what would happen if a Chinese Canadian claimed as non-resident but rented out an inherited apartment unit in HK. Does that person need to pay tax to the Canadian government?

OK, you can declare your overseas property as your principal residence (which is exempted from Capital Gain Tax) on form T2091 when you sell it, even though you have a house and live elsewhere, say, in Toronto. BUT, remember, you can only declare one principal residence per married couple per year when you have several houses around the world. Hence, make your pick carefully and thoughtfully and hope for the best when you see your accountant.

Non-residents working overseas? Looks like you have emigrated to another country after living in Canada for a while. In that case, you only need to report income from Canadian sources (such as rental income, investment income, withdrawal from RRSP, business income, etc.) You do not need to declare overseas properties nor report any overseas income. BUT, you should tell CRA when you moved overseas (ie, declare non-residence) on your T1 income tax return. If you are a performing artist (actor, singer, musician, TV talk show host, standup comedian. etc) , I strongly recommend you to consult a Professional Chartered Accountant if you return to Canada to perform in a concert or film a movie or do a TV show.

@@mschan3572 NO - you do not need to report overseas income or properties during those years that you are overseas. You only need to pay Canadian taxes on Canadian income (such as bank interest, trading on Canada stock market, rent collected in Canada, royalties if you are an artist). To be exact - the day between you left Canada and the day you return - your personal exemption is pro-rated in the years of leaving and coming back. How to pay non-resident taxes while you work overseas ? By law, the payer of your income, such as the bank,. the stock market trader, tenants of your house in Canada, your pension fund administrator, music copyright authority, etc., must withhold 25% non-resident tax and remit it to CRA. Hence, if you pay a non-resident (an actor from Hong Kong to make a movie, for example), be careful: you as a payer may be responsible for his non-resident tax. EXAMPLE, if you sell a house as a non-resident at $1 million, your lawyer will withhold $250,000 (25%) and send it to Canada Revenue Agency. You may later file a non-resident return to claim things like legal fees, real estate commission, selling expenses such as fix-ups and repairs, etc., to get a tax refund. TAX TIP: You may work up to four year overseas and still call your house your "principle residence" when you return to Canada and enjoy a tax exemption. OPPS! If I work five years and return, then I am screwed? Not quite, the exemption is pro-rated. .
不可以,也沒有那麼多的人力物力去查核數以億計的稅務帳戶。 不過,加拿大和一百多個國家有「稅務條約」 international tax treaties(包括中、港、台在內),彼此税局之間互相交換資訊。如此,可減少各國人士逃稅,也避免「雙重税收」。比方說,你是演藝圈人士,去各國巡迴演出,如果沒有這些國際稅務條約,後果真的是一塌糊塗。

@beyondKOL Long time ago, Manulife floated herself into stock markets worldwide at the same day. A policyholder of Manulife HK got the Manulife share and the policyholder authorised Manulife HK to be his/her trustee to sell the Manulife share while the policyholder regarded that the trustee, Manulife HK, would sell the policyholder's share in HK. However, the trustee, Manulife, sold the policyholder's Manulife shares in Canada. Manulife deducted 25% tax from the proceeds of the sales of the Manulife shares after the sales of the Manulife while the policyholder has never been a Canadian and has never lived in Canadian. How come a Canadian who lives outside Canadian is entitled not to pay tax to Canadian under his/her non-taxation Canadian??!!! It seems that it was so ridiculous.
