I expected Nintendo and the Pokemon Company to try to sue Palworld for copyright infringement, to claim designs between Pals and Pokemon are too similar. But they're instead claiming patent infringement and claiming Palworld copied game mechanics?! Not only could the two games not be more different, it's incredibly scummy to claim ownership over game mechanics and to set a legal prescedent where a company can go after a dev for using such mechanics. This feels like a shady way for Nintendo to manipulate and exploit the legal system that could have long-term ramifications if they succeed. BanCo patented "mini games in loading screens" and did nothing with it for years until it expired. WB patented the "nemesis system" and still haven't done anything with it since Mordor. Patenting game mechanics kills creativity.

That is why I think it may be a process or piece of code that is not what we can see at the consumer level. Makes more sense than Nintendo having a patent on catching things.

Patenting game mechanics is inherently destructive to the gaming market; several of the best titles ever have been built on reiterations on games that released before. If AAA game companies become litigious over specific gameplay mechanic, then indie games would be shut out of engaging in entire GENRES of games. If Nintendo pursued this case and won, what would keep them from pursuing this same kind of lawsuit against games like Coromon and Cassette Beasts?

If you're talking about the 2024 catching mechanic that's just a continuation of the 2021/22 catching mechanic filed for L:A. Not that it really matters considering the basic catch mechanic has existed since the Palworld devs released Craftopia back in 2020.

Nintendo has filed a cr*pton of patents over this year alone, it feels like they're just trying to patent everything they can come up with and since the system is bad they actually get the patents for most of them and then if you want to make a game there will be definitely something in it that they can sue you for. It has no real basis but you do need to fight it and that means legal fees an indie dev might not have funds for. Would be okay-ish if in case of a patent that ends up struck down as illegal/flawed whatever they call that, those that Granted said patent would be also punished. Are they punished in such case? That would make them more motivated to not let someone go around patenting the word "red" and the like...

Yong, you realize those 3D models were proven false, right? Those models were altered by someone to make it look like Pocketpair copied the molds 1:1. And again, we are also aware that Pokémon also copied Dragon Quest with some of it's first mons. Again, why is it only Pokémon can do it, but no one else can? In terms of the patents, there is no sense. Nintendo really did sue Pocketpair with no basis whatsoever. That's Nintendo for you. They think they own an idea, and just get to take whoever they want to court with no real repercussions for their false claims. Nevermind the fact they play completely differently from each other. Digimon, Yokai Watch, TemTem, Persona/Shin Megami Tensai? Did Nintendo forget those exist? They are just salty that Pocketpair made a good mon capture game that changed the formula, while also sticking it to Pokémon, albiet unintentionally. And that really is all it comes down to; "Pocketpair made the Pokémon game Nintendo/Game Freak never would." Hope Nintendo loses. Rather innovate and actually put effort into making a good Pokémon game, they rather sue Pocketpair and get Palworld out of the way. Even though both games are completely different in gameplay. Patents shouldn't exist, anyway. How the fuck you gonna claim ownership over a damn game mechanic? By that logic, Shin Megami Tensai should be the ones sueing Pokémon. Because I've seen a lot of misinformation going around, a summary: -Nintendo is *NOT* suing Palworld for their character designs. They are suing over patent infringement. -Said patent infringement was not specified by Nintendo, however, sources speculate that it's most likely the "poke ball" game mechanic where you aim and throw a ball to capture creatures. -Nintendo can't sue for copyright infringement of the character designs because the Pals are designed differently *enough* to be protected. My opinion: If that is the case, this case should be thrown out. This is like a publisher copyrighting a game mechanic of a character jumping while throwing a grenade in a first-person shooter, and then suing other games that do that. If you played Palworld, it plays nothing like Pokemon.

I'd like to be a little more clear on your second point. The patent being talked about is specifically for the Legends: Arceus catching mechanic. Not just aim and throw a ball to capture creatures, otherwise the Let's Go mechanic would also be in this patent. This specific patent is 20230191255 or 20240278129 . The first one being the original, the second being the most recent one. And yes, we don't actually know if this is the patent(s) Nintendo plans to fight with, but it is the most likely one from what non-lawyers can tell.

@@The_Azure_ Problem with this patent, if it's the one, is the Palword devs already did it in Craftopia beofre Arceus released so Palworld already had said mechanic before Pokemon whcih may bring up the issue if Nitnendo shoudl've ever been allowed to have said patent to begin with as it would've not been unique to them at the time they issued said patent (which is generally the main requirement to get a patent)...hell this case could even lead them to losing the patent completely and being allowed to make similar patents to it in the future if they change up aspects of it. They probably don't go for monster catching in general as a patent as other companies have made games that did it first and if they attempted that they're opening a can of worms that lead them against all of the gaming industry (this is already pretty bad imo just like WB's BS patent on the nemesis system and how even a similar idea with different code can't be done) If they want to patent or have patented the specific code in which they catch Pokemon and that was infringed fine they can go for that but he idea na, sorry just the idea alone should not be patentable/copyrigthable in regards to copyright laws.

