You’ve been pulled over with a Byrna in your car… now what?
So you MAY have been going slightly over the speed limit… And now the officer is at your window AND you’re carrying a Byrna launcher in the car. Are you required to or should you say anything about it to the officer?
In this case it’s always important to listen to the exact question the officer asks.
What if he asks... “Do you have any firearms in the vehicle?”
Because none of the Byrna launchers are considered firearms, you could legally tell him "No sir, there are no firearms in the vehicle".
But what if the officer asks…“Do you have any weapons in the car?”
While the legality of having to answer these questions will vary by region, in the vast majority of cases it’s unlikely to negatively impact the situation if you tell the officer something like this... “Yes sir, I have a less-lethal Byrna launcher in my center console.”
The key here is NOT TO REACH FOR IT. Keep your hands in view on the steering wheel during the entire encounter. It is important to understand that more officers are ambushed and killed during traffic stops than any other type of activity. The more comfortable you make them the more likely you are to have a positive encounter.
So while carrying a Byrna in your car probably won't alter the outcome of a traffic stop it WILL assure that if the time comes, you are prepared to defend!

Most do by now as they are often trained on it, or know about a department that "uses something like a Byrna"... Byrna is simply trying to throw their trademark around like it's some kind of glorified token of global knowledge (and probably is from the amount of spam we receive). Most departments have also heard of "launcher/s", however this is also a very poor choice to use as a launcher is any device that is capable of projecting (launching) something not otherwise powered by a single explosive charge (like a gun cartridge charge that is fully contained... note, black powder does not come under this as the primer and charge are loaded separately and remain separate until "loaded*"). *"Loaded..." This is a sticky area of law as there are many views of what loaded actually mean, such that the Bulyrna is actually as "loaded weapon", but is simply "not charged" until you pop the gas chamber/cylinder. So you are actually carrying a "loaded weapon" around just as a modern gunpowder cartridge fired hand gun is a "loaded weapon". Therefore I find it better to clearly say "the safety is on, it is NOT charged and it is located in/by my xxxx".

It's always in your best interest to follow their directions and be honest with them. The majority of officers know what Less Lethal means and what a launcher is, so it shouldn't be an issue to have one. If they do ask you to step out of the car so they can retrieve it, do as they say because they will give it back to you once they see what it is.

It's in your best interests to know what they are and are not allowed to do and say and to know all of your rights in a situation involving law enforcement. A lot, possibly the majority, of law enforcement officers don't know a lot of law.

Honestly, i don't tell officers or anyone that I have a firearm or less than lethal weapons in my car. That's why concealed carry exists. So that nobody knows what you have. Key word.. concealed. The odds of an officer asking to search your vehicle during a speeding traffic stop is literally next to none. Meaning, there's absolutely zero reason on this planet other than you being a goodie two shoes.. that you'd say uhh hey btw.. I have a gun in here, hehe. Literally, nobody's business what I have in my car.

Cops don't want to get shot during a traffic stop and neither do I, so I always turn the interior light on if I'm stopped at night. I also have my DL, registration and insurance card out BEFORE he approaches the window, so I'm not reaching for anything after he gets there. I had one officer thank me for doing it. OTOH, the contents of my car are none of his concern unless he has probable cause.

100% legal. I'm a felon who has been through a traffic stop twice. I first time the cop never even acknowledged I had a byrna. The second cop asked me to step out and asked if he could search. As a felon I can't say no, I told him it was in my door. He searched the vehicle and asked me several questions about it then sent me on my way. Neither time was a concealment issue however.

I say "I have less than lethal devices in my car (or on me)". I never answer the word "weapon/s" as this word is a use by some jurisdictions to mean some kind of device of any kind that has caused a crime or is about to cause a crime or is in the middle of causing a crime. This is important for those who carry knives in the same jurisdictions as a knife is legal and lawful until it becomes a weapon and then it is not. So if you answer the police when he says, do you have a weapon and you say yes I have a launcher launcher that could easily signal to them that you have committed a crime or about to do so.

Even with the "firearm" question, personally I'd still mention the Byrna...just in case he later wanted to search and found it, thinking I'd lied. This cop here is cool but not all cops are the same. NOTE: another way to keep an officer comfortable if you get pulled over at night is to turn on your interior lights before he comes over. He'll feel safer being able to see everything AND you won't have that annoying flashlight shone in your face.

@@jetway756 That was what I was thinking, I live in Nevada which is a "Open carry" state, you do not need a permit to carry any weapon as long as it is seen, BUT you can not "hide" it unless you have a CC permit, so putting it in a center console might be considered "Hidden"

You are not required to answer questions during a traffic stop. Assert your Fourth and Fifth Amendment rights when encountering the police and keep your mouth shut. Remember police are enforcers of illegal laws passed by the states politician's.

Locally here, cops ask about "weapons", not just firearms. Part of their dept protocol is to ask if you have a "bazooka", which I think is intended to sound funny, but basically serve as an additional line of questioning.
