in possesstion of a firearm and was pointing it at people, so they must get the person in cuffs and safely put away in a cop car before going through the process of ID'ing them.

I mean it is situational awareness, all three failed to see what the problem could be. The third cop coming in late surprises me he didn't call it out upon arrival. The first two had tunnel vision on the suspect and ADD on looking through the car and wanting to go through procedure and not on the entire scene with details.

Do I believe all of these cops were tunnel visioned and didn't realize that a train could come and hit the vehicle? Yes, because why would anyone knowingly let this happen. Despite that, I do believe that they should've been charged from the perspective that they did know this was going to occur and that they were intending to end her life. If a regular civilian mother left her SUV on train tracks with her baby in the car then proceed to plead "I didn't realize my baby was in the car" as a defense, I don't think any judge in the world would let her off without some kind of murder charge. I specifically highlight the fictional mother pleading "I didn't realize my baby was in the car" because that is essentially what the driving officer stated: "I didn't think the Lupton officer was gonna put her in my car" and I argue that this is a complete admission of guilt because it insinuates he knew a train would come and hit his vehicle.

Both officers should share the blame. There is no doubt about that. But it is FAR from even. It's like a 80%(female)-20%(male) split. The guy negligent decision of parking the vehicle on the tracks was going to cost the department the vehicle and all of the equipment inside no matter what. So he should definitely get some severe punishment like unpaid leave during investigation, docked pay, demotion, and more. BUT what the female cop did was BEYOND careless, negligent, idiotic and reckless! She has zero right to argue he shouldn't have parked on the tracks when she did NOT have to load the detainee into that vehicle! She was obviously oblivious to the tracks herself by choosing that vehicle over the other. And she loaded someone that is fking handcuffed with the doors locked. She absolutely royally fucked that detainee. And just to add how unbelievably stupid/oblivious they both *(specifically and especially the female cop)* are, they do not even think of the current circumstance when they hear the train horns. A small credit to the male officer was that he at least thought of the detainee and most likely assumed the female cop would not have fking loaded her into the vehicle on the tracks while being nonchalant about the approaching train! She should absolutely be fired and face charges of attempted manslaughter (not attempted murder). She has NO ONE to blame but herself.

The guy initiated the stop. The guy is responsible for the suspect. The guy TOLD the female officer to "go ahead" and cuff the suspect. It's his suspect so she takes her to his car which was also the closest and largest vehicle. The only reason she is bringing the suspect is because she is the one who was told to do the arresting. Your 80 - 20 explanation is almost as braindead as this male officer. Obviously if your senior officer is doing something as stupid as parking on the tracks, you would also assume he's experienced and senior enough to know if the trains have stopped, as they do in many areas at certain times and there is no need to worry about one coming by. Clearly he had no idea and parked on the tracks like an idiot. Is she supposed to just assume he's that low iq to do that without knowing if trains are still coming by?

How is it legal in NA to put a person in handcuffs without telling them the reason of arrest? In any normal country if an innocent person is handcuffed that cop loses their job. First you need to give a reason fully covered by law for arrest. Its actually illegal where im from to even demand a person to leave their car-they can say no and police cant do anything,first you as a cop have to give a reason for suspicion,ask for documents,check the documents in the system and have actual proof a person did something illegal to even get them out of the car. A car is basically a house-private property.

What I don't get is how the hell they took so long to remember the woman was inside the patrol vehicle once the train hit the thing. Like bro. How dumb are they? Plus, what if it was karma? The woman probably parked strategically to make the cop park on the tracks. She got arrested. And karma fucked her. But maybe that's just a fictitious reach.