If Nintendo wins this case, it will be over for any Pokemon type game. Nintendo will be the ONLY company making Pokemon games. And I think having a monopoly like that is extremely unfair.

"Pokemon type game" - the usual genre terms are Monster Tamer or Monster Collector RPGs. Then again, I wish we did live in a world where we could use "Pokemon" as a term for the Monster Tamer genre because it would be _really_ funny if it resulted in Genericide and Nintendo's copyright was affected.

It should not be allowed to patent game mechanics period. Most companies abuse this to prevent competition and just want to sit on their one good Idea. If your game does it best you get the attention you want (see palworld) without the need to sue others. This just kills innovation

They have a separate game called "A.I: Art Impostor", this game uses A.I as the premise is being a fake artist using AI, but during the initial shitstorm people misrepresented statements regarding this game as being about Palworld.

Basically A-B testing. When one of these two succeeds, they get to grow the one that did (and eventually the other). They did copy their own game, and it's because they can. It's legal. What Nintendo is doing isn't good.

Take Nexomon for instance it is also basically pokemon, but more violent. Temtem is another example of another creature catching game. Why not throw in Caset Beasts in there as well. I would also like to add Palworld is a different Genera of game, Pokemon and Nexomon are both turn based RPGs where Palworld is a survival crafting game with monster catching elements more in line with ARK survival. Nintendo wins this it will encourge them to be picky and choosy. I feel like the real reason Palworld is being attacked is it got big real big if only for a moment. Can we also the leadership within Nintendo and Gamefreak are actively hostile towards their own consumers and fans. I think it will do Nintendo some good to be humbled in court.

Unless it costs nintendo siginficant money their not going to change. That's all they care about, and thus far their actions have yet to affect their bottomline. Ontop of that this entire case is going to be complicated as it's taking place in japan between two japanesse countries in a court system heavily biased towards nintendo and it's considerable weight in politics due to it's long history and ties to less then savory characters and it's shit load of money. Pocket Pair inc not only lacks the funds to fight this to the end without going bankrupt, but they lack the support in a country where this kind of behavior from companys is expected and accepted and have to deal with the entire system being heavily biased. Suuing for "Game Mechanics" is incredibly scummy. That means Dragon Quest should've sued Nintendo for Patent Infringement on Party system. That's also wrong. So if someone patented "Shooting Mechanics" that means they can shut down anyone who makes Shooting Games there. That is completely stupid and wrong for all the reasons involved.

This is especially true because Pokemon didn't invent monster catching, multiple games have released before Pokemon. The type system has almost always existed in RPGs. Pokemon has almost nothing truly unique to it. This lawsuit would have to go up not just against Palworld but many companies, in fact they all benefit from Nintendo losing.

That's exactly the point. They don't want a game that gives the same kind of experience being available for the rest of the gaming market. Selling low power consoles like the Switch for the same price as PS5 or Xbox Series X I believe is something they get lots of money from. The games for it automatically can only have a smaller scope, which means lower production budgets while the games go for $60. Huge profit margins.

The fact that Pokemon/Nintendo is trying to sue Palworld out of the market is just a red flag of them being incapable of making a decent contender. Because I'll be frank. If they released a game like Palworld, with similar mechanics (Let's say you found a town, build up a gym, gather stores, well known trainers etc) and made it with pure love. It'd leave Palworld in the dirt. But instead of that. They're just trying to get rid of the only title capable of rivaling them.

Though there is a theory they are doing this knowing they won't win, but are using their greater pool of funds to make Pocket Pair go bankrupt. However this is one key issue with that idea if that is true.. Game has offline support and custom server hosting, people can still play it even if it does get removed. Modders will mod the game since it has that support to an extent. Players can still make videos, and... Players will still compare it against future Pokemon titles. If those games are more buggy than Palworld which is an incomplete game mind you, not fully released.. It would just hurt nintendo.

This is dangerous because it sets a new layer on what can be filed for a lawsuit. Considering game mechanics are creativity based, this kind of lawsuits could only harm in the middle/long term. Games mechanics should be an exception for patents to an extent, remember how the Nemesis System is locked to be used on a major scale because it was patented by WB and was only used on Shadow of Mordor and Shadow of War? I genuinely hope Nintendo loses the case.

The Delphox art was a fanart of a potential mega evolution too. You gotta be careful about these kind of details when you present them, but the only reason we feel upset about this is because he's usually so reliable in the first place. Personally, I don't think taking that much time to compare the designs was nessicary to the horrible case here either. The mechanics patent is much more terrible for everyone than any design patent could ever be.

Even under Japanese law, WAITING on this one probably is going to cause them the most problems with their lawsuit, as this game had a lot of fanfare at announcement, and at launch all those months ago, so they had time to stop it then. Now? Now it either looks like a money grab, or at worst, an attempt to kneecap the competition as they ramp up for a pokemon game in the fall for the Christmas time. Either way, that's a bad look in, and that fact that they're basically going after it for the creature collecting aspect...something THEY did not invent? Japanese law is different than american, but it's still likely to be a bad look.

@@toukoenriaze9870 Who knows...apparently Palword has some backing from Sony and Microsoft before this so if they want to keep the investment going they could just keep funding the company by funding other games while this case goes on if the judge just doesn't toss it quickly (which they quite frankly should due to 1st how long after the lawsuit was made after Palword was known to be a thing in development/in early access and buyable now and then 2nd most mechanics they likely will target likely aren't patentable to begin with and never should've been or the patens may have expired if its something like ball catching as it's been nearly 30 years since the first Pokemon game came out or they didn't patent it until recently (which some people are saying Nintendo only patented the ball catching this August though it may be for a version specific to the Pokemon Z / A game or back when Legend Arceus released so the August filing may have been an extension or something however the issue there is Palword's devs apparently used something like this in Craftopia which released before Arceus so that will be an issue for Nintendo in court...throw in those were just applications from what I read...I don't think anyone mentioned if those patent applications got approved or not which if they weren't and Nintendo's trying to use that on Palword than they'll get in trouble for not using a valid patent in the lawsuit and that alone may get the case dismissed. And let me be clear patents do expire (usually 20 years for both the US and Japan so even if Nintendo patented ball catching if they didn't renew it immediately after and only did so with Arceus/the new upcomign Z game then ya it won't work for them) so if any of those Nintendo is trying to use in this lawsuit passed that time and they weren't/weren't allowed to be extended than there's no case for Nintendo.

If they were able to do it over copyright infringement, they would have done it before the game even get released. Japanese law is even more restrictive on that matter than US or EU laws on that matter, for instance there is no such thing as "fair use" under Japanese laws.

I think they couldn’t go after Palworld for the monster designs, because they themselves got "inspired" by Dragon Quest monster designs for the original Pokémon. That would definitely come up in court if they tried. So, they decided to take a sneakier approach, using a precedent like the Crazy Taxi vs. Simpsons: Hit & Run case to improve their chances of winning which centers around the idea of patented game mechanics.

@@laurencefraser Also it's more difficult to change gameplay elements than design elements. Pocketpair could easily redesign all the Pals in probably less than a month to avoid copyright. However redesigning whole gameplay systems is far more trickier. Even then you still wouldn't even know if the changed gameplay is far enough removed from the patent unless you ended up making an entirely new game.

you have to be blind to think pokemon designs are rip offs of dragon quests designs, taking inspiration on the same lore creatures is not the same thing as ripping assets from pokemon and frankensteining them into your own versions using some shitty AI slop generator. this will just be the first of probably many lawsuits, not sure why everyone thinks these are one and done all or nothing packed deal things. They can sue them over every single aspect of the game.

Palworld was just in negotiations with Sony music and Aniplex to start making Merchandise, franchise the brand, possibly roll out a new anime or shorts and even do charity work. Nintendo picked an INTERESTING time to lay down the lawsuit upon them. Not even serving the lawsuit in private, they flat out announced they were going to file for patent infringement without even talking to PocketPair first. Meaning they want this to be a spectacle and they want people to see what happens to them. Nintendo's Pokemon thrives in 3 areas, the Game, the Anime and the Merchandise which makes a majority of Pokemon sales. When Nintendo saw PocketPair starting to do all three, they acted NOW. Meaning Nintendo feels threatened by the smallest possibility that Pokemon's Culture phenomenal sales now grossing over 100 billion dollars could be threatened even by a little. This isn't just petty, it's straight up bullying the competition, one that even admired Pokemon as the director of PocketPair stated.

And really, I think the AI generation loving company that's been ripping off design and mechanics from other companies for years now, before Pal World was a thing even, should be humbled rather than the company that took the failure of the Wii U with humility and had the upper execs take pay cuts instead of firing people. Because digimon isn't trying to compete with them. They started as a virtual pet franchise and still exist to this day as that, everything else was secondary to the V-pets and infact the anime was originally made to be a glorified commerical that got very popular so it stuck around. Also because nintendo has a lot of money and political clout.....but not enough to want to get into a pissing match with bandai.

Because Digimon is a spin off of Tamagotchi, Tamagotchi has different creature stages too. Not to mention Tamagotchi came out the same years as Pokemon. Pokemon February 1996 and Tamagotchi November 1996, aka they were in development at the same time

Imagine someone patenting the FPS style of game. There would be only one single FPS game. Glad I never supported Nintendo with my money ever. If I would be Nintendo, I would contact the company to do a collab where as a form of DLC, you could actually implement Pokémon in the game, it would be a win win situation for both company and players.

If this is seriously considered by any judge, it's going to be more than just this game that's going to be under threat. The fact that PP wasn't even notified of what patents they are supposedly infringing immediately tells me N is doing this in bad faith with intent to harm, not for genuine legal protective reasons. Got it, so Nintendo's financial strategy is to release the same game 100 times, then when someone else actually puts in the effort to make a good game that doesn't even use their IP, they'll just take their competitor's money away via lawsuits. I will not give money to companies like Nintendo anymore. I'll check in maybe in 2034 and see if Nintendo is behaving themselves - until then, I bid Mario, Zelda, and Ash a fond farewell.

The fact we don’t know what this patent is tells me it’s probably something so stupid even the fanboys are gonna have a hard time defending it. I am Japanese. I watched this video with Japanese subtitles using the automatic translation function. It is an easy to understand explanation. Thank you. I liked Nintendo, but this lawsuit is sad news. It looks like Nintendo is threatening other companies under the justification of "because of the patent" and "because it's legal". It appears to be an overlap of the Japanese yakuza. I sympathize with the confusion of the video contributors. Instead of threatening other companies and taking their money, they should make more interesting games at a faster pace!

Pokemon Legends ZA comes out next year. They're attempting to soften the market. They don't even have to win the lawsuit to do so. Pocketpair is a small company. Money they spend on defending themselves legally is money they can't invest in more palworld development.

From a PR perspective, this is a really bad decision. This just gives people more reason to hate Nintendo. I don't care what your allegiances are, no one or entity should be able to own the rights to an idea. The same goes for game mechanics. Just because they have bottomless pockets, doesn't mean they can own the monster/creature capture genre, or any other game mechanic. Same goes to any other company. They're only suing Palworld because they're grasping at straws, and this is the only thing they can legally do to get after Palworld. I hope Palworld wins. This lawsuit will be damaging to their image, and I hope at least if Palworld doesn't win, I hope that Nintendo's Image gets a big hit in the end. A sort of eye for an eye situation.

I only know US law as an enjoyer of the topic so I do not know any of the peculiarities of Japanese PATENT law. We can reasonably infer however they are NOT suing over the similar likeness in characters as that falls under Intellectual Property (IP). This is also not copyright (factually incorrect for YongYea to say it is Copyright, they are 2 separate things) as Nintendo says they are suing under Patent law and not Copyright law. Nintendo suing for PATENT violation presumes that Palworld is very similar in GAMEPLAY or other underlying systems or mechanics such as net code, server architecture or any other piece of technology that can be patented. To differentiate Patent from Copyright or IP is a high level thing but tldr: Copyright is the right to copy a already created thing, IP is the ownership of an artistic thing, and Patent is the ownership of a technical thing. But that they are suing under PATENT law may mean a few things: 1) Palworld's creators have ex-Nintendo employees who utilized things from their time at Nintendo in Palworld (code, server architecture, processes, etc.) 2) Nintendo is fishing; This is not a serious claim and are trying drown their competition in legal costs. 3) Nintendo is making a survival Pokémon game (copying palworld) and want to eliminate their competition. What I think, that if Palworld's development team is 100% certain that point 1 is false then they need to countersue for legal fees and highlight how Nintendo may just be employing anticompetitive practices.

Law in each system is close enough that if they're suiting over patent, it's not about character design. That's copyright infringement in japan too. I think you're spot on with number 2. Pokemon Legends ZA comes out next year. This very well could be a move to soften the market for it's release. It doesn't really need to succeed either, seeing as Pocketpair is a relatively small company. Money being used to defend against a lawsuit is likely to dig into development funds.

This ridiculous. Pokemon isnt even the first game series to capture creatures and make them fight with you. Dragon Quest and SMT predate it. That aside, this feels like trying to copywright a game genre, which is entirely nonsensical.

Its gonna be the end of video gaming if this goes through because what this means is someone makes a new gaming genre and any other company who wants to participate in this new genre is not allowed to do it because a game of the same genre is obviously having mostly the same mechanics. So it will end up that only 1 company per genre is allowed to exist.

I am convinced that Nintendo doesn't care about actually winning this lawsuit. They likely want to reduce Palworld's influence on the market by miring them in legal troubles so they can release Pokemon Legends ZA next year to as wide a market as possible.
